This decision overturns a recent 2-1 ruling by a three-judge panel that had temporarily allowed the deployment. the full appeals court&#8217;s order, issued Tuesday, did not specify when the case will be reheard.<\/p>\n<p>The case stems from earlier orders by U.S. District Judge karin Immergut, who ruled that Trump unlawfully federalized Oregon National Guard troops to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/government-report-disproves-bidens-claim-that-trump-had-protesters-tear-gassed\/\" title=\"Government Report Disproves Biden\u2019s Claim That Trump Had Protesters Tear-Gassed\">protect federal property<\/a> in Portland, and later blocked the deployment of any federalized troops, including those from other states. while the three-judge panel had lifted the first order, the second remained in place.<\/p>\n<p>Judge Immergut is set to hold a three-day trial beginning this week to examine whether the deployment was lawful. This trial will be the first to address the merits of Trump&#8217;s federalization and deployment of troops to Democrat-led cities amid civil unrest related to immigration enforcement. Immergut ruled that Trump had unlawfully federalized and deployed troops from the Oregon National Guard to Portland to defend federal assets and personnel. Immergut later issued a second order blocking any federalized troops from being deployed to Portland, after the Trump administration attempted to deploy troops from out of state to the city.<\/p>\n<p>The three-judge panel&rsquo;s ruling had lifted the first order from Immergut, but the second order remained in effect, barring any troops from being sent into Portland. The two judges in the majority, both Trump appointees, had argued Immergut&rsquo;s second order should also be lifted, while the <a href=\"https:\/\/amzn.to\/3YuVZYV\" >lone dissenting judge argued<\/a> it should not be.<\/p>\n<p>Immergut held a hearing late last week to hear arguments on what she should do regarding the second order, following the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/appeals-court-allows-trump-administration-to-freeze-billions-in-foreign-aid-but-challenge-remains-alive\/\" title=\"... ... allows Trump administration to freeze billions in foreign aid but challenge remains alive\">appeals court panel&#038;rsquo<\/a>;s ruling that set aside her first. She had not issued a ruling on the matter before the full appeals court vacated the three-judge panel&rsquo;s favorable ruling toward the Trump administration Tuesday evening.<\/p>\n<p>In her <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-announces-new-legal-team-for-impeachment-defense-after-previous-team-collapsed\/\" title=\"Trump Announces New Legal Team For Impeachment Defense After Previous Team Collapsed\">federal district court<\/a>, Immergut will hold a three-day trial beginning Wednesday over whether Trump lawfully federalized and deployed troops to Portland, even as the full appeals court now weighs action on her first temporary restraining order.<\/p>\n<p>The three-day trial will mark the first such proceeding on the merits of the deployment and federalization of troops to a Democrat-run city amid unrest over immigration enforcement since Trump began doing so with Los Angeles in June. Other cases remain focused on procedural issues.<\/p>\n<p><strong><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3864792\/courts-battle-over-national-guard\/\">COURTS BATTLE ONE ANOTHER OVER NATIONAL GUARD AS TRUMP&rsquo;S PORTLAND DEPLOYMENT FACES TRIAL<\/a><\/strong><\/p>\n<p>U.S. District Judge Charles Breyer held a <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3498988\/doj-legal-arguments-over-la-troop-deployment-met-with-skepticism-at-trial\/\">trial<\/a> in August over whether the deployed troops had violated the Posse Comitatus Act, which prevents federal troops from being used for <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-proceeds-to-consider-new-pause-on-trump-national-guard-use-despite-appeals-court-ruling\/\" title=\"Judge proceeds to consider new pause on Trump ... use despite ... ... ruling\">regular law enforcement activities<\/a>, but did not address the question of the legality of the deployment itself.<\/p>\n<p>Trump&rsquo;s deployment of the National Guard to Los Angeles, Portland, and Chicago has faced lawsuits over whether he has the authority to do so. The Chicago deployment was the first to <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/3855487\/trump-administration-asks-supreme-court-allow-national-guard-deployment-chicago\/\">end up on the Supreme Court&rsquo;s emergency docket<\/a> after both a federal district court and appeals court ruled against Trump.
