The judge&#8217;s decision was influenced by concerns that Robinson wearing jail clothes during widely publicized proceedings could <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/special-counsel-jack-smith-seeks-narrowly-tailored-gag-order-against-trump\/\" title=\"Special ... While Robinson&#8217;s attorneys argued against him <a href=\"https:\/\/amzn.to\/3YuVZYV\" >wearing jail attire<\/a> and restraints at all pretrial sessions, the judge balanced the presumption of innocence against courtroom safety and denied the request to remove restraints. The court ordered that the least restrictive restraints necessary be used, with the possibility for defense counsel to request adjustments if the restraints interfere with communication or note-taking. Robinson faces multiple serious charges related to the alleged assassination at Utah Valley University, with the death penalty as a potential sentence. To date, this has not occurred, and the presumption of innocence remains.&rdquo;<\/p>\n<p>&ldquo;Balancing these factors, the court finds that Mr. Robinson&rsquo;s right to the presumption of innocence outweighs the minimal inconvenience of permitting civilian attire. Mr. Robinson shall be dressed as one who is presumed innocent,&rdquo; Graf added.<\/p>\n<p>Citing the &ldquo;extraordinarily serious&rdquo; charges Robinson faces and the &ldquo;emotional nature of these proceedings,&rdquo; Graf denied Robinson&rsquo;s lawyers&rsquo; request that their client not be required to wear restraints during pretrial proceedings.<\/p>\n<p>&ldquo;The court directs the sheriff&rsquo;s department to conduct an individualized assessment and use the least restrictive restraints necessary to maintain safety. If those restraints impede the defendant&rsquo;s ability to communicate with counsel or take notes, counsel may renew the motion,&rdquo; Graf said in his denial of the request.<\/p>\n<p><strong><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3828760\/tyler-robinson-lawyers-request-delay-voluminous-evidence-charlie-kirk-assassination\/\">ROBINSON&rsquo;S LAWYERS ASK FOR DELAY DUE TO &lsquo;VOLUMINOUS&rsquo; AMOUNT OF DISCOVERY EVIDENCE IN CHARLIE KIRK&rsquo;S ASSASSINATION CASE<\/a><\/strong><\/p>\n<p>The attire Robinson would wear in pretrial hearings was the topic of a closed-door Friday hearing, although Graf sided largely with the defense on Monday. Robinson will be in court next on Jan. 16, 2026, for another pretrial hearing, with a subsequent hearing set for Jan. 30, 2026.<\/p>\n<p>Robinson faces multiple charges for his alleged assassination of Kirk on the Utah Valley University campus last month.
