MSNBC legal analyst Danny Cevallos expressed skepticism about Comey&#8217;s chances of getting the case dismissed before trial,noting that motions to dismiss on grounds such as selective prosecution or pretrial publicity rarely succeed. Although I&rsquo;ll say if ever there was a case for selective prosecution, there is every element of it here,&rdquo; Cevallos said.<\/p>\n<p>&ldquo;The reality is, virtually all federal prosecution is selective by nature. The federal government is one of limited jurisdiction. And that&rsquo;s why these motions almost always lose,&rdquo; he continued.<\/p>\n<p>&ldquo;So as much as Comey would want to knock it out in the beginning, realistically the case may proceed beyond the motions &hellip;&nbsp;realistically, it is tough to get a case tossed on a motion before it goes to trial. Judges do not like to deny prosecutors their opportunity to try the case.&rdquo;<\/p>\n<p>While Comey claimed he didn&rsquo;t &ldquo;authorize someone at the FBI to be an anonymous source,&rdquo; the indictment found his assertion to be inaccurate, <a href=\"https:\/\/www.justice.gov\/opa\/pr\/attorney-general-bondi-director-patel-statements-regarding-indictment-former-fbi-director\" target=\"_blank\" rel=\"noopener noreferrer\">according<\/a>&nbsp;to the DOJ.<\/p>\n<p>The former FBI director maintained his innocence in <a href=\"https:\/\/dailycaller.com\/2025\/09\/25\/james-comey-responds-indictment\/\" target=\"_blank\" rel=\"noopener noreferrer\">response<\/a> to the indictment on Instagram Thursday.<\/p>\n<p>&ldquo;My heart is broken for the Department of Justice, but I have great confidence in the federal judicial system, and I&rsquo;m innocent,&rdquo; Comey said.<\/p>\n<p>&ldquo;So let&rsquo;s have a trial and keep the faith.&rdquo;<\/p>\n<p>Trump <a href=\"https:\/\/dailycaller.com\/2025\/08\/30\/donald-trump-daily-caller-interview-russiagate-john-brennan-james-comey\/\" target=\"_blank\" rel=\"noopener noreferrer\">told<\/a> the Daily Caller in August that it &ldquo;would not bother&rdquo; him to see Comey and former CIA Director John Brennan&nbsp;arrested live on television.<\/p>\n<p>The president also <a href=\"https:\/\/dailycaller.com\/2025\/09\/20\/justice-must-be-served-donald-trump-puts-pam-bondi-on-blast-over-comey-schiff\/?ref=tippinsights.com\" target=\"_blank\" rel=\"noopener noreferrer\">expressed<\/a> frustration with Attorney General Pam Bondi on Saturday, questioning the progress of investigations into Comey, Democratic Sen.
