The settlement resolves claims under the False Claims Act without an admission of guilt. The Department of Justice alleges that NEXT made disguised payments to physicians in Texas and Arkansas as consulting or medical director fees to induce them to order lab tests. Additionally, the lab allegedly paid commissions to independent marketers based on referral volume and value, creating improper financial incentives unrelated to patient care. The settlement includes potential additional payments depending on certain financial conditions.

The case originated from a whistleblower lawsuit filed by Sunil Wadhwa and Ken Newton, who will receive $113,700 from the settlement.DOJ officials emphasized that financial incentives should not influence medical decisions, as they compromise patient trust and integrity in healthcare. The alleged violations breach the Anti-Kickback Statute, designed to prevent remuneration intended to induce referrals in federally funded health programs like Medicare and Medicaid.

NEXTS settlement includes cooperation with ongoing investigations but does not admit liability. The case highlights heightened scrutiny of conflicts of interest in healthcare, especially concerning laboratory testing and billing practices. the Department of Justice encourages reporting suspected fraud or abuse in healthcare programs.

A Virginia-based laboratory has agreed to pay $758,000 to resolve allegations that it engaged in a kickback scheme with doctors and marketers, highlighting ongoing concerns about financial incentives in healthcare.

The laboratory, NEXT Bio-Research Services LLC (doing business as NEXT Molecular Analytics), is settling claims under the False Claims Act.
