Pope Leo XIV recently warned against &#8220;false mercy&#8221; in annulment decisions, emphasizing that annulments must be based solely on whether a valid marriage existed at the wedding, regardless of later relational issues.<\/p>\n<p>In the U.S., marriage annulments have soared compared to the rest of the world. from 1968 to 1994, annulments increased dramatically, and while numbers decreased somewhat by 2014, they remain high relative to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/the-west-is-killing-marriage-and-its-death-might-kill-the-west\/\" title=\"...s demise in the West threatens the West itself.\">declining marriage rates<\/a>. About 28% of American Catholics now divorce, and 75% marry outside the Church, both trends contrary to Catholic teaching that marriage is a lifelong sacrament instituted by God.<\/p>\n<p>Church tribunals, mostly staffed by priests trained in canon law, handle annulment cases, with appeals going to the Vatican&#8217;s Rota tribunal. Critics say many U.S. tribunals grant annulments too easily,creating confusion about the Church&#8217;s stance on marriage. Catholic leaders involved in the annulment process describe the situation as a &#8220;crisis of faith&#8221; and worry that frequent annulments may undermine the meaning of valid marriage itself. The article calls for U.S. bishops to recognize and address the root causes of this crisis to uphold the Church&#8217;s teachings on marriage and family amid contemporary societal pressures.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>In addition to the sexual abuse <a href=\"https:\/\/www.britannica.com\/topic\/Catholic-Church-Sexual-Abuse-Crisis\" target=\"_blank\" rel=\"noreferrer noopener\">scandal<\/a> that has plagued the Roman Catholic Church, there&rsquo;s another threatening the very foundation of Catholic beliefs on marriage and family: an annulment process that often violates church teaching. The crisis is particularly acute in the United States, where marriage annulments have proliferated.<\/p>\n<p>On Nov. 21, Pope Leo XIV delivered a <a href=\"https:\/\/press.vatican.va\/content\/salastampa\/en\/bollettino\/pubblico\/2025\/11\/21\/251121h.html\" target=\"_blank\" rel=\"noreferrer noopener\">speech<\/a> to the Rota, the church&rsquo;s &ldquo;supreme court,&rdquo; warning that &ldquo;human judgment on the nullity of marriage cannot&hellip;be manipulated by false mercy.&rdquo; He indicated that compassion for those going through annulment proceedings should &ldquo;never [come] at the expense of truth.&rdquo; The only question in marriage annulment proceedings, he said, is whether a valid marriage existed at the time of the wedding &ldquo;despite any relational failure.&rdquo;<\/p>\n<p>Observant Catholics can remarry only after spouses die or a marriage has been declared null, a church declaration that a valid marriage never existed. (A limited <a href=\"https:\/\/www.commonwealmagazine.org\/divorce-annulment-petrine-privilege-catholic-willet-convert\" target=\"_blank\" rel=\"noreferrer noopener\">exception<\/a> exists for certain converts, who must apply directly to the pope.) According to the Roman church, without an annulment once-married persons are still married. That means if a married person divorces but doesn&rsquo;t get an annulment and then civilly marries someone else, that person is committing adultery.