Fitzpatrick acknowledged that Comey&#8217;s defense has presented a &#8220;particularized and factually based&#8221; argument that investigative missteps, including potential exposure of privileged communications and Fourth Amendment violations, may justify dismissing charges against him. The judge criticized the prosecution,highlighting their reliance on the testimony of an FBI agent who may have <a href=\"https:\/\/amzn.to\/3YuVZYV\" >improperly accessed privileged facts<\/a> but still testified to support the indictment.<\/p>\n<p>Comey faces charges of obstruction and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/hunter-bidens-attorneys-make-desperation-move-to-fight-gun-charges\/\" title=\"Hunter Biden&#039;s lawyers resort to desperate tactics in battling firearm allegations\">making false statements related<\/a> to his 2020 congressional testimony, with a trial scheduled for January 2026. Simultaneously occurring, questions have been raised about the legitimacy of the appointment of interim U.S. Attorney Lindsey Halligan, who led the indictment efforts despite having no prior prosecutorial experience. A senior judge, Cameron Currie, is reviewing the validity of Halligan&#8217;s appointment and the grand jury process, especially since parts of Halligan&#8217;s grand jury presentation were never transcribed, calling into question claims that Attorney General Pam Bondi reviewed the full proceedings.<\/p>\n<p>The DOJ wants these issues treated as clerical errors to preserve the indictments, but Comey and co-defendant New York Attorney General Letitia James argue for dismissal on grounds of unlawful prosecution. (Stefani Reynolds\/Pool via AP)<\/figcaption><\/figure>\n<p>&ldquo;The Court recognizes that the relief sought by the defense is rarely granted,&rdquo; Fitzpatrick wrote in an order <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.vaed.582136\/gov.uscourts.vaed.582136.191.0.pdf\">published to the court docket<\/a> Monday morning. &ldquo;However, the record points to a disturbing pattern of profound investigative missteps, missteps that led an FBI agent and a prosecutor to potentially undermine the integrity of the grand jury proceeding.&rdquo; <\/p>\n<p>Fitzpatrick expressed concern that Halligan&rsquo;s presentation relied entirely on the testimony of a single FBI agent who may have reviewed material subject to Comey&rsquo;s attorney-client privilege with longtime associate <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3868105\/role-of-comey-confidant-center-of-doj-leak-case\/\">Daniel Richman<\/a>, a Columbia Law School professor who doubled as an adviser to Comey when he was director of the FBI. The agent was made aware that he may have inadvertently reviewed the material improperly, Fitzpatrick said, but still &ldquo;proceeded into the grand jury undeterred and testified in support of the pending indictment.&rdquo;<\/p>\n<p>The magistrate judge ruled that Comey&rsquo;s due-process rights outweigh traditional grand jury secrecy and ordered prosecutors to turn over the full set of materials by the end of Monday. The opinion also cited possible <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/fourth-amendment\/\">Fourth Amendment<\/a> violations, exposure to privileged communications, and irregularities during the grand jury presentation.<\/p>\n<p>Comey has pleaded not guilty to charges of obstruction and making false statements related to his 2020 congressional testimony, with a trial set for Jan. 5, 2026.<\/p>\n<p>The disclosure order comes as a separate challenge threatens the validity of the indictment itself. At a hearing last week, U.S. District Judge Cameron Currie questioned the legality of interim U.S. Attorney <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/3858601\/leaked-signal-texts-letitia-james-prosecutor-dont-violate-ethics-rules-experts-say\/\">Lindsey Halligan&rsquo;s<\/a> rushed appointment and the circumstances under which she secured indictments against Comey and New York Attorney General <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/letitia-james\/\">Letitia James<\/a>. (AP Photo\/Jacquelyn Martin)<\/figcaption><\/figure>\n<p>Attorneys for both defendants argue that Halligan&rsquo;s appointment violated the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/constitution\/\">Constitution&rsquo;s<\/a> appointments clause and allowed a politically connected interim prosecutor with no prior prosecutorial experience to override career staff who warned that the evidence was unlikely to persuade a jury.<\/p>\n<p>Currie&rsquo;s skepticism deepened after learning that a portion of <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/3825597\/grand-jury-indicts-former-fbi-director-james-comey\/?utm_source=chatgpt.com\">Halligan&rsquo;s grand jury presentation<\/a>, between 4:28 p.m. and the return of the indictment just after 6:30 on Sept. 25, was never transcribed, casting doubt on later assurances by Attorney General <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/pam-bondi\/\">Pam Bondi<\/a> that she had reviewed Halligan&rsquo;s full grand jury appearances before retroactively approving her actions.<\/p>\n<p>&ldquo;How does the AG say she has reviewed [the materials] when they didn&rsquo;t exist?&rdquo; Currie asked.<\/p>\n<p><strong><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3886117\/doj-urges-judge-not-toss-comey-letitia-james-cases-paperwork-error-lindsey-halligan\/\">DOJ URGES JUDGE NOT TO TOSS COMEY AND JAMES CASES OVER &lsquo;PAPERWORK ERROR&rsquo;<\/a><\/strong><\/p>\n<p>Government lawyers have urged the court to treat the issues as clerical errors and preserve the indictments even if Halligan is disqualified. Both Comey and James are asking for dismissal with prejudice, arguing that the cases were rushed through by an unlawfully appointed prosecutor over internal objections.<\/p>\n<p>Currie has said she expects to rule before Thanksgiving on whether to disqualify Halligan.
