the Trump-appointed judge wrote in the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.opb.org\/pdf\/FINDINGS%20OF%20FACT%20AND%20CONCLUSIONS%20OF%20LAW_1762564569662.pdf\">106-page order<\/a>.<\/p>\n<p>The final ruling follows a preliminary injunction that prevented troops from being deployed until 5 p.m. local time on Friday.<\/p>\n<p>Immergut held a three-day trial last week featuring testimony from federal, state, and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/51-lawmakers-warn-biden-immigration-order-could-make-border-crisis-catastrophic-overnight\/\" title=\"51 Lawmakers Warn Biden Immigration Order Could Make Border Crisis \u2018Catastrophic Overnight\u2019\">local law enforcement officials<\/a> regarding Trump&rsquo;s claims that protests over <a href=\"https:\/\/amzn.to\/3YuVZYV\" >federal immigration operations prompted<\/a> him to activate the National Guard to protect federal assets and officials. Based on the compiled evidence, the judge said the administration&rsquo;s claims of unruly violence before the deployment were largely unfounded.<\/p>\n<p>&ldquo;While violent protests did occur in June, they quickly abated due to the efforts of civil law enforcement officers. And since that brief span of a few days in June, the protests outside the Portland ICE facility have been predominantly peaceful, with only isolated and sporadic instances of relatively low-level violence, largely between protesters and counterprotesters,&rdquo; she wrote.<\/p>\n<p>Though the ruling is a setback for the federal government, Immergut noted it does not preclude Trump from deploying the National Guard to Oregon in the future if there is justification for doing so. She said that the conditions in Portland did not meet the bar.<\/p>\n<p>&ldquo;When considering these conditions that persisted for months before the President&rsquo;s federalization of the National Guard, this Court concludes that even giving great deference to the President&rsquo;s determination, the President did not have a lawful basis to federalize the National Guard,&rdquo; Immergut said.<\/p>\n<p>The ruling allows the Oregon National Guard to remain under federal control for at least 14 days. However, the National Guard units from Texas and California that were deployed to Oregon are immediately barred under the preliminary injunction.<\/p>\n<p>An appeal <span style=\"box-sizing: border-box; margin: 0px; padding: 0px;\">is likely to be filed by the&nbsp;<a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/trump-administration\/\">Trump administ<\/a><\/span>ration, considering federal lawyers indicated as much during last week&rsquo;s trial.<\/p>\n<p><strong><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3872594\/federal-judge-extends-block-on-portland-national-guard-deployment\/\">JUDGE EXTENDS BLOCK ON PORTLAND NATIONAL GUARD DEPLOYMENT THROUGH FRIDAY<\/a><\/strong><\/p>\n<p>&ldquo;President Trump is using his lawful authority to direct the National Guard to protect federal assets and personnel in Portland following months of violent riots where officers have been assaulted and doxxed by left-wing rioters,&rdquo; <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/department-of-homeland-security\/\">Department of Homeland Security<\/a> spokeswoman Tricia McLaughlin said in response to the ruling. &ldquo;The President&rsquo;s lawful actions will make Portland safer.&rdquo;<\/p>\n<p>Meanwhile, Trump&rsquo;s deployment of the National Guard to <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/chicago\/\">Chicago<\/a> has faced similar court orders from a federal judge and an appeals court.
