First Choice also highlighted that the subpoena was not issued in isolation.<\/p>\n<p>&ldquo;The Attorney General had essentially, what your friends on the other side would say, declared war on pregnancy centers,&rdquo; Justice Amy Coney Barrett noted, pointing out the subpoena was issued in the context of other allegedly hostile activities.<\/p>\n<p>As part of a &ldquo;Strike Force&rdquo; to promote abortion access after Roe v. Wade was overturned in 2022, a &ldquo;consumer alert&rdquo; was issued <a href=\"https:\/\/perma.cc\/5J8A-D4LB\" target=\"_blank\" rel=\"noopener\">warning<\/a> the state that pregnancy centers do not provide abortions. Platkin signed onto a 2023 <a href=\"https:\/\/perma.cc\/DL74-3K6L\" target=\"_blank\" rel=\"noopener\">letter<\/a> that accused pregnancy centers of &ldquo;misleading consumers.&rdquo;<\/p>\n<p>&ldquo;My friends on the other side don&rsquo;t let the actual factual allegations get in the way of telling a story about hostility,&rdquo; Iyer replied.<\/p>\n<p>Pro-life pregnancy centers provided an estimated $452 million worth of services to around 1 million new clients in 2024, <a href=\"https:\/\/lozierinstitute.org\/wp-content\/uploads\/2025\/11\/A-Legacy-of-Life-Love-2025-Rising-to-the-Occasion-with-Unwavering-Care.pdf\" target=\"_blank\" rel=\"noopener\">according<\/a> to a November report.<\/p>\n<p>Nearly 100 pro-life centers and groups have faced attacks since the <a href=\"https:\/\/www.westernjournal.com\/justice-alito-claims-pretty-good-idea-dobbs-leaker-sabotage-created-rift-scotus\/\" target=\"_blank\" rel=\"noopener\">Dobbs<\/a> v. Jackson Women&rsquo;s Health Organization decision was leaked in 2022, <a href=\"https:\/\/catholicvote.org\/2022\/06\/09\/pregnancy-center-attack-tracker\/\" target=\"_blank\" rel=\"noopener\">according<\/a> to Catholic Vote.<\/p>\n<p>First Choice&rsquo;s case is not the only litigation pregnancy centers have faced.<\/p>\n<p>The Second Circuit Court of Appeals <a href=\"https:\/\/adflegal.org\/press-release\/federal-appeals-court-affirms-that-ny-pregnancy-centers-are-free-to-inform-women-about-abortion-pill-reversal\/\" target=\"_blank\" rel=\"noopener\">allowed<\/a> pregnancy centers sued by New York Attorney General Letitia James on Monday to tell women about abortion pill reversal using progesterone.<\/p>\n<p>Colorado attempted to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/when-you-search-pregnancy-on-google-the-top-result-is-for-planned-parenthood\/\" title=\"Top Google result for &#039;Pregnancy&#039;: Planned Parenthood.\">ban abortion pill reversal<\/a>, though a federal judge <a href=\"https:\/\/adflegal.org\/wp-content\/uploads\/2025\/08\/bella-health-and-wellness-v-weiser-2025-08-01-district-decision.pdf\" target=\"_blank\" rel=\"noopener\">struck<\/a> down the <a href=\"https:\/\/adflegal.org\/press-release\/colorado-court-strikes-down-state-law-banning-abortion-pill-reversal\/\" target=\"_blank\" rel=\"noopener\">ban<\/a> in August.<\/p>\n<p>Along with implications for the freedom of association, First Choice raises concerns of donor privacy that have led even some left-leaning organizations like the American Civil Liberties <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/24\/24-781\/373236\/20250829132105924_250827a%20AC%20Brief%20for%20efiling.pdf\" target=\"_blank\" rel=\"noopener\">Union<\/a> to back the pregnancy center&rsquo;s claim.<\/p>\n<p>&ldquo;&lsquo;[Using] using the subpoena power &mdash; or any other power &mdash; to censor, regulate, or chill disfavored speech violates the First Amendment,&rdquo; the ACLU and Foundation for Individual Rights and Expression <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/24\/24-781\/373236\/20250829132105924_250827a%20AC%20Brief%20for%20efiling.pdf\" target=\"_blank\" rel=\"noopener\">argued<\/a> in an amicus brief. &ldquo;That&rsquo;s precisely what First Choice has alleged in this case, and it&rsquo;s sufficient to state a justiciable First Amendment claim.&rdquo;<\/p>\n<div class=\"disclaimer\">\n<p><em>All content created by the Daily Caller News Foundation, an independent and nonpartisan newswire service, is available without charge to any legitimate news publisher that can provide a large audience.
