This nomination serves as a strategic move to allow Vought to continue acting as head of the agency beyond the 210-day limit set by the Federal Vacancies Reform Act without requiring Senate confirmation. The <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/white-house\/\">White House<\/a> budget director&rsquo;s stated intention is in line with reports that the Trump administration wants to <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/apnews.com\/article\/donald-trump-doge-cfpb-elon-musk-456b747c367fccbcf3b74d2893cd1a35\">cut about 90%<\/a> of the agency&rsquo;s staff.<\/p>\n<p>The CFPB&rsquo;s expected closure stems from its inability to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-administration-determines-cfpbs-funding-mechanism-is-unlawful\/\" title=\"... determines ...&#039;s funding mechanism is unlawful\">legally draw funds<\/a> from the Federal Reserve. The Department of Justice told a federal court last week that the agency expects to run out of funding by early 2026, absent congressional action.<\/p>\n<p>&ldquo;If the Federal Reserve has no profits, it cannot transfer money to the CFPB,&rdquo; DOJ official T. Elliot Gaiser <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cadc.41898\/gov.uscourts.cadc.41898.01208794293.0.pdf\">wrote <\/a>in a court notice. &ldquo;Because the only lawful source of funding from the Federal Reserve has dried up, the proper method for obtaining additional funds is to request them from Congress.&rdquo;<\/p>\n<p>The nomination was received in the Senate and referred to the Committee on Banking, Housing, and Urban Affairs on Tuesday, <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.congress.gov\/nomination\/119th-congress\/652?q=%7B%22search%22%3A%22Stuart+Levenbach%22%7D&amp;s=2&amp;r=1\">according to<\/a> congressional records. It remains unclear whether the committee will proceed with the new nominee&rsquo;s confirmation process.<\/p>\n<p>Sen. <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/tim-scott\/\">Tim Scott<\/a> (R-SC), who chairs the committee, has not publicly commented on the nomination.<\/p>\n<p>Sen. <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/elizabeth-warren\/\">Elizabeth Warren<\/a> (D-MA), who serves as the committee&rsquo;s ranking member and helped establish the agency in 2010, opposed the move.<\/p>\n<p>&ldquo;Donald Trump&rsquo;s sending the Senate a new nominee to lead the CFPB looks like nothing more than a front for Russ Vought to stay on as Acting Director indefinitely as he tries to illegally close down the agency,&rdquo; she <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.banking.senate.gov\/newsroom\/minority\/senator-warren-statement-on-new-trump-cfpb-nominee\">said in a statement<\/a> on Wednesday. &ldquo;Instead of doing everything in their power to lower costs for Americans, Trump and Vought want to make it easier for giant corporations to scam families out of their money.&rdquo;<\/p>\n<p><strong><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/3882802\/trump-administration-determines-cfpb-funding-mechanism-is-unlawful\/\">TRUMP ADMINISTRATION DETERMINES CFPB&rsquo;S FUNDING MECHANISM IS UNLAWFUL<\/a><\/strong><\/p>\n<p>Vought has been serving as the CFPB&rsquo;s acting head since Feb. 7. His term was set to expire in December.<\/p>\n<p>Trump&rsquo;s previous CFPB nominee, Jonathan McKernan, was withdrawn in May.
