Jean Carroll. The brief argues that Carroll&#8217;s refusal to pursue or allow DNA testing during the trial undermined the reliability of her claims and tainted the verdict. Even though DNA tests of a dress Carroll said she wore during the <a href=\"https:\/\/amzn.to\/3YuVZYV\" >alleged <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/introducing-the-clinton-project\/\" title=\"Introducing the Clinton Project\">mid-1990s<\/a> encounter found<\/a> no sperm cells, she did not compel Trump to submit DNA, and when Trump offered voluntarily to do so in exchange for the dress&#8217;s DNA report, Carroll declined.<\/p>\n<p>The trial judge excluded DNA evidence from the trial, preventing jurors from considering the absence of Trump&#8217;s DNA, which AFL claims was critical rebuttal evidence and affected Trump&#8217;s ability to receive a fair trial. AFL also criticized the use of New York&#8217;s Adult Survivors act, which revived Carroll&#8217;s time-barred claims nearly 30 years after the alleged incident, and the admission of testimony from two other women about decades-old accusations against Trump. The lower courts upheld jury verdicts ordering Trump to pay over $88 million for sexual abuse and defamation, though the jury rejected Carroll&#8217;s rape claim.<\/p>\n<p>AFL contends that the case reflects biased submission of evidentiary rules influenced by political pressures and calls on the Supreme Court to intervene to preserve judicial fairness and integrity. Jean Carroll<\/a>&lsquo;s civil judgments against President <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/donald-trump\/\">Donald Trump<\/a> should be vacated because she declined to pursue or permit DNA testing at trial that could have answered questions about what really happened decades ago, Trump allies argued in a new <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/supreme-court\/\">Supreme Court<\/a> filing that sharply criticizes the trial court&rsquo;s evidentiary rulings.<\/p>\n<p>In an <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/25\/25-573\/387047\/20251211103918138_25-573%20Amicus%20Brief.pdf\">amicus brief<\/a> filed with the high court on Thursday, <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/america-first-legal\/\">America First Legal<\/a>, a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/cbs-sued-by-seal-team-writer-who-claims-heterosexual-white-men-need-extra-qualifications\/\" title=\"CBS faces lawsuit by &#039;SEAL Team&#039; writer alleging bias against heterosexual, white men\">conservative legal group founded<\/a> by senior Trump adviser <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/stephen-miller\/page\/29\/\">Stephen Miller<\/a>, urged the justices to review the U.S. Court of Appeals for the 2nd Circuit&rsquo;s decisions upholding two New York jury verdicts that forced Trump to pay more than $88 million in fees to the former <em>Elle <\/em>magazine columnist. Jean Carroll, left, and former President Donald Trump (AP Photos)<\/figcaption><\/figure>\n<p>Laura Stell, counsel at AFL, said selective application of evidentiary rules threatens public confidence in the judiciary.<\/p>\n<p>&ldquo;Without equal application of the law, in both form and substance, the American justice system unravels,&rdquo; she said. &ldquo;The Supreme Court must intervene to preserve the integrity of our legal process and prevent future abuse.&rdquo;<\/p>\n<p>The filing zeroes in on Carroll&rsquo;s repeated public assertions that a dress she said she wore during the alleged mid-1990s encounter contained Trump&rsquo;s DNA. According to the brief, testing ultimately found no sperm cells on the dress, undercutting Carroll&rsquo;s earlier suggestion that the garment constituted physical proof.<\/p>\n<p>Despite that result, Carroll never moved to compel Trump to submit a DNA sample after the case entered its pretrial stages in early 2023, even though she had sought his DNA sample from 2020 to 2023. At that time, Trump&rsquo;s lawyers repeatedly rejected her requests, <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.nbcnews.com\/politics\/donald-trump\/trump-dna-will-not-used-civil-trial-writer-accused-rape-judge-rules-rcna70807\">arguing she had<\/a> &ldquo;not demonstrated a reasonable basis for such an intrusive request.