Democrats, including California Rep. Ted Lieu and Minnesota Sen. <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/amy-klobuchar\/\">Amy Klobuchar<\/a>, echoed the same warning. And legal scholars say the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/constitution\/\">Constitution<\/a> may cut against Trump&rsquo;s claim that he can unilaterally impose what the president wants to be &ldquo;One Rulebook&rdquo; for the nation&rsquo;s AI sector.<\/p>\n<p>But even Trump&rsquo;s most staunch defenders are telling him to pump the brakes. During an <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/americasvoice.news\/playlists\/show\/the-war-room\/\">episode<\/a> of Steve Bannon&rsquo;s <em>War Room <\/em>podcast on Wednesday, the former adviser said the fallout from the order would be a &ldquo;legal morass.&rdquo;<\/p>\n<p>&ldquo;Trump reiterated today he&rsquo;ll sign an AI EO because we can&rsquo;t be encumbered, even though states will unleash a million lawsuits,&rdquo; Bannon said, predicting the order will face numerous challenges in federal court. <\/p>\n<p>A six-page draft of the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/executive-orders\/\">executive order<\/a> titled &ldquo;Eliminating State Law Obstruction of National AI Policy&rdquo; circulated last month, proposing a federal task force to <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/cdn.sanity.io\/files\/3tzzh18d\/production\/dddda503135f3940ff3cae786c0d816b29745b68.pdf\">challenge state AI statutes<\/a> and raising the possibility of withholding certain broadband funds from states whose AI regulations the administration views as burdensome or inconsistent with its national framework.<\/p>\n<p>All 50 states and several territories introduced AI bills this year, and dozens <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.ncsl.org\/technology-and-communication\/artificial-intelligence-2025-legislation\">enacted substantial measures<\/a>, according to the National Conference of State Legislatures. The forthcoming order would put many of those laws directly in the crosshairs.<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-why-republican-states-are-openly-preparing-for-a-showdown\">Why Republican states are openly preparing for a showdown<\/h2>\n<p>DeSantis, who unveiled an &ldquo;AI bill of rights&rdquo; for <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/florida\/\">Florida<\/a> last week, vehemently declared Trump has no legal authority to override his state&rsquo;s statutes.<\/p>\n<p>&ldquo;An <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-grants-major-security-guarantees-to-qatar-after-israeli-strike\/\" title=\"Trump grants major security guarantees to Qatar after Israeli strike\">executive order doesn&#038;rsquo<\/a>;t\/can&rsquo;t preempt state legislative action,&rdquo; DeSantis wrote on X, arguing only <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/congress\/\">Congress<\/a> can do that.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p lang=\"en\" dir=\"ltr\">An executive order doesn&rsquo;t\/can&rsquo;t preempt state legislative action. Lieu blasted Trump for &ldquo;<a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/x.com\/tedlieu\/status\/1998168076374691892\">a fake Executive Order<\/a>,&rdquo; and Klobuchar said the president&rsquo;s approach &ldquo;<a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/x.com\/amyklobuchar\/status\/1998418453615808673\">threatens to override<\/a>&rdquo; the only safeguards citizens have against deepfakes and AI-enabled scams.<\/p>\n<p>The resistance is not limited to lawmakers. <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/openai\/\">OpenAI<\/a> itself conceded in a <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/cdn.openai.com\/global-affairs\/ostp-rfi\/ec680b75-d539-4653-b297-8bcf6e5f7686\/openai-response-ostp-nsf-rfi-notice-request-for-information-on-the-development-of-an-artificial-intelligence-ai-action-plan.pdf\">15-page memorandum<\/a> to the White House in March that preempting state AI laws &ldquo;will require an act of Congress.&rdquo; That admission gives challengers a clean argument against Trump&rsquo;s legal foundation and undercuts any claim that the executive branch can impose national AI rules on its own.<\/p>\n<p>Republican-run states also worry the order could strip them of the protections they are actively trying to build. <\/p>\n<p>Florida&rsquo;s proposal, <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.flgov.com\/eog\/news\/press\/2025\/governor-ron-desantis-announces-proposal-citizen-bill-rights-artificial\">unveiled on Dec. 4<\/a>, would create an &ldquo;Artificial Intelligence Bill of Rights&rdquo; that gives residents sweeping protections over privacy, data use, parental oversight, and name-image-likeness rights, along with limits on deepfakes, restrictions on Chinese-made AI tools, guardrails on how insurers and chatbots can operate, and strict rules governing AI data centers. Trump&rsquo;s looming executive order could threaten to nullify those statutes at the outset.