<\/p>\n<p>Bishop-established <a href=\"https:\/\/www.vatican.va\/archive\/cod-iuris-canonici\/eng\/documents\/cic_lib7-cann1400-1500_en.html\" target=\"_blank\" rel=\"noreferrer noopener\">tribunals<\/a> in <a href=\"https:\/\/www.usccb.org\/about\/bishops-and-dioceses\/all-dioceses\" target=\"_blank\" rel=\"noreferrer noopener\">194<\/a> U.S. dioceses hear annulment cases. These tribunals consist of one to three judges, usually priests, trained in the church&rsquo;s <a href=\"https:\/\/www.usccb.org\/beliefs-and-teachings\/what-we-believe\/canon-law\" target=\"_blank\" rel=\"noreferrer noopener\">canon law<\/a>. The Rota hears annulment appeals.<\/p>\n<p>&ldquo;The Rota tends to be pretty good,&rdquo; Catholic author John Clark told me. &ldquo;American tribunals are pretty bad.&rdquo; His book, <a href=\"https:\/\/www.amazon.com\/Betrayed-without-Kiss-Defending-Leadership\/dp\/1505127637\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Betrayed Without A Kiss<\/em><\/a><em>, <\/em>examines the attack on matrimony from within the church.<\/p>\n<p>In his explosive book, <em><a href=\"https:\/\/www.amazon.com\/What-God-Has-Joined-Together\/dp\/0195107640?source=ps-sl-shoppingads-lpcontext&amp;ref_=fplfs&amp;psc=1&amp;smid=ATVPDKIKX0DER\" target=\"_blank\" rel=\"noreferrer noopener\">What God Has Joined Together<\/a>: The Annulment Crisis in American Catholicism, <\/em>Notre Dame University professor Robert Vasoli reported that from 1968 to 1994, nullity decrees rose from fewer than 400 to nearly 60,000 per year, with the United States &ldquo;by a wide marginv&hellip; annulling far more marriages than the rest of the Catholic world combined.&rdquo;<\/p>\n<p>The United States accounts for only 6 percent of the world&rsquo;s Catholics, yet grants <a href=\"https:\/\/www.catholicworldreport.com\/2011\/04\/28\/annulment-nation\/\" target=\"_blank\" rel=\"noreferrer noopener\">60 percent<\/a> of the church&rsquo;s annulments. Today, <a href=\"https:\/\/www.catholicculture.org\/news\/headlines\/index.cfm?storyid=19231\" target=\"_blank\" rel=\"noreferrer noopener\">28 percent<\/a> of Catholics divorce. The share of divorced Catholics has more than doubled, while the share of married Catholics has declined in the last 50 years from <a href=\"https:\/\/nineteensixty-four.blogspot.com\/2024\/08\/#:~:text=What%2520has%2520changed%2520more%2520is,(52%2525%2520in%25202022).\" target=\"_blank\" rel=\"noreferrer noopener\">67 to 53 percent.<\/a><\/p>\n<p>Seventy-five percent of Catholics marry outside the church, which is also contrary to church teaching. For Catholics, marriage is supposed to be <a href=\"https:\/\/www.vatican.va\/content\/catechism\/en\/part_two\/section_two\/chapter_three\/article_7\/v_the_goods_and_requirements_of_conjugal_love.html\" target=\"_blank\" rel=\"noreferrer noopener\">lifelong<\/a>. Marriage is deemed a <a href=\"https:\/\/www.catholicnewsagency.com\/resource\/55403\/marriage-in-the-catechism-of-the-catholic-church?__hstc=198926896.bce5fe53b6f34b44231ad950989d475a.1728929109909.1764460430442.1764510613875.271&amp;__hssc=198926896.2.1764510613875&amp;__hsfp=3732782242\" target=\"_blank\" rel=\"noreferrer noopener\">sacrament<\/a> established by Christ, with God &ldquo;the author of marriage&rdquo; at Creation.<\/p>\n<p>The Roman Catechism states that the good of humanity is &ldquo;bound up with the healthy state of conjugal and family life.&rdquo; Scholarly <a href=\"https:\/\/ifstudies.org\/brad-wilcox\" target=\"_blank\" rel=\"noreferrer noopener\">research<\/a> confirms that intact, monogamous marriages are the gold standard for the well-being of spouses, children, and communities on every measurable level.