Judge Mae D&#8217;Agostino dismissed the Trump management&#8217;s lawsuit challenging the 2020 &#8220;Protect our Courts Act,&#8221; which restricts <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-to-nominate-texas-sheriff-to-lead-ice\/\" title=\"Biden to Nominate Texas Sheriff to Lead ICE\">federal immigration enforcement<\/a> in state-owned facilities. The judge found that New York is not regulating federal agents but establishing limits on activities within its own properties, which does not violate the supremacy clause.She also cited the 10th Amendment, affirming states&#8217; rights to refuse cooperation with federal immigration enforcement and protecting New York&#8217;s sovereign interests. The Department of Justice plans to appeal the decision. Such conduct does not run afoul of the intergovernmental immunity doctrine.&rdquo;<\/p>\n<p>D&rsquo;Agostino also found that the 10th Amendment allows states to opt out of assisting with federal immigration enforcement and that state officials have intergovernmental immunity from claims made by the Trump administration.<\/p>\n<p>&ldquo;To hold to the contrary would improperly elevate the concerns of the federal sovereign over that of a State and deprive New York of its essential ability to protect its sovereign interests in the face of undue federal interference,&rdquo; D&rsquo;Agostino said.<\/p>\n<p>The Trump administration filed the lawsuit in June, alleging that the 2020 state law has hampered the ability of federal immigration officials to arrest illegal immigrants in state and local courts.
