After the administration&#8217;s appeal to the D.C. Circuit court of Appeals was denied, the DOJ, represented by solicitor General John Sauer, urged the Supreme Court to temporarily stay the injunction while the case proceeds. The administration argues that the President has broad authority under the Federal Reserve Act to remove members of the Board for cause, and claims that Cook does not have a legal property interest in her position. They further assert that allowing Cook to remain woudl cause irreparable harm given her <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/amy-coney-barrett-says-formal-supreme-court-ethics-code-a-good-idea\/\" title=\"Barrett supports formal ethics code for ....\">alleged ethical issues<\/a>, emphasizing the importance of maintaining integrity in the Federal Reserve. That order sought to block the president from removing Cook from her position with the agency. <\/p>\n<div class=\"fdrlst__b89e9-paragraph-2 d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-515885938\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p>Trump announced he was firing Cook &ldquo;on Aug. 25 over allegations broached by one of his appointees that she <a href=\"https:\/\/amzn.to\/3YuVZYV\" >committed mortgage fraud related<\/a> to two properties she purchased in Ann Arbor, Michigan, and Atlanta in 2021, before she joined the Federal Reserve,&rdquo; according to a <a href=\"https:\/\/www.fox7austin.com\/news\/judge-blocks-trump-firing-fed-gov-lisa-cook\" target=\"_blank\" rel=\"noreferrer noopener\">local Fox affiliate<\/a>. <\/p>\n<p>Cobbs&rsquo; ruling prompted the Trump administration to <a href=\"https:\/\/thefederalist.com\/2025\/09\/15\/rests-on-a-series-of-legal-errors-trump-admin-appeals-court-order-blocking-removal-of-fed-governor-lisa-cook\/\" target=\"_blank\" rel=\"noreferrer noopener\">appeal<\/a> to the D.C. Circuit Court of Appeals, asking the higher court to pause the Biden appointee&rsquo;s injunction. A three-judge panel for the appellate court <a href=\"https:\/\/www.politico.com\/news\/2025\/09\/15\/appeals-