This action is part of the committee&#8217;s investigation into Smith&#8217;s prosecution of former President Donald Trump and his associates during the 2024 election. Smith was appointed in 2022 by Attorney General Merrick Garland to oversee investigations related to Trump&#8217;s handling of documents and his statements about the 2020 election. The committee, led by Chairman Rep. Jim Jordan, alleges that Smith&#8217;s investigation-codenamed &#8220;Arctic Frost&#8221;-was an expansive and politically motivated fishing expedition targeting Trump and others, including GOP senators, some of whose communications where subpoenaed without their knowledge. The committee accuses Smith&#8217;s team of misconduct such as silencing Trump, conducting abusive raids, pressuring defense attorneys, and manipulating evidence. Jim Jordan&rsquo;s <a href=\"https:\/\/judiciary.house.gov\/sites\/evo-subsites\/republicans-judiciary.house.gov\/files\/evo-media-document\/2025-12-03-jdj-to-smith-re-subpoena.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">letter<\/a> demanded Smith appear to testify on Dec. 17, and instructed the former special counsel to turn over documents by Dec. 12.<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2 d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-425119256\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p>Joe Biden&rsquo;s Attorney General Merrick Garland appointed Smith in 2022 to oversee two investigations into Trump, one related to his retention of documents from his first presidency and the other related to views he expressed about the 2020 election. Months earlier, with Garland&rsquo;s approval, the FBI had opened an investigation into Trump codenamed <a href=\"https:\/\/thefederalist.com\/2025\/10\/29\/arctic-frost-docs-expose-breadth-of-biden-dojs-weaponization\/\" target=\"_blank\" rel=\"noreferrer noopener\">Arctic Frost<\/a>, the <a href=\"https:\/\/amzn.to\/3YuVZYV\" >overreaching fishing expedition related<\/a> to critiques of the 2020 election that we now know caught Trump and more than 150 others in its dragnet.<\/p>\n<p>As my colleague Shawn Fleetwood <a href=\"https:\/\/thefederalist.com\/2025\/11\/25\/docs-jack-smith-ignored-constitutional-standards-to-target-gop-senators-in-arctic-frost-probe\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>, recently released records show &ldquo;communications between Smith&rsquo;s team and Biden Justice Department (DOJ) officials about their plans to file subpoenas against more than eight GOP <a href=\"https:\/\/thefederalist.com\/2025\/10\/07\/docs-biden-fbi-spied-on-8-republican-senators-in-get-trump-probe\/\">senators<\/a>.&rdquo; Smith&rsquo;s tactics &mdash; up to and including the acquisition of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-shooting-could-reshape-future-secret-service-directors-washington-examiner\/\" title=\"Trump shooting could reshape future Secret Service directors ... Washington Examiner\">senators&#038;rsquo<\/a>; <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wray-declines-to-confirm-fbis-use-of-geolocation-data-to-track-capitol-rioters-but-says-it-would-not-surprise-me\/\" title=\"Wray Declines to Confirm FBI\u2019s Use of Geolocation Data to Track Capitol Rioters But Says It \u2018Would Not Surprise Me\u2019\">phone records<\/a> without their knowledge &mdash; have been blasted by Republicans as &ldquo;brazen&rdquo; and unconstitutional.<\/p>\n<p>Jordan previously sent Smith an Oct. 14 <a href=\"https:\/\/judiciary.house.gov\/sites\/evo-subsites\/republicans-judiciary.house.gov\/files\/evo-media-document\/2025-10-14-jdj-to-smith-re-ti-request.pdf\">letter<\/a> noting that members of his former <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/sidney-powell-is-an-american-legal-giant\/\" title=\"Sidney Powell Is an American Legal Giant\">special counsel team<\/a> had failed to cooperate with the investigation. Jay Bratt for example, &ldquo;invoked the Fifth Amendment approximately 75 times during his interview.&rdquo;<\/p>\n<p>During its investigation, Smith&rsquo;s team &ldquo;sought to silence President Trump by restricting his public statements about the case, conducted an unnecessary and abusive raid of his residence, attempted to improperly pressure defense counsel with the promise of political patronage, and manipulated key evidence in the investigation,&rdquo; Jordan alleged in his October letter.<\/p>\n<p>Smith has also been uncooperative with the committee&rsquo;s oversight investigation, failing to respond to document requests, according to Jordan. Now, Smith will have to appear to testify or risk being held in contempt.<\/p>\n<p>The committee previously asked Smith to hand over documents relating to his appointment as special counsel, any communications with the Biden-Harris administration about his investigation, and communications related to his &ldquo;charging decisions&rdquo; and &ldquo;tactics.&rdquo;<\/p>\n<hr class=\"wp-block-separator\">\n<div class=\"article-author-description fst-italic\">      Beth Brelje is an elections correspondent for The Federalist.
