The court deferred ruling on the emergency stay request filed by the Trump administration, which sought to pause a preliminary injunction by a Biden-appointed district judge preventing Cook&#8217;s dismissal. the Supreme Court has scheduled oral arguments on the case for January 2026 and will establish a briefing schedule in the meantime. Cook remains in her position during this period.<\/p>\n<p>The dispute arose after Trump announced Cook&#8217;s firing in august 2025 over allegations of mortgage fraud predating her Fed appointment. Cook sued, leading to the injunction. The Trump administration contends that the Federal Reserve Act gives the president broad authority to remove board members &#8220;for cause&#8221; and argues the injunction improperly interferes with presidential removal power. This case is part of a broader legal challenge on presidential authority over autonomous federal agencies, including a related case concerning the Federal Trade Commission that the Supreme Court will also hear this term. The motion asked the justices to temporarily pause a preliminary injunction issued by a Biden-appointed district judge that blocked Trump from firing Fed Gov. Lisa Cook, also a Biden appointee.<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2 d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-5422894\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p>The Supreme Court said it will defer on issuing a verdict on the matter &ldquo;pending oral argument&rdquo; in the case, which it announced has been scheduled for January 2026. The high court further directed the court clerk to &ldquo;to establish a briefing schedule for <em>amici curiae<\/em> and any supplemental briefs responding to <em>amici<\/em>.&rdquo;<\/p>\n<p>Cook will remain in her position until SCOTUS issues a judgment in the case.<\/p>\n<p>According to a <a href=\"https:\/\/www.fox7austin.com\/news\/judge-blocks-trump-firing-fed-gov-lisa-cook\" target=\"_blank\" rel=\"noreferrer noopener\">local Fox affiliate<\/a>, Trump announced he was firing Cook &ldquo;on Aug. 25 over allegations broached by one of his appointees that she <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-admin-appeals-order-blocking-removal-of-lisa-cook\/\" title=\"... Admin Appeals Order Blocking Removal Of ...\">committed mortgage fraud related<\/a> to two properties she purchased in Ann Arbor, Michigan, and Atlanta in 2021, before she joined the Federal Reserve.&rdquo; <\/p>\n<p>The move prompted Cook to sue over her firing in federal court, leading to the aforementioned preliminary injunction issued by District Judge Jia Cobb. The Trump administration quickly <a href=\"https:\/\/thefederalist.com\/2025\/09\/18\/doj-asks-scotus-to-shut-down-judicial-interference-with-trumps-removal-of-fed-governor\/\" target=\"_blank\" rel=\"noreferrer noopener\">appealed<\/a> to the D.C. Circuit Court of Appeals, of which a three<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/fifth-circuit-upholds-injunction-for-navy-seals-challenging-dod-vaccine-mandate\/\" title=\"Fifth Circuit Upholds ... for Navy SEALs Challenging DOD Vaccine Mandate\">-judge panel rejected<\/a> (2-1) its request to pause the injunction. <\/p>\n<p>In its emergency application for stay presented to the Supreme Court, the federal government <a href=\"https:\/\/thefederalist.com\/2025\/09\/18\/doj-asks-scotus-to-shut-down-judicial-interference-with-trumps-removal-of-fed-governor\/\" target=\"_blank\" rel=\"noreferrer noopener\">requested<\/a> the justices pause Cobbs&rsquo; injunction and argued that its latest filing &ldquo;involves yet another case of improper judicial interference with the President&rsquo;s removal authority&ndash;here, interference with the President&rsquo;s authority to remove members of the Federal Reserve Board of Governors for cause.&rdquo;<\/p>\n<p>&ldquo;The Federal Reserve Act, ch. 6, 38 Stat. 251, broadly authorizes the President to dismiss members of the Board of Governors &lsquo;for cause,&rsquo; without further restricting permissible types of cause,&rdquo; U.S. Solicitor General John Sauer wrote. &ldquo;This Court should stay the district court&rsquo;s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/doj-asks-scotus-to-stop-interference-with-fed-governor-firing\/\" title=\"DOJ Asks SCOTUS To Stop &#039;Interference&#039; With Fed Governor ...\">deeply flawed preliminary injunction<\/a> and should grant an immediate administrative stay.&rdquo;<\/p>\n<p>Thus far, the case is the second in which the Supreme Court will hear oral arguments in this term involving the president&rsquo;s authority to dismiss leading officials of certain executive agencies. <\/p>\n<p>Last week, the high court <a href=\"https:\/\/thefederalist.com\/2025\/09\/22\/trump-scores-scotus-win-in-bid-to-fire-federal-trade-commission-member\/\" target=\"_blank\" rel=\"noreferrer noopener\">agreed<\/a> to take up and hold arguments in <em>Trump v. Slaughter<\/em>, which centers around Trump&rsquo;s firing of a Democrat member of the Federal Trade Commission. The case could ultimately lead to the <a href=\"https:\/\/thefederalist.com\/2025\/09\/23\/scotus-tees-up-potential-takedown-of-progressives-independent-agencies-theory\/\" target=\"_blank\" rel=\"noreferrer noopener\">overturning<\/a> of the precedent established in <em><a href=\"https:\/\/www.oyez.org\/cases\/1900-1940\/295us602\" target=\"_blank\" rel=\"noreferrer noopener\">Humphrey&rsquo;s Executor v.
