Smacks Down Effort To Nullify Arkansas\u2019 Anti-BDS Law\">appeals court overruled<\/a> a decision from the U.S. District Court for the Northern District of Florida, which said the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/russia-ignores-u-n-court-ordering-end-of-ukraine-war\/\" title=\"Russia Ignores U.N. ... Ordering End of Ukraine War\">court lacked jurisdiction<\/a> under the Foreign Sovereign Immunities Act and the Justice Against Sponsors of Terrorism Act.<\/p>\n<p>&ldquo;One group, or bundle, of the plaintiffs&rsquo; claims &mdash; those based on the theory that the kingdom had been grossly negligent in vetting, hiring, and sending airman al Shamrani to the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/683785\/city-of-pensacola-hit-with-cyberattack-in-wake-of-naval-air-station-shooting\/\">United States<\/a> &mdash; is facially sufficient to survive the jurisdictional attack,&rdquo; Marcus wrote.<\/p>\n<p>The court also ruled on the Justice Against Sponsors of <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/white-house\/3881291\/trump-quietly-meets-syria-former-jihadist-president-white-house\/\">Terrorism<\/a> Act, which upheld claims that the Saudi government failed to vet the accused attacker properly, despite extensive evidence that he was <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/1409218\/gunman-who-opened-fire-at-naval-air-station-pensacola-was-saudi-arabian-flight-student\/\">affiliated<\/a> with al Qaeda and adhered to <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/opinion\/3273645\/terrorist-drone-attacks-lurk-on-the-horizon\/\">extremist<\/a> views, and &ldquo;deliberately&rdquo; sent him to the United States.&nbsp;<\/p>\n<p><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/1409218\/gunman-who-opened-fire-at-naval-air-station-pensacola-was-saudi-arabian-flight-student\/\"><strong>GUNMAN WHO OPENED FIRE AT NAVAL AIR STATION PENSACOLA WAS SAUDI ARABIAN FLIGHT STUDENT&nbsp;<\/strong><\/a><\/p>\n<p>&ldquo;The Amended Complaint sufficiently alleges that the Kingdom committed <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/2398169\/texas-naval-air-station-shooting-was-terrorism-related-and-person-of-interest-may-be-at-large\/\">grossly negligent <\/a>acts of commission rather than omission,&rdquo; the court said. &ldquo;Second, the Amended Complaint asserts that on multiple occasions, Saudi Arabia conducted security screenings for Al Shamrani &mdash; deliberate and affirmative acts of will or exertion designed to accomplish an objective&rdquo; of enrolling him in the training program.<\/p>\n<p>&ldquo;Third, <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/opinion\/beltway-confidential\/3876244\/saudi-purchase-of-f-35s-signals-revival-of-us-alliance\/\">Saudi Arabia<\/a> nominated al Shamrani for, and awarded him, a scholarship which enabled him to go to Texas to learn English from August 2017 until May 2018, and then to participate in the flight training program at NAS <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/2398169\/texas-naval-air-station-shooting-was-terrorism-related-and-person-of-interest-may-be-at-large\/\">Pensacola<\/a> from May of 2018 until the time of the attack on December 6, 2019,&rdquo;
