Pulte referred Swalwell and other prominent Democrats, including New York Attorney General Letitia James, Federal Reserve governor Lisa Cook, and Senator Adam Schiff, to the Department of Justice (DOJ) based on alleged inconsistencies in their mortgage documents. Swalwell&#8217;s lawsuit alleges that pulte unlawfully accessed and <a href=\"https:\/\/amzn.to\/3YuVZYV\" >disclosed private mortgage records<\/a> from government-sponsored enterprises Fannie Mae and Freddie Mac without consent, violating the Privacy Act of 1974 and retaliating against Swalwell for his First Amendment rights. His referrals have largely been based on inconsistencies found in their loan documents.<\/p>\n<div class=\"recommended-stories\">\n<h2>Recommended Stories<\/h2>\n<ul>\n<li><a href=\"https:\/\/www.washingtonexaminer.com\/news\/house\/3898728\/house-gop-centrists-main-street-caucus-trump-obamacare-plan-confusion-rollout\/\">Republican Main Street Caucus thrown for a loop over &#8216;support&#8217; for Trump&#8217;s Obamacare plan<\/a><\/li>\n<li><a href=\"https:\/\/www.washingtonexaminer.com\/news\/house\/3898326\/mike-johnson-breaks-trump-tucker-carlson-nick-fuentes-interview\/\">Johnson breaks with Trump on whether Carlson should have given Fuentes a platform: &#8216;Openly racist&#8217;<\/a><\/li>\n<li><a href=\"https:\/\/www.washingtonexaminer.com\/news\/house\/3897963\/house-members-new-boosted-security-funds-mobile-duress-system\/\">House members see boosted security funds and new mobile duress system<\/a><\/li>\n<\/ul>\n<\/div>\n<div class=\"article-paywall\">\n<p>Swalwell filed the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.287155\/gov.uscourts.dcd.287155.1.0.pdf\">lawsuit<\/a> against Pulte in the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-announces-new-legal-team-for-impeachment-defense-after-previous-team-collapsed\/\" title=\"Trump Announces New Legal Team For Impeachment Defense After Previous Team Collapsed\">federal district court<\/a> for the District of Columbia on Tuesday.<\/p>\n<p>Counsel for Swalwell alleged in the complaint that Pulte &ldquo;abused his position by scouring databases at Fannie Mae and Freddie Mac&mdash;two government-sponsored enterprises&mdash;for the private mortgage records of several prominent Democrats.&rdquo;<\/p>\n<p>The California representative filed a lawsuit against Pulte, the FHFA, and Fannie Mae and Freddie Mac on two counts: one for violating the Privacy Act of 1974 and one for First Amendment Retaliation.<\/p>\n<p>Swalwell&rsquo;s attorneys wrote that the defendants &ldquo;willfully and intentionally provided&rdquo; Swalwell&rsquo;s mortgage information to the DOJ and media without his &ldquo;prior written consent or knowledge or any lawful justification,&rdquo; in violation of the Privacy Act. <\/p>\n<p>They also alleged that Pulte&rsquo;s referral was &ldquo;calculated to retaliate against and punish&rdquo; Swalwell for exercising his First Amendment rights, calling it &ldquo;arbitrary, capricious, an abuse of discretion, and not in accordance with law.&rdquo;<\/p>\n<p>The complaint pointed to several of Trump&rsquo;s Truth Social <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/112831960855086827\">posts<\/a>, including one in which he called Swalwell a &ldquo;total sleezebag.&rdquo; Swalwell also referenced Trump&rsquo;s <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/115239044548033727\">highly-cited post<\/a> in which he said &ldquo;justice must be served&rdquo; to people such as Comey and James &mdash; <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3857662\/comey-trump-truth-social-post-selective-prosecution\/\">a post<\/a> he reportedly meant to direct message to Attorney General Pam Bondi.<\/p>\n<p>&ldquo;Defendants&rsquo; submission of a criminal referral concerning Plaintiff&rsquo;s confidential mortgage records shortly after President Trump called for the prosecution of his political enemies&mdash;including those who participated in his impeachment&mdash;demonstrates a causal link between Plaintiff&rsquo;s protected First Amendment activities and his being the subject of a criminal complaint,&rdquo; the complaint read.<\/p>\n<p>The FHFA did not respond to the <em>Washington Examiner<\/em>&lsquo;s requests for comment from the agency and Pulte.<\/p>\n<p>&ldquo;When someone commits mortgage fraud, they undermine the faith and integrity of our System. It does not matter who you are &ndash; no one is above the law,&rdquo; Pulte wrote in an August <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/x.com\/pulte\/status\/1958111353505189889?s=20\">X post<\/a> about his referral of Cook to the DOJ.<\/p>\n<p><strong><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/white-house\/3885403\/trump-world-forecloses-onhousing-director-bill-pulte\/\">TRUMPWORLD FORECLOSES ON &lsquo;FALL GUY&rsquo; HOUSING DIRECTOR BILL PULTE AMID MORTGAGE DRAMA CLEANUP<\/a><\/strong><\/p>\n<p>In September, House Judiciary Committee&nbsp;Democrats <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/3799313\/jamie-raskin-investigation-fhfa-director-bill-pulte\/\">opened an investigation<\/a> into Pulte over his mortgage fraud referrals.<\/p>\n<p>Swalwell is also <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/3894398\/speculation-swalwell-governor-announcement-kimmel\/\">running for California governor<\/a> in 2026 to replace term-limited Gov.
