The DOJ argues these laws are an unconstitutional attempt by the state to regulate federal law enforcement and undermine officer safety. California&#8217;s Governor Gavin Newsom signed these bills-known as the No secret Police Act and the No Vigilantes Act-as part of efforts to restrict aggressive immigration enforcement tactics. The laws require law enforcement officers to display clear identification and ban the wearing of face coverings by ICE agents.In response, the Department of Homeland Security stated it would not comply, asserting the laws violate federal supremacy. Gavin Newsom (D-CA)<a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/policy\/immigration\/3817126\/newsom-bill-banning-ice-agents-from-wearing-face-coverings\/\"> signed legislation<\/a> into law in September designed to clamp down on the Trump administration&lsquo;s immigration operations in the state. The bills included the No Secret Police Act, which bans most federal, local, and out-of<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/gov-desantis-offers-5k-in-bonuses-for-law-enforcement-to-relocate-to-fla-amid-covid-19-vaccination-mandates\/\" title=\"Gov. DeSantis offers K in bonuses for ... to relocate to Fla. amid COVID-19 vaccination mandates\">-state law enforcement officers<\/a> from wearing face coverings, and the<a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/sd25.senate.ca.gov\/news\/governor-newsom-signs-senator-perezs-major-immigration-bills-sb-98-safe-act-and-sb-805-no\"> No Vigilantes Act<\/a>, which requires most law enforcement to display clear identification.<\/p>\n<p>&ldquo;To ICE, unmask. What are you afraid of?&rdquo; the governor said as he signed the bills into law. &ldquo;You&rsquo;re gonna do enforcement? Provide an ID.&rdquo;<\/p>\n<p>In response, the Department of Homeland Security, which oversees ICE, stated that it would <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/policy\/immigration\/3819190\/department-of-homeland-security-not-comply-california-mask-ban-gavin-newsom\/\">not comply<\/a> with the new laws, calling them &ldquo;<a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/3820475\/no-newsoms-california-police-cannot-arrest-masked-ice-officers-former-cops\/\">unconstitutional<\/a>.&rdquo;<\/p>\n<p>&ldquo;At a time that ICE law enforcement faces a 1,000% increase in assaults and their family members are being doxxed and targeted, the sitting Governor of California signed unconstitutional legislation that <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/nyc-council-overrides-adams-on-worker-pay-street-vending-ban\/\" title=\"NYC Council overrides Adams on worker pay, street vending ban\">strips law enforcement<\/a> of protections in a disgusting, diabolical fundraising and PR stunt,&rdquo; DHS wrote.<\/p>\n<p>The Justice Department argued that the state&rsquo;s jurisdiction does not apply to the federal government, with acting U.S. Attorney for the Central District of California Bill Essayli <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/policy\/immigration\/3827181\/trump-administration-directs-federal-agents-to-disregard-newsoms-anti-mask-law\/\">issuing a memo <\/a>directing federal law enforcement heads to disregard the law.<\/p>\n<p>&ldquo;The law is well-settled that, under the Supremacy Clause, state officials cannot control the actions of federal law enforcement officers and an attempt to do so is unconstitutional,&rdquo; Essayli wrote, citing the 1920 case <em>Johnson v. Maryland<\/em>.&nbsp;<\/p>\n<p><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/policy\/immigration\/3817126\/newsom-bill-banning-ice-agents-from-wearing-face-coverings\/\"><strong>NEWSOM SIGNS BILL BANNING ICE AGENTS FROM WEARING FACE COVERINGS<\/strong><\/a><\/p>\n<p>In its 16-page complaint filed Monday, the Trump administration again cited the Supremacy Clause and noted that in June, Newsom cast doubt on the legal validity of the legislation under discussion at that time.&nbsp;<\/p>\n<p>&ldquo;We&rsquo;re looking at the constitutionality of it.
