In a 6-3 decision, the Court issued a stay on a preliminary injunction from the U.S. District Court for the District of Columbia, which had sought to stop these foreign aid cuts under the Impoundment Control Act. The Trump administration had requested emergency relief after being denied by the D.C. Court of Appeals. The majority opinion stated that at this early stage, the government showed sufficient grounds that the Impoundment Control Act bars the lawsuit challenging the cuts, and that the potential harm to the executive&#8217;s foreign affairs outweighed the harm to the respondents. The decision does not resolve the case&#8217;s merits, serving only as interim relief while the government&#8217;s appeal proceeds. Justices Sotomayor, Kagan, and Jackson dissented, with Kagan expressing concern that the ruling disrupts the separation of powers by allowing the executive branch to <a href=\"https:\/\/amzn.to\/3YuVZYV\" >withhold congressionally appropriated funds<\/a>, thus preventing the aid from reaching its recipients. That order tried to prevent Trump from cutting $4 billion in foreign aid approved by Congress (a &ldquo;pocket recession&rdquo;) under the Impoundment Control Act.<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2 d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-352533095\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p>The Trump administration filed its emergency request with the justices after its application for relief was denied by the D.C. Court of Appeals. <\/p>\n<p>Associate Justices Sonia Sotomayor, Elena Kagan, and Ketanji Brown Jackson would have denied the administration&rsquo;s request. <\/p>\n<p>In its <a href=\"https:\/\/www.supremecourt.gov\/opinions\/24pdf\/25a269_bp7c.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Friday order<\/a>, SCOTUS determined that the federal government &ldquo;at this early stage, has made a sufficient showing that the Impoundment Control Act precludes respondents&rsquo; suit, brought pursuant to the Administrative Procedure Act, to enforce the appropriations at issue here.&rdquo; The majority further noted that the administration &ldquo;has also made a sufficient showing that <a href=\"https:\/\/www.law.cornell.edu\/wex\/mandamus\" target=\"_blank\" rel=\"noreferrer noopener\">mandamus<\/a> relief is unavailable to respondents,&rdquo; and that &ldquo;on the record before the Court, the asserted harms to the Executive&rsquo;s conduct of foreign affairs appear to outweigh the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/supreme-court-allows-trump-to-halt-4-billion-in-foreign-aid-for-now\/\" title=\"Supreme ... allows Trump to halt  billion in ... for now\">potential harm faced<\/a> by respondents.&rdquo;<\/p>\n<p>&ldquo;This order should not be read as a final determination on the merits. The relief granted by the Court today reflects our preliminary view, consistent with the standards for interim relief,&rdquo; the majority stated.<\/p>\n<p>Writing for the dissent, Kagan recognized the majority&rsquo;s admission that the court&rsquo;s order is &ldquo;only a &lsquo;preliminary view&rsquo; of the issues raised&rdquo; in the case, but claimed that &ldquo;even at that, the majority goes too far.&rdquo; She further argued that the administration &ldquo;has not met our standard for emergency relief &mdash; the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/u-s-bishops-praise-scotus-ruling-on-death-row-prayer\/\" title=\"U.S. Bishops Praise SCOTUS Ruling on Death Row Prayer\">appropriately high bar<\/a> we have erected because a stay like this one disrupts &lsquo;the ordinary processes of administration and judicial review.&rsquo;&rdquo;<\/p>\n<p>&ldquo;I appreciate that the majority refrains from offering a definitive view of this dispute and the questions raised in it,&rdquo; Kagan wrote. &ldquo;But the effect of its ruling is to allow the Executive to cease obligating $4 billion in funds that Congress appropriated for foreign aid, and that will now never reach its intended recipients. Because that result conflicts with the separation of powers, I respectfully dissent.&rdquo;<\/p>\n<p>The Supreme Court&rsquo;s temporary stay on the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/justice-alito-moves-up-deadline-for-supreme-court-briefing-in-pennsylvania-lawsuit-to-flip-the-election\/\" title=\"Justice Alito Moves Up Deadline For Supreme ...
