The lawsuit challenged a 2024 presidential poll published just days before the election,which predicted Kamala Harris would defeat Donald Trump in Iowa-a prediction that proved inaccurate as Trump won the state by 13 points.Donnelly accused the paper of publishing &#8220;fake news&#8221; and made claims including fraudulent misrepresentation and interference with voting rights. U.S. District judge Rebecca Goodgame Ebinger ruled that Donnelly failed to adequately plead his claims and dismissed the case with prejudice. Selzer expressed relief over the decision, citing First Amendment protections of free speech and press. U.S. District Judge Rebecca Goodgame Ebinger, appointed by former President Barack Obama, dismissed the lawsuit Tuesday.<\/p>\n<p>&ldquo;I am pleased to see this lawsuit has been dismissed. The First Amendment&rsquo;s protection for free speech and a free press held strong. I know that I did nothing wrong, and I am glad the court also concluded that there was never a valid legal claim,&rdquo; Selzer said in a statement.<\/p>\n<p>Donnelly&rsquo;s claims against the poll&rsquo;s publishers included fraudulent misrepresentation, consumer fraud, professional malpractice, and interference with the right to vote.<\/p>\n<p>&ldquo;The <em>Des Moines Register<\/em> here failed in its promise to our client and all of its other subscribers to deliver fair and accurate news,&rdquo; Donnelly&rsquo;s attorney, Daniel Suhr, told a <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.weareiowa.com\/article\/news\/local\/local-politics\/des-moines-register-ann-selzer-iowa-poll-election-trump-district-court\/524-7ef113ab-f8bc-4873-87bf-5efb57cb2c4a\">local Iowa news<\/a> outlet in January.<\/p>\n<p>Ebinger wrote in the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.iasd.90629\/gov.uscourts.iasd.90629.48.0.pdf\">order<\/a> that Donnelly &ldquo;failed to sufficiently plead his claims&rdquo; and granted the defendants&rsquo; motions to dismiss the case with prejudice.<\/p>\n<p>Attorney for the defendants and Foundation for Individual Rights and Expression chief counsel Bob Corn-Revere said the ruling marked &ldquo;a good day for freedom of speech.&rdquo;<\/p>\n<p><strong><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3863912\/court-trump-legal-win-election-interference-case-ann-selzer-iowa-poll\/\">COURT HANDS TRUMP LEGAL WIN IN ELECTION INTERFERENCE CASE OVER 2024 ANN SELZER IOWA POLL<\/a><\/strong><\/p>\n<p>&ldquo;This decision shows where petty politics ends and the rule of law begins.
