The case is an appeal by the Justice Department seeking to uphold this law after the fifth Circuit Court of Appeals ruled it unconstitutional under the Second Amendment.<\/p>\n<p>The law has appeared in high-profile cases, including one involving Hunter Biden, who was found guilty of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/hunter-biden-sues-irs-alleges-breach-of-tax-information-privacy\/\" title=\"Hunter Biden files ...suit against IRS, claims privacy breach in tax information.\">gun charges related<\/a> to this statute, though he was later pardoned by his father, former President Joe Biden.<\/p>\n<p>The Supreme Court&#8217;s review follows a 2022 ruling that gun regulations must align with past traditions. This case, United States v. Hemani, alongside another major gun case from Hawaii, will be heard during the court&#8217;s upcoming term, with decisions expected by mid-2026. Unjustifiable restrictions on that right present a grave threat to Americans&rsquo; most cherished freedoms,&rdquo; the DOJ&rsquo;s petition to the Supreme Court said.<\/p>\n<p>&ldquo;Courts should exercise the utmost vigilance in guarding that right from legislative or regulatory infringement. There are, however, narrow circumstances in which the government may justifiably burden that right, and Section 922(g)(3) provides such a circumstance,&rdquo; the petition added.<\/p>\n<p>The appeals court sided with Ali Hemani&rsquo;s challenge of his single-count indictment under the statute, which he claimed was unconstitutional under the Supreme Court&rsquo;s 2022 decision in <em><a href=\"https:\/\/www.washingtonexaminer.com\/news\/2882136\/supreme-court-rules-new-yorks-strict-concealed-carry-law-is-unconstitutional\/\" target=\"_blank\" rel=\"noreferrer noopener\">New York Rifle &amp; Pistol Association v. Bruen<\/a><\/em>, where the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/gun-groups-ask-court-to-overturn-perilous-precedent-in-suppressor-registration-case\/\" title=\"Gun groups ask court to overturn &#039;perilous precedent&#039; in suppressor registration ...\">high court found gun regulations<\/a> must conform with the country&rsquo;s history and tradition of gun laws.<\/p>\n<p>The Supreme Court&rsquo;s decision to hear the case marks the second major gun case the justices have decided to take up this term. Earlier this month, the court <a href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/3835799\/supreme-court-takes-up-challenge-hawaii-handgun-restrictions\/\" target=\"_blank\" rel=\"noreferrer noopener\">agreed to hear<\/a> a challenge to a Hawaii law that severely restricts where&nbsp;handgun&nbsp;owners may carry their weapons, taking up the case <em>Wolford v. Lopez<\/em>.<\/p>\n<p><strong><a href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/3829193\/eight-cases-to-watch-new-supreme-court-term\/\" target=\"_blank\" rel=\"noreferrer noopener\">EIGHT CASES TO WATCH IN THE NEW SUPREME COURT TERM<\/a><\/strong><\/p>\n<p>The Supreme Court has yet to schedule oral arguments for either <em>United States v. Hemani<\/em> or <em>Wolford v. Lopez<\/em>, but both cases are expected to be argued before the justices sometime between January and April 2026.