<\/p>\n<p>Pope Leo delivered his address on the tenth anniversary of Pope Francis&rsquo;s <a href=\"https:\/\/www.vatican.va\/content\/francesco\/en\/motu_proprio\/documents\/papa-francesco-motu-proprio_20150815_mitis-iudex-dominus-iesus.html\" target=\"_blank\" rel=\"noreferrer noopener\">alterations<\/a> that made annulment quicker and cheaper. Francis also removed the safeguard of automatic appeals. Afterwards, <a href=\"https:\/\/www.ncronline.org\/annulment-reform-seems-cultivate-change-culture\" target=\"_blank\" rel=\"noreferrer noopener\">reports<\/a> indicated U.S. annulment <a href=\"https:\/\/catholicnewsherald.com\/90-news\/local\/248-local-annulment-cases-up-after-pope-francis-reforms\" target=\"_blank\" rel=\"noreferrer noopener\">filings<\/a> were trending back up.<\/p>\n<p>Sometimes Catholics file for an annulment soon after their civil divorce; some are seeking to remarry. Others who have already left the church file when they want to return and receive <a href=\"https:\/\/www.catholic.com\/qa\/is-it-true-that-a-person-who-is-legally-divorced-cannot-go-to-confession-or-receive-communion-0\" target=\"_blank\" rel=\"noreferrer noopener\">communion<\/a> or become a <a href=\"https:\/\/www.vatican.va\/archive\/cod-iuris-canonici\/eng\/documents\/cic_lib4-cann834-878_en.html#CHAPTER_IV.\" target=\"_blank\" rel=\"noreferrer noopener\">godparent<\/a>.<\/p>\n<p>As judicial vicar of the Diocese of Gallup, Fr. Nathanael Block coordinates the annulment process and serves as tribunal judge. The cases he encounters usually involve Catholics who have left the church and seek to return well after their civil divorce. But &ldquo;yes, there is a crisis,&rdquo; he said, although he&rsquo;s primarily familiar with his own diocese. He pointed out that the United States has more tribunals, hence more cases.<\/p>\n<p>But he reiterated that &ldquo;the presumption is in favor of [the validity of] the marriage. I tell myself I&rsquo;m going to be judged on this. Before I write a sentence, I seek direction: &lsquo;God, tell me how.&rsquo;&rdquo; Block has been a great source of <a href=\"https:\/\/www.ncregister.com\/features\/beverly-willett-atlanta-retreat\" target=\"_blank\" rel=\"noreferrer noopener\">help<\/a> and <a href=\"https:\/\/marysadvocates.org\/services\/heart-of-the-abandoned-spouse-brochure\/?fbclid=IwY2xjawOf52FleHRuA2FlbQIxMQBzcnRjBmFwcF9pZBAyMjIwMzkxNzg4MjAwODkyAAEe725k-o9oqF1pfK1-sS5hyZCjGDIST9k1Cw7JOwEIr05NkXZnGjagj4OFy1g_aem_oyn2u2HQURqE2edlNEpjRw\" target=\"_blank\" rel=\"noreferrer noopener\">comfort<\/a> to Catholics seeking to honor their marriage vows despite societal pressure to move on.<\/p>\n<p>Fr. Andrew <a href=\"https:\/\/diosav.org\/es\/marriage-tribunal\" target=\"_blank\" rel=\"noreferrer noopener\">Larkin<\/a>, a priest and canon lawyer who serves as <a href=\"https:\/\/www.catholicculture.org\/culture\/library\/dictionary\/index.cfm?id=32991&amp;randomterm=false\" target=\"_blank\" rel=\"noreferrer noopener\">defender<\/a> of the marriage bond in Savannah, Georgia, calls the marriage disarray &ldquo;a crisis of faith.&rdquo; Except for converts, he often sees &ldquo;real ignorance&rdquo; about church doctrine on marriage. Indeed, research confirms only 35 percent of Catholics know their church teaches that remarriage after a divorce without an annulment is a <a href=\"https:\/\/www.pewresearch.org\/short-reads\/2015\/09\/09\/relatively-few-u-s-catholics-skipped-annulment-because-of-cost-or-complications\/\" target=\"_blank\" rel=\"noreferrer noopener\">sin<\/a>.