&rdquo;<\/p>\n<p>During the pretrial period, Trump reversed course and offered to provide a DNA sample voluntarily in exchange for the full DNA report on the dress. Carroll refused, citing timing concerns. On Feb. 15, 2023, U.S. District Judge Lewis Kaplan sided with Carroll and ruled in a <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.nysd.590045\/gov.uscourts.nysd.590045.56.0.pdf\">21-page decision<\/a> that Trump&rsquo;s DNA offer came too late, while acknowledging the dress did not contain any sperm cells on it.<\/p>\n<p>&ldquo;The alleged rape could have occurred without a sufficient quantity or quality of Mr. Trump&rsquo;s DNA to have remained on the dress since the mid-1990s,&rdquo; Kaplan said.<\/p>\n<p>AFL argued that those concerns rang hollow given that Carroll waited decades to sue. The group said the refusal to pursue DNA confirmation, combined with Carroll&rsquo;s public claims that the dress proved her allegation, was powerful evidence bearing directly on credibility.<\/p>\n<p>Jurors never heard any of that. At Carroll&rsquo;s request, the trial judge barred discussion of DNA evidence altogether, reasoning it would be unfairly prejudicial for jurors to infer that the absence of DNA meant Trump&rsquo;s DNA was not on the dress.<\/p>\n<p>The amicus brief calls that ruling backward. According to AFL, the inference was not only reasonable but highly probative in a case that otherwise turned on decades-old allegations with no physical evidence or contemporaneous corroboration.<\/p>\n<p>&ldquo;Federal courts must apply the rules of evidence the same way in every case,&rdquo; said Emily Percival, senior counsel at AFL. &ldquo;What happened here was the opposite: unreliable allegations were admitted, critical rebuttal evidence was excluded, and the result was a verdict divorced not only from the standards that protect every litigant, but also reality itself.&rdquo;<\/p>\n<p>AFL President Gene Hamilton framed the case as an example of political lawfare.<\/p>\n<p>&ldquo;If the rules don&rsquo;t apply equally to everyone, then they don&rsquo;t protect anyone,&rdquo; Hamilton said, urging the court to correct what he called serious errors and reaffirm that justice cannot be bent to fit political narratives.<\/p>\n<p>Beyond DNA evidence, the brief attacks <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.governor.ny.gov\/news\/governor-hochul-signs-adult-survivors-act\">New York&rsquo;s Adult Survivors Act<\/a>, signed by Gov. <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/kathy-hochul\/\">Kathy Hochul<\/a> (D-NY) in 2022, which temporarily revived time-barred claims and allowed Carroll to sue Trump roughly 30 years after the alleged incident. AFL argued that the law was effectively tailored to permit Carroll&rsquo;s case and that its retroactive application undermined core fairness principles.<\/p>\n<p>The filing also challenges the trial court&rsquo;s admission of testimony from two other women describing alleged encounters with Trump from the 1970s and 2005. AFL argued that the courts diluted the traditional balancing required by the Federal Rules of Evidence, allowing decades-old, uncorroborated accusations to be used as propensity evidence despite their prejudicial effect.<\/p>\n<p>The jury ultimately rejected Carroll&rsquo;s rape claim, finding that she failed to prove penetration, yet still found Trump liable for sexual abuse and defamation,&nbsp;<a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/1638923\/jury-orders-trump-to-pay-5-million-in-damages-to-carroll-for-battery-and-defamation\/\">awarding $5 million<\/a>. A second jury ordered Trump to&nbsp;<a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/2821525\/trump-must-pay-83-million-to-carroll\/\">pay an additional $83.3 million<\/a>&nbsp;the following year based on a separate public remark he made denying her allegations.<\/p>\n<p>AFL argued that the DNA evidence and related credibility matters were central to whether Trump acted with &ldquo;actual malice&rdquo; by denying her claims, a required element for alleging defamation by a public figure.<\/p>\n<p><strong><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/3882164\/trump-supreme-court-verdict-e-jean-carroll\/\">TRUMP ASKS SUPREME COURT TO TOSS VERDICT IN E. JEAN CARROLL CASE<\/a><\/strong><\/p>\n<p>Trump <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/3882164\/trump-supreme-court-verdict-e-jean-carroll\/\">petitioned the Supreme Court last month<\/a> after the 2nd Circuit affirmed both judgments and declined to rehear the case en banc.
