two Trump appointees and a judge appointed by Joe Biden &mdash; <a href=\"https:\/\/www.westernjournal.com\/trump-celebrates-big-win-gavin-newsom-federal-court-great-decision-country\/\" target=\"_blank\" rel=\"noopener\">ruled unanimously<\/a> that Breyer had overstretched and that the Trump administration was likely to prevail in an ongoing fight over control of the Guard.<\/p>\n<p>The full circuit&rsquo;s refusal to take up the case &mdash;
