Moskal&rsquo;s decision was the result of a lawsuit <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/tennesseelookout.com\/2025\/11\/17\/judge-temporarily-blocks-national-guard-deployment-in-memphis\/\">filed<\/a> on October 17 by local and state officials: Shelby County Mayor Lee Harris (D) and Tennessee state Representatives. LA troop ... violated federal ...\">troop deployment violated<\/a> the Tennessee Constitution, claiming that it requires that Guard troops could only be <a target=\"_blank\" href=\"https:\/\/tennesseelookout.com\/2025\/11\/17\/judge-temporarily-blocks-national-guard-deployment-in-memphis\/\" rel=\"noreferrer noopener\">used<\/a> when there are &ldquo;circumstances amounting to a rebellion or invasion,&rdquo; and &ldquo;even then, the legislature must declare, by law, that the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/ag-garland-targets-entire-minneapolis-police-department-with-investigation\/\" title=\"AG Garland Targets Entire Minneapolis Police Department With Investigation\">public safety requires<\/a> it.&rdquo;<\/p>\n<p>Moskal&rsquo;s ruling <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/tennesseelookout.com\/2025\/11\/17\/judge-temporarily-blocks-national-guard-deployment-in-memphis\/\">found<\/a> that the plaintiffs were likely to be successful &ldquo;on the merits of their claims that the Governor&rsquo;s actions in calling the National Guard into the active service of the state to support the Memphis Safe Task Force violate the terms and conditions of Tennessee&rsquo;s Military Code.&rdquo;<\/p>\n<p>&ldquo;The power committed to the Governor as commander-in-chief of the Army and the Militia is not unfettered,&rdquo; <a target=\"_blank\" href=\"https:\/\/tennesseelookout.com\/2025\/11\/17\/judge-temporarily-blocks-national-guard-deployment-in-memphis\/\" rel=\"noreferrer noopener\">wrote<\/a> Moskal. &ldquo;The Tennessee Constitution and the Military Code establish conditions for calling the National Guard into active service and limit the Governor&rsquo;s power and authority.&rdquo;<\/p>\n<p>Yet, while Moskal blocked the order, she also put it on hold and gave five days for an appeal to be filed.<\/p>\n<p>Lee&rsquo;s order stemmed from the creation of the Memphis Safe Task Force, created by President Donald Trump as a response to the high rates of violent crime in the city.