<\/p>\n<p>He also <a href=\"https:\/\/amzn.to\/3YuVZYV\" >noted annulment petitions dismissed<\/a> for lack of standing don&rsquo;t show up in annulment statistics. But he agrees this doesn&rsquo;t explain the &ldquo;prevalence of [annulment] affirmatives.&rdquo; And there&rsquo;s an equally serious &ldquo;double-edged sword.&rdquo;<\/p>\n<p>&ldquo;If we&rsquo;re saying all these marriages are invalid, what are we saying about marriage in general? That a valid marriage is hard to find?&rdquo; Larkin said. &ldquo;&hellip;On the flip side, you can&rsquo;t apply a different standard to those who enjoy their marriages. The church has been very specific about marriage being a natural thing. You don&rsquo;t have to be a theologian to approach marriage.&rdquo;<\/p>\n<p>In 2016, Pope Francis claimed &ldquo;the <a href=\"https:\/\/www.catholicnewsagency.com\/news\/34056\/updated-most-marriages-today-are-invalid-pope-francis-suggests\" target=\"_blank\" rel=\"noreferrer noopener\">great majority<\/a> of our sacramental marriages are null.&rdquo; When his statement came under fire, he revised his remarks to &ldquo;a portion.&rdquo; Could Leo be signaling a course correction?<\/p>\n<p>Maybe, although popes routinely address the Rota. &ldquo;<a href=\"https:\/\/www.vatican.va\/content\/john-paul-ii\/en\/speeches\/2002\/january\/documents\/hf_jp-ii_spe_20020128_roman-rota.html\" target=\"_blank\" rel=\"noreferrer noopener\">John Paul II&rsquo;s<\/a> address was even more intense,&rdquo; Larkin noted. And there have been annulment <a href=\"https:\/\/scholarship.law.stjohns.edu\/cgi\/viewcontent.cgi?article=1581&amp;context=tcl\" target=\"_blank\" rel=\"noreferrer noopener\">scandals<\/a> before. Still, Clark considers Leo&rsquo;s speech &ldquo;a big shift. He&rsquo;s identifying a problem, and it&rsquo;s happening very early in his papacy,&rdquo; he said. &ldquo;[Leo&rsquo;s] saying we&rsquo;ve been doing this wrong for a while now, without saying those words.&rdquo;<\/p>\n<p>Less than a month into his papacy, Leo also delivered a powerful <a href=\"https:\/\/www.ncregister.com\/news\/leo-xiv-at-one-month\" target=\"_blank\" rel=\"noreferrer noopener\">homily<\/a> about marriage in St. Peter&rsquo;s Square. A few days after speaking to the Rota, he issued a <a href=\"https:\/\/www.newsweek.com\/pope-leo-updates-marriage-rules-1-4-billion-catholics-11120647\" target=\"_blank\" rel=\"noreferrer noopener\">decree<\/a> condemning polygamy and reiterating that Catholics should commit to one spouse for life.<\/p>\n<p>Leo is a canon lawyer and the first U.S. pope. His namesake <a href=\"https:\/\/www.vatican.va\/content\/leo-xiii\/en\/encyclicals\/documents\/hf_l-xiii_enc_10021880_arcanum.html\" target=\"_blank\" rel=\"noreferrer noopener\">Pope Leo XIII<\/a> focused extensively on marriage. Perhaps Leo hopes his words filter down to the U.S. bishops, Clark said.<\/p>\n<p>In that case, U.S. bishops must identify and acknowledge what&rsquo;s fueling the crisis and take steps to address what many scholars, policy makers, and Catholics have identified as the most serious issue of our times &mdash; the breakdown of American marriage and family.<\/p>\n<hr>\n<p>      A former New York City litigator and copyright attorney, Beverly Willett is the author of the legal thriller in process &ldquo;Nobody&rsquo;s Fault,&rdquo; about a constitutional challenge to no-fault divorce.
