Two of them, Jerome Gorgon and Erin Creegan, will be confirmed as <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.congress.gov\/bill\/119th-congress\/senate-resolution\/532\/text\">part of a large package<\/a> of nominees next week. The president&rsquo;s U.S. attorneys, in particular, are vulnerable to partisan gridlock, as the blue slip tradition gives <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/democrats-hand-grassley-rare-district-attorney-victories\/\" title=\"... district ... victories\">home state senators veto power<\/a> over nominees, something Democrats have used to block his choices in New York, New Jersey, and other Democratic-run states.&nbsp;<\/p>\n<p>Trump, fuming over that veto power, has attempted to circumvent Senate confirmation altogether and appoint the nominees unilaterally, only to suffer setbacks in court. He&rsquo;s also hit a wall of resistance in the Senate, where Grassley and other Republicans on his committee refuse to scrap the blue slip courtesy, viewing it as helpful when their party is in the minority.<\/p>\n<p>Trump was <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/white-house\/3911309\/trump-blue-slip-hot-mic-alina-habba-resignation\/\">caught on a hot mic<\/a> venting over blue slips earlier this week, but has <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/senate\/3486342\/trump-insults-chuck-grassley-blue-slips\/\">attacked Grassley publicly<\/a> over it.<\/p>\n<p><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/senate\/3908769\/gop-stands-firm-blue-slip-battle-trump-despite-prosecutor-setbacks\/\"><strong>GOP STANDS FIRM IN &lsquo;BLUE SLIP&rsquo; BATTLE WITH TRUMP DESPITE PROSECUTOR SETBACKS<\/strong><\/a><\/p>\n<p>&ldquo;I want Trump to be successful, and the only way he can be successful is if we approve his nominees,&rdquo; Grassley told the <em>Washington Examiner<\/em> on Tuesday. &ldquo;If we did away with the blue slip, you got all the Democrats and at least two Republicans who wouldn&rsquo;t vote for anybody to get out of Judiciary, and he&rsquo;d never get any of his people approved anyway.&rdquo;<\/p>\n<p>&ldquo;I want to produce for the president, and the only way you can produce for the president is to have at least 12 votes in the committee,&rdquo; Grassley added.<\/p>\n<p>In total, Grassley has found bipartisan cooperation from Democratic senators in six states, with the Senate confirming <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.senate.gov\/legislative\/LIS\/roll_call_votes\/vote1191\/vote_119_1_00547.htm\">two other U.S. attorneys<\/a> with their approval in October. Sen. <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/john-fetterman\/\">John Fetterman<\/a> (D-PA) returned a blue slip for David Metcalf in Pennsylvania, while Sens. <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/amy-klobuchar\/\">Amy Klobuchar<\/a> (D-MN) and<a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/tina-smith\/\"> Tina Smith<\/a> (D-MN) did the same for Daniel Rosen, the U.S. attorney for the district of Minnesota.<\/p>\n<p>Those nominees were not especially controversial, advancing out of the Judiciary Committee in large bipartisan votes, but they were the first of Trump&rsquo;s U.S. attorneys to be confirmed in blue states.&nbsp;<\/p>\n<p>&ldquo;Putting aside political differences, he is respected across the board in <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/minnesota\/\">Minnesota<\/a>, and so I thought he would be a good U.S. attorney,&rdquo; Smith said of Rosen, adding that she&rsquo;s known him for years.<\/p>\n<p>In the current batch of blue state nominees, Creegan <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.judiciary.senate.gov\/press\/rep\/releases\/judiciary-committee-advances-nominations-for-assistant-attorney-general-mississippi-and-louisiana-district-courts-and-four-us-attorneys\">advanced<\/a> in an 18-4 committee vote, and Gorgon <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.judiciary.senate.gov\/press\/rep\/releases\/judiciary-committee-advances-judicial-nominations-for-seventh-circuit-and-four-district-courts-along-with-nominations-for-the-director-of-national-drug-control-policy-and-five-us-attorneys\">advanced<\/a> 20-2.<\/p>\n<p>&ldquo;He was an unambiguously qualified candidate with a great record and a great reputation,&rdquo; Sen. <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/elissa-slotkin\/\">Elissa Slotkin<\/a> (D-MI) said of Gorgon, the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/michigan\/\">Michigan<\/a> U.S. attorney nominee who will get a vote next week, adding that she consulted with the White House on his nomination.<\/p>\n<p>&ldquo;There&rsquo;s a process,&rdquo; Slotkin added. &ldquo;And so, of course, we engage back and forth very productively.&rdquo;<\/p>\n<p>Since they will be bundled into a package of 97 total nominees, Democrats are likely to oppose them in the floor vote next week, but the note of bipartisanship stands in stark contrast to the drama unfolding over nominees that Democrats have blocked.<\/p>\n<p>Courts have ruled that four of Trump&rsquo;s U.S. attorneys, named on an acting or interim basis, were serving unlawfully, and while not all were nominated in the Senate, Democrats have either <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.rosen.senate.gov\/2025\/07\/29\/senator-rosen-denounces-trumps-unconstitutional-attempt-to-appoint-sigal-chattah-as-acting-u-s-attorney-for-the-district-of-nevada\/\">promised to withhold<\/a> a blue slip or <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonpost.com\/national-security\/2025\/10\/28\/trump-prosecutor-los-angeles-unlawful-appointment\/\">expressed opposition<\/a> to them.<\/p>\n<p>Those disqualified nominees have been serving in California, Nevada, and Virginia, while a fourth, Alina Habba, his prosecutor for New Jersey, <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3910469\/former-trump-lawyer-alina-habba-resigns-acting-us-attorney-new-jersey\/\">stepped down Monday<\/a> after the administration lost a bid to appeal the ruling in her case.<\/p>\n<p>Overall, the Senate will have confirmed 31 of Trump&rsquo;s U.S. attorneys by the end of next week, when lawmakers depart for the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/christmas\/\">Christmas<\/a> recess, with the overwhelming majority in states where both senators are Republicans.&nbsp;<\/p>\n<p>Another outlier is <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/jeanine-pirro\/\">Jeanine Pirro<\/a>, the Fox News host-turned-U.S. attorney for the District of Columbia. Despite being a Democratic stronghold, the district has no voting power in Congress and therefore no senators who could withhold a blue slip.<\/p>\n<p>The Senate confirmed Pirro in an August floor vote, with all Democratic senators voting against her.<\/p>\n<p>Democratic senators also <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.kaine.senate.gov\/press-releases\/04\/03\/2025\/warner-and-kaine-announce-recommendations-for-us-attorneys-for-the-eastern-and-western-districts-of-virginia\">returned blue slips<\/a> for Todd Gilbert and Erik Siebert, both of whom were tapped for prosecutor posts in Virginia, but the nominees resigned before the confirmation process was completed, reportedly under pressure from the White House.<\/p>\n<p>Seibert had been unwilling to pursue an indictment against New York Attorney General <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/letitia-james\/\">Letitia James<\/a>, one of Trump&rsquo;s political enemies.
