The Court granted the governance&#8217;s request to stay an injunction from a Biden-appointed judge that had blocked Trump&#8217;s ability to remove FTC commissioner Rebecca Slaughter,a Democrat. While Justices Sotomayor, Kagan, and Jackson dissented, the supreme Court did not provide reasoning for its emergency decision but will hear the full case in December. The case raises constitutional questions about the statutory removal protections for FTC members, the separation of powers, and whether longstanding precedent (Humphrey&#8217;s Executor v. United States) should be overturned. The stay remains in effect until the Court issues a final ruling. District Judge Loren AliKhan. That ruling <a href=\"https:\/\/www.scotusblog.com\/2025\/09\/supreme-court-permits-trumps-firing-of-ftc-commissioner-to-remain-in-place\/\" target=\"_blank\" rel=\"noreferrer noopener\">attempted<\/a> to bar Trump from using his executive authority to remove FTC member Rebecca Slaughter, a Democrat, from her post.<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2 d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-499713061\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p>Associate Justices Sonia Sotomayor, Elena Kagan, and Ketanji Brown Jackson would have denied the government&rsquo;s request to pause the injunction.<\/p>\n<p>As is typical with decisions on its emergency (or &ldquo;interim&rdquo;) docket, the court did not provide a reasoning for the decision. It did, however, reveal that it has agreed to take up the merits of the case and is poised to hear oral arguments in December.<\/p>\n<p>According to the order, the parties are instructed to answer whether &ldquo;the statutory removal protections for members of the Federal Trade Commission violate the separation of powers and, if so, whether[[<em><a href=\"https:\/\/www.oyez.org\/cases\/1900-1940\/295us602\" target=\"_blank\" rel=\"noreferrer noopener\">Humphrey&rsquo;s Executor v. United States<\/a><\/em>]&hellip; should be overruled,&rdquo; and if &ldquo;a federal court may prevent a person&rsquo;s removal from public office, either through relief at equity or at law.&rdquo;<\/p>\n<p>The court&rsquo;s stay will expire once the justices hand down a judgment in the case.<\/p>\n<p>Writing for the dissent, Kagan whined about the majority regularly granting the Trump administration&rsquo;s emergency requests for stay in cases brought about by <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/listening-to-the-law-gives-americans-get-a-peek-inside-scotus\/\" title=\"Listening To The Law Gives Americans Get A Peek Inside SCOTUS\">leftist-backed lawfare<\/a>. The Obama appointee complained that, as a result of the majority&rsquo;s decisions, it &ldquo;has handed full control of [certain] agencies to the President.&rdquo;<\/p>\n<p>&ldquo;He may now remove&mdash;so says the majority, though Congress said differently&mdash;any member he wishes, for any reason or no reason at all. And he may thereby extinguish the agencies&rsquo; bipartisanship and independence,&rdquo; Kagan wrote. &ldquo;Our emergency docket should never be used, as it has been this year, to permit what our own precedent bars. Still more, it should not be used, as it also has been, to transfer government authority from Congress to the President, and thus to reshape the Nation&rsquo;s separation of powers.&rdquo;<\/p>\n<p>Associate Justice Brett Kavanaugh <a href=\"https:\/\/www.nytimes.com\/2025\/07\/31\/us\/politics\/kavanaugh-supreme-court-emergency.html\" target=\"_blank\" rel=\"noreferrer noopener\">recently<\/a> <a href=\"https:\/\/thefederalist.com\/2025\/08\/01\/justice-kavanaugh-highlights-separation-of-powers-issue-congress-keeps-making-worse\/\" target=\"_blank\" rel=\"noreferrer noopener\">explained<\/a> why the Supreme Court must be wary about offering extended legal opinions for cases on the emergency docket in order to avoid creating a &ldquo;lock-in effect&rdquo; that may not &ldquo;reflect the final view&rdquo; of the court in its final decision on the matter. Associate Justice Amy Coney Barrett also <a href=\"https:\/\/thefederalist.com\/2025\/09\/16\/in-listening-to-the-law-justice-barrett-gives-americans-a-peek-inside-the-supreme-court\/\" target=\"_blank\" rel=\"noreferrer noopener\">addressed<\/a> the use of the interim docket in her <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/fact-check-was-general-mark-milley-arrested-for-treason\/\" title=\"FACT CHECK: Was General Mark Milley Arrested For Treason?\">recently released book<\/a>, noting how the justices are only reacting to matters brought before them and &ldquo;can only resolve disputes that litigants choose to bring; [they] can&rsquo;t volunteer answers to questions that no one has asked.&rdquo;<\/p>\n<p>&ldquo;As long as <a href=\"https:\/\/amzn.to\/3YuVZYV\" >litigants continue filing emergency applications<\/a>, the Court must continue deciding them,&rdquo; Barrett wrote. <\/p>\n<hr class=\"wp-block-separator\">\n<div class=\"article-author-description fst-italic\">      Shawn Fleetwood is a staff writer for The Federalist and a graduate of the University of Mary Washington.
