The current requirement includes attesting on the form, under penalty of perjury, that the applicant is an American citizen.<\/p>\n<p>The Supreme Court in 2013 struck down an Arizona law requiring proof of citizenship when registering to vote, concluding that states could not create new requirements for federal elections under the NVRA.<\/p>\n<p>The proposed bill is also in response to Washington, D.C., and cities in Maryland, Vermont, and New York that allow noncitizens to vote in local elections.<\/p>\n<p>Noncitizen voting does occur in federal elections, but documented cases are extremely rare.<\/p>\n<p>Recent reported cases include six <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/new-biden-immigration-orders-seek-to-reverse-trumps-policies-streamline-naturalization-process\/\" title=\"New Biden Immigration Orders Seek To Reverse Trump\u2019s Policies, Streamline Naturalization Process\">green card holders<\/a> who were <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.ohioattorneygeneral.gov\/Media\/News-Releases\/October-2024\/Grand-Juries-Indict-6-for-Illegal-Voting\">indicted<\/a> last year for alleged illegal voting in Ohio and a student from China at the University of Michigan who was <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/apnews.com\/article\/michigan-student-noncitizen-voting-charges-china-19edcea1ca92ef163d50282dc55742ba\">charged<\/a> last year with noncitizen voting. A <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/s3.amazonaws.com\/dl.ncsbe.gov\/sboe\/Post-Election%20Audit%20Report_2016%20General%20Election\/Post-Election_Audit_Report.pdf\">state audit<\/a> in North Carolina conducted after the 2016 elections revealed that 41 green card holders voted out of nearly 4.<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/republicans-see-hints-of-an-early-voting-edge-over-democrats-washington-examiner\/\" title=\"... see hints of an early voting edge over Democrats - Washington Examiner\">8 million votes cast<\/a>. A similar <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/apnews.com\/article\/georgia-noncitizens-voter-rolls-14532ef49b66f9cbf34ff483d2534280\">audit<\/a> in Georgia last year identified 20 alleged cases of noncitizen voting out of 8.2 million registered voters.<\/p>\n<p>A broader <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.brennancenter.org\/our-work\/research-reports\/noncitizen-voting-missing-millions\">case study after the 2016 election<\/a> of 42 voting jurisdictions across a dozen states identified 30 likely instances of noncitizens voting out of 23.5 million ballots cast.<\/p>\n<p>Democratic lawmakers and voting rights advocates typically oppose such legislation, arguing it amounts to voter suppression that blocks more U.S. citizens from casting ballots than it does the number of noncitizens. Republicans, meanwhile, say the bill and those like it are safeguards that instill confidence in elections.<\/p>\n<p>&ldquo;It should not be controversial that states have the legal right to prevent noncitizens &mdash; including illegal aliens and o&#64259;cial representatives of foreign adversaries &mdash; from voting in state and federal elections,&rdquo; Britt said.<\/p>\n<figure class=\"wp-block-image size-large\"><figcaption class=\"wp-element-caption\">Sen. (AP Photo\/Mark Schiefelbein, File)<\/figcaption><\/figure>\n<p>The measure, should it be brought to the Senate floor, is unlikely to receive the Democratic support needed to clear a 60-vote filibuster, though Republicans could attempt to pass it as part of a larger piece of legislation.<\/p>\n<p><strong><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/3418889\/republicans-advance-bill-block-noncitizens-voting-dc-elections\/\">REPUBLICANS ADVANCE BILL TO BLOCK NONCITIZENS FROM VOTING IN DC ELECTIONS<\/a><\/strong><\/p>\n<p>&ldquo;Americans deserve to know their elections are secure,&rdquo; Palmer said in a statement. &ldquo;The Citizen Ballot Protection Act is a great step towards restoring faith in the ability to conduct free and fair elections and preventing illegally cast ballots from swaying the outcome.&rdquo;<\/p>\n<p>The bill has garnered early support from several GOP senators, including past and present members of leadership.
