This decision was made in the case Blanche v. Perlmutter, where the Court deferred action pending decisions in related cases involving Trump&#8217;s firing of Democrat-appointed officials Rebecca Slaughter (Federal Trade Commission) and Lisa Cook (Federal Reserve Board).These cases raise constitutional questions about the statutory protections for certain public officials and whether courts can prevent their removal. Justice Clarence Thomas dissented, expressing support for temporarily pausing the injunction against Perlmutter&#8217;s firing.The outcome of these cases could impact the broader understanding of executive power and the <a href=\"https:\/\/amzn.to\/3YuVZYV\" >independent agency structure established<\/a> under longstanding precedents such as Humphrey&#8217;s Executor v. Perlmutter<\/em>, the high court deferred consideration of a request from the Trump administration to temporarily stay (&ldquo;pause&rdquo;) a September injunction issued by a three-judge panel on the D.C. Circuit Court of Appeals. That directive sought to block the administration from firing Shira Perlmutter, who led the U.S. Copyright Office in the Library of Congress until her&nbsp;<a href=\"https:\/\/rollcall.com\/2025\/10\/27\/supreme-court-asked-to-allow-removal-of-copyright-office-head\/\" target=\"_blank\" rel=\"noreferrer noopener\">termination<\/a>&nbsp;in May.<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2 d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-185073330\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p>As The Federalist previously <a href=\"https:\/\/thefederalist.com\/2025\/10\/28\/doj-asks-scotus-to-end-judicial-interference-with-trumps-firing-of-library-of-congress-official\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>, &ldquo;Perlmutter&rsquo;s dismissal came shortly after Trump removed&nbsp;<a href=\"https:\/\/www.pbs.org\/newshour\/politics\/senate-confirms-carla-hayden-first-woman-african-american-named-librarian-congress#:~:text=Carla%20Hayden%2C%20first%20female%20and,confirmed%20by%20Senate%20%7C%20PBS%20News\" target=\"_blank\" rel=\"noreferrer noopener\">Obama-appointed<\/a>&nbsp;Carla Hayden as Librarian of Congress. Hayden has been replaced by Deputy Attorney General Todd Blanche, who is filling the position on an &lsquo;acting&rsquo; basis.&rdquo;<\/p>\n<p>Associate Justice Clarence Thomas would have granted the administration&rsquo;s request to temporarily pause the injunction.<\/p>\n<p>According to the court&rsquo;s order, consideration of the government&rsquo;s application is deferred pending a decision from the justices in <em>Trump v. Slaughter<\/em> and <em>Trump v. Cook<\/em>. Those cases, which arose earlier this year, center around Trump&rsquo;s firing of Rebecca Slaughter and Lisa Cook, Democrat-appointed members of the Federal Trade Commission (FTC) and Federal Reserve Board of Governors, respectively.<\/p>\n<p>In the former case, a Biden-appointed district court judge issued an injunction preventing Slaughter&rsquo;s dismissal. After failing to obtain a temporary stay on that injunction at the D.C. Circuit Court of Appeals, the administration appealed to SCOTUS, which temporarily <a href=\"https:\/\/thefederalist.com\/2025\/09\/22\/trump-scores-scotus-win-in-bid-to-fire-federal-trade-commission-member\/\" target=\"_blank\" rel=\"noreferrer noopener\">granted<\/a> the government&rsquo;s application in September.<\/p>\n<p>In approving the administration&rsquo;s request, the high court additionally revealed that it would be taking up and hearing arguments in the case, which are currently slated for Dec. 8, 2025. In its <a href=\"https:\/\/thefederalist.com\/2025\/09\/30\/the-federalists-guide-to-the-2025-supreme-court-term\/\" target=\"_blank\" rel=\"noreferrer noopener\">order<\/a>, the justices instructed the parties to address whether &ldquo;the statutory removal protections for members of the Federal Trade Commission violate the separation of powers and, if so, whether[[<em><a href=\"https:\/\/www.oyez.org\/cases\/1900-1940\/295us602\" target=\"_blank\" rel=\"noreferrer noopener\">Humphrey&rsquo;s Executor v. United States<\/a><\/em>]&hellip; should be overruled,&rdquo; and if &ldquo;a federal court may prevent a person&rsquo;s removal from public office, either through relief at equity or at law.&rdquo;<\/p>\n<p>As The Federalist previously <a href=\"https:\/\/thefederalist.com\/2025\/09\/23\/scotus-tees-up-potential-takedown-of-progressives-independent-agencies-theory\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>, <em>Humphrey&rsquo;s Executor <\/em>is a 1935 Supreme Court decision that gave rise to Progressives&rsquo; &ldquo;<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/the-british-deep-state-deposed-pm-liz-truss-after-44-days\/\" title=\"The British Deep State Deposed PM Liz Truss After 44 Days\">independent agencies&#038;rdquo<\/a>; theory and effectively helped birth what has been since been referred to as the &ldquo;administrative state&rdquo; &mdash; a de facto fourth branch of government that&rsquo;s been permitted to operate outside the normal confines of the Constitution for nearly a century.<\/p>\n<p>In Cook&rsquo;s case, SCOTUS <a href=\"https:\/\/thefederalist.com\/2025\/10\/01\/scotus-declines-to-halt-lower-court-blockade-on-fed-gov-lisa-cooks-removal-for-now\/\" target=\"_blank\" rel=\"noreferrer noopener\">declined<\/a> to block a lower court injunction preventing her firing last month.
