Asks Supreme ... to Save Obamacare\">high court heard arguments<\/a> in a case that could limit the <a href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/3849965\/supreme-court-kickstart-round-of-redistricting-louisiana\/\" target=\"_blank\" rel=\"noreferrer noopener\">Voting Rights Act&rsquo;s power in redistricting<\/a>.<\/p>\n<p>The <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/supreme-court\/\" target=\"_blank\" rel=\"noreferrer noopener\">Supreme Court<\/a> heard rearguments on Wednesday in <em>Louisiana v. Callais<\/em> after <a href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/3456028\/supreme-court-louisiana-gerrymandering-map-racial-redistricting-case\/\" target=\"_blank\" rel=\"noreferrer noopener\">punting<\/a> on a decision at the end of its last term. Gingles<\/em>. The <em>Gingles <\/em>standard finds that if a minority group makes up a significant portion of a state&rsquo;s population and lives in a sufficiently compact area, that group should be entitled to elect its preferred candidate via its own congressional district. The <em>Gingles<\/em> holding aimed to curb the unlawful dilution of minority groups&rsquo; voting power in elections by ensuring their representation through VRA opportunity districts.<\/p>\n<p>The Supreme Court&rsquo;s <a href=\"https:\/\/amzn.to\/3YuVZYV\" >conservative majority appeared poised<\/a> to toss out or significantly weaken the 60-year-old racial redistricting requirements.<\/p>\n<p>During oral arguments on Wednesday, Kavanaugh asked Janai Nelson, a lawyer from the NAACP Legal Defense Fund who represented the coalition aiming to maintain the second black-majority district, how much longer race-based redistricting would be necessary to correct for historic inequalities.<\/p>\n<p>&ldquo;This Court&rsquo;s cases, in a variety of contexts, have said that race-based remedies are permissible for a period of time, sometimes for a long period of time, decades, in some cases, but that they should not be indefinite and should have an endpoint,&rdquo; Kavanaugh said. &ldquo;And what exactly do you think the endpoint should be, or how would we know for the intentional use of race to create districts?&rdquo;<\/p>\n<p>Nelson argued that the law itself does not expire, but that &ldquo;court order remedies&rdquo; to fix Section 2 violations of the VRA do have time limits. Kavanaugh responded by asking if there should be a time limit on how the statute is applied for congressional redistricting under the&nbsp;<em>Gingles<\/em>&nbsp;ruling.<\/p>\n<p>&ldquo;I&rsquo;m saying there should not be a time limit,&rdquo; Nelson responded. &ldquo;But I also think it&rsquo;s critical to emphasize that Section 2 does not require a race-based remedy in all circumstances.&rdquo;<\/p>\n<p>Kavanaugh later asked Louisiana Solicitor General Benjamin Agui&ntilde;aga his thoughts on Nelson&rsquo;s assertion that there should be no time limit to race-based redistricting solutions.<\/p>\n<p>&ldquo;The Court has always qualified its voting cases with the caveat that racial stereotyping is bad,&rdquo; Agui&ntilde;aga said. &ldquo;The 14th Amendment forbids it, and in all events, it can&rsquo;t persist. I think anybody remotely involved in redistricting knows those caveats and has been on notice since the 1990s.&rdquo;<\/p>\n<p>Agui&ntilde;aga pointed to recent decisions by the high court, including the <a href=\"https:\/\/www.washingtonexaminer.com\/news\/2578872\/supreme-court-bans-affirmative-action-in-ruling-against-race-conscious-college-admissions-2\/\" target=\"_blank\" rel=\"noreferrer noopener\">2023 decision<\/a> in <em>Students for Fair Admissions v. Harvard<\/em>, which struck down affirmative action in college admissions, as examples of the justices not tolerating any other form of &ldquo;racial stereotyping&rdquo; under the 14th Amendment.<\/p>\n<p>&ldquo;The warning bells have been sounding for decades, and I think that&rsquo;s a long enough notice for anybody involved,&rdquo; Agui&ntilde;aga said.<\/p>\n<p>Louisiana, the Justice Department, and a group of white voters have asked the Supreme Court to rule that the creation of the second majority-black district in Louisiana was unconstitutional, while also tossing out the <em>Gingles<\/em> rules for litigating Section 2 violations. If the Supreme Court overturns <em>Gingles<\/em>, it could have sweeping effects on the congressional maps of nearly a dozen Southern states.<\/p>\n<p>As many as 12 Democratic congressional districts could be redrawn into Republican ones if <em>Gingles<\/em> is tossed, according to <a href=\"https:\/\/messaging-custom-newsletters.nytimes.com\/dynamic\/render?campaign_id=277&amp;emc=edit_nc_20251015&amp;free_trial=0&amp;instance_id=164474&amp;isViewInBrowser=true&amp;nl=the-tilt&amp;paid_regi=1&amp;productCode=NC%C2%AEi_id=65226929&amp;segment_id=207949&amp;sendId=207949&amp;uri=nyt:\/\/newsletter\/a1bc33d3-f633-5fbf-b8e8-0a66739059d9&amp;user_id=011a405a6d1c1f555d38cb2d5538fba5\" target=\"_blank\" rel=\"noreferrer noopener\">analysis<\/a> from the <em>New York Times<\/em>. Another report by left-wing group Fair Fight Action&nbsp;<a href=\"https:\/\/cdn.prod.website-files.com\/664f769adc5cc1607d32b366\/68e58681b33c082c686a91bf_a9a4cc027348464928d3c5d4f61f1f4c_2025%20REPORT_SCOTUS_VRA.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">found<\/a>&nbsp;that as many as 19 Democratic congressional seats could be in jeopardy.<\/p>\n<p><strong><a href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/3849965\/supreme-court-kickstart-round-of-redistricting-louisiana\/\" target=\"_blank\" rel=\"noreferrer noopener\">SUPREME COURT COULD KICKSTART ANOTHER ROUND OF REDISTRICTING WITH LOUISIANA RACE-BASED DISTRICTING CASE<\/a><\/strong><\/p>\n<p>The Supreme Court had the chance to toss the <em>Gingles<\/em> standard in the 2023 <a href=\"https:\/\/www.washingtonexaminer.com\/news\/2585828\/supreme-court-news-justices-reject-alabama-gop-congressional-map-under-voting-rights-act-2\/\" target=\"_blank\" rel=\"noreferrer noopener\">case&nbsp;<em>Allen v. Milligan<\/em><\/a>,&nbsp;but upheld the framework in a 5-4 decision that saw Chief Justice John Roberts and Kavanaugh join the liberal justices in the majority. Kavanaugh and Roberts are viewed as the two key swing votes in <em>Louisiana v. Callais<\/em> because of their ruling in <em>Milligan<\/em>, with only one of the two needing to flip from their 2023 holding to toss the <em>Gingles<\/em> standard. <\/p>\n<p>The high court&rsquo;s decision in <em>Louisiana v.
