At a press conference in Memphis on Monday, Bondi said the department planned to immediately appeal Currie&rsquo;s ruling and pursue &ldquo;all available legal action,&rdquo; but she declined to elaborate.<\/p>\n<p>The U.S. Court of Appeals would hear any appeal for the 4th Circuit, where the timeline for resolution is uncertain. If the department chooses to re-indict either defendant at a later point, it will need someone with undisputed authority to oversee the charging decisions.<\/p>\n<p><span style=\"box-sizing: border-box; margin: 0px; padding: 0px;\">James&rsquo;s attorney,&nbsp;<a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/white-house\/3786112\/trump-foes-longtime-washington-lawyer-abbe-lowell-defense\/\">Abbe Lowell,<\/a>&nbsp;welcomed the dismissal but said his team is preparing to fight again.<\/span> He warned that any attempts to revive the case will be challenged as politically motivated.<\/p>\n<p>Comey, in a video to supporters released after the ruling, said he <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3897421\/james-comey-case-dismissed-trump-come-after-me-again\/\">expects further attempts to charge him<\/a>. Currie suggested in a footnote that because the indictment was invalid from its inception, it may not have triggered the six-month grace period that normally allows prosecutors to refile charges after the limitations period has expired.<\/p>\n<p>&ldquo;Generally, the return of an indictment tolls the statute of limitations on charges contained in the indictment,&rdquo; Currie wrote. &ldquo;An invalid indictment, however, cannot serve to block the door of limitations as it swings closed.&rdquo;<\/p>\n<p>Legal experts disagree on how much weight that footnote carries. A ruling on vindictive prosecution could have required detailed accounts of behind-the-scenes tactics by Trump and his advisers.<\/p>\n<p>Several judges were also questioning Halligan&rsquo;s work before the grand jury, including revelations that she had not personally shown jurors the final version of the Comey indictment. A ruling voiding the indictment on those grounds would have raised even deeper concerns about her experience and the office&rsquo;s internal processes.<\/p>\n<p>Currie instead issued a ruling that sidestepped those disputes and centered entirely on the legality of Halligan&rsquo;s appointment, an issue that has now fractured multiple federal courts and set up a broader battle over how the administration fills interim U.S. attorney posts.<\/p>\n<p>The White House dismissed the ruling as a technicality. That is now unlikely to happen unless prosecutors bring a new case.<\/p>\n<p>If the DOJ attempts to reindict either defendant, the question of vindictive prosecution will resurface.<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-what-happens-to-halligan-for-now\">What happens to Halligan for now?<\/h2>\n<p>Bondi said Monday that Halligan will remain in the Eastern District as a &ldquo;special&rdquo; U.S. attorney and will continue appearing in court. The DOJ has argued that this designation insulates the rest of the office&rsquo;s work from being jeopardized if the appeals court upholds Currie&rsquo;s ruling.<\/p>\n<p>Halligan&rsquo;s status has created immediate confusion inside the office. According to <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/x.com\/lawofruby\/status\/1993137160921469125\">reporting<\/a> from MSNOW, citing two people familiar with internal Eastern District of Virginia operations, prosecutors were instructed after the ruling to sign court filings under the name of Halligan&rsquo;s first assistant. Whelan said this approach is permissible during a contested appointment, provided that someone with lawful authority signs off.<\/p>\n<p>But there is another complication, <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/x.com\/EdWhelanEPPC\/status\/1993371823505908173\">according to a post on X by Whelan<\/a>: Trump nominated Halligan as the permanent U.S. attorney. Whelan said that the nomination makes her ineligible to serve as acting head under the Vacancies Reform Act because she has not met the minimum required time as first assistant. He said an earlier Office of Legal Counsel opinion supports that view.<\/p>\n<p>Despite the uncertainty, <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.justice.gov\/usao-edva\/staff-profile\/meet-us-attorney\">Halligan&rsquo;s name remained<\/a> on the office&rsquo;s website this week, and she continued appearing on filings in ongoing matters.<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-what-about-other-criminal-cases-brought-during-disputed-appointments-in-other-states\">What about other criminal cases brought during disputed appointments in other states?<\/h2>\n<p>The Halligan ruling is part of a larger nationwide fight over the administration&rsquo;s use of interim and acting U.S. attorneys. Four judges across Virginia, New Jersey, California, and Nevada have reached similar conclusions that the administration exceeded its authority after the 120-day statutory window for interim appointments expired.<\/p>\n<p><span style=\"box-sizing: border-box; margin: 0px; padding: 0px;\">One federal judge in Pennsylvania, who in August reviewed challenges to acting U.S. Attorney Alina Habba&rsquo;s authority to lead the U.S. Attorney&rsquo;s Office in New Jersey,&nbsp;<a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/static.politico.com\/04\/07\/b556e4d04951887f1fd09c6ddeac\/opinion.pdf\">suggested in his ruling<\/a>&nbsp;that prosecutions supervised by an unlawfully appointed leader could be tainted, even when the underlying charges might otherwise be sound.<\/span> That ruling has led defense attorneys in multiple districts to argue that any case touched by a disputed appointee is subject to scrutiny.<\/p>\n<p>John Day, president of the American College of Trial Lawyers, told the&nbsp;<em>Washington Examiner<\/em>&nbsp;the&nbsp;<a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/3857517\/alina-habba-us-attorney-post-faces-uphill-battle-appeals-court\/\">3rd Circuit&rsquo;s review<\/a>&nbsp;of the Habba case &ldquo;needs to <a href=\"https:\/\/amzn.to\/3YuVZYV\" >move quickly&#038;rdquo<\/a>; because the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/federal-appeals-court-hands-texas-a-major-border-win-over-the-biden-administration\/\" title=\"Federal Appeals Court Hands Texas a Major Border Win Over the Biden Administration\">district court&#038;rsquo<\/a>;s ruling now affects charging decisions, grand jury proceedings, and trials in several states.