<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-where-do-states-authorities-start-and-end\">Where do states&rsquo; authorities start and end?<\/h2>\n<p>The conflict goes deeper than preemption and reaches the heart of <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/federalism\/\">federalism<\/a>. A&nbsp;recent&nbsp;<em>Bloomberg<\/em>&nbsp;op-ed&nbsp;by&nbsp;Kevin Frazier&nbsp;of the University of Texas School of Law argues that state laws &ldquo;end at [their] borders,&rdquo; and that the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/justice-department\/\">Justice Department<\/a> has an affirmative <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/news.bloomberglaw.com\/legal-exchange-insights-and-commentary\/trumps-draft-ai-order-would-keep-states-in-their-proper-lanes\">constitutional duty to intervene<\/a> when states project their authority nationwide.<\/p>\n<p>Frazier uses early U.S. history to show the Founding Fathers&rsquo; obsession with preventing extraterritorial state power. Under the Articles of Confederation, states routinely tried to enforce their laws beyond their borders, leading Congress to assemble special courts to stop them. James Madison even proposed giving Congress a veto over every state law before <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/thomas-jefferson\/\">Thomas Jefferson<\/a> scaled it back. The judiciary ultimately became the arbiter, with one guiding question of whether a state law implicates people outside of those states who do not consent to it.<\/p>\n<p>Frazier argues AI laws in states such as <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.jacksonlewis.com\/insights\/californias-new-ai-regulations-take-effect-oct-1-heres-your-compliance-checklist\">California<\/a> and <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.gtlaw.com\/en\/insights\/2025\/10\/new-york-poised-to-be-at-the-forefront-of-ai-regulation-five-bills-await-gov-hochuls-action\">New York<\/a> do exactly that, since AI companies cannot realistically train state-specific models. &ldquo;Like a battery draining from 100% to 1% while you&rsquo;re busy scrolling Instagram, many Americans have failed to take note of the tendency of states such as California regulating beyond their borders,&rdquo; he wrote.<\/p>\n<p>For Frazier, any executive order instructing the DOJ to police state overreach is aligned with core constitutional principles &mdash; as long as it targets extraterritorial regulation. But he is equally clear that states retain discretion to act as &ldquo;laboratories of democracy,&rdquo; so long as the effects of their experiments fall on their own residents. AI, he says, confronts that localized regulatory experimentation because of its inherently national scope.<\/p>\n<p>Many of Trump&rsquo;s more populist allies, including Sen. <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/josh-hawley\/page\/14\/\">Josh Hawley<\/a> (R-MO), have cautioned that any short-term benefits for the U.S. industry would not be worth the unintended consequences of preempting state AI regulations.<\/p>\n<p>Hawley said in October that he would stand firmly against any measure that would undermine protections in his state for children who could be at risk of exploitation or deepfake pornography.<\/p>\n<p>&ldquo;I want to protect kids from all those things, and I want the states to be able to do that. You know? I mean, I think it&rsquo;s a <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/rollcall.com\/2025\/12\/08\/trump-pledges-executive-action-to-counter-state-ai-laws\/\">terrible idea<\/a> to say that, &lsquo;Oh no, states, you can&rsquo;t protect your kids in your own state,&rsquo;&rdquo; Hawley said.<\/p>\n<p>While Congress has been unable to pass many of its espoused ideas to regulate AI at the national level, Hawley&rsquo;s concerns of child exploitation were addressed in part through the passage of the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/white-house\/3416059\/trump-signs-take-it-down-act-first-lady-revenge-pornography\/\">Take It Down Act <\/a>earlier this year, a bill endorsed by first lady <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/melania-trump\/\">Melania Trump<\/a> that makes it a crime to share non-consensual intimate images, or deepfakes, and requires online platforms to implement swift takedown procedures.<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-a-political-rebellion-meets-a-policy-void\">A political rebellion meets a policy void<\/h2>\n<p>Trump&rsquo;s forthcoming order lands in the middle of a regulatory vacuum.
