The Supreme Court recently declined to hear a case involving a Colorado middle school accused of secretly promoting gender ideology and rewarding students who came out as transgender. Although the court rejected the petition without detailed explanation, Alito, joined by Justices Thomas and Gorsuch, issued a statement highlighting the serious national importance of this issue. Alito noted that thousands of schools reportedly have policies that keep gender identity information from parents. Advocacy groups supporting the case expressed disappointment but vowed to continue efforts to ensure parents have the right to be informed about their children’s education and gender-related matters. Simultaneously occurring, similar cases, such as one in Florida involving a secret gender support plan for a student, are awaiting possible Supreme Court review in the upcoming term.

Alito concerned courts are avoiding question of parental rights over transitioning genders in schools

Justice Samuel Alito expressed concern Tuesday that federal courts are attempting to “avoid confronting” the question of whether parental rights are violated when a school transitions a student’s gender without the parents’ permission or knowledge.

The Supreme Court declined to take up a case involving a middle school in Colorado that allegedly hid the promotion of gender ideology to students with their parents’ knowledge, with officials at the school giving prizes to students who “came out” as transgender at Gender and Sexualities Alliance meetings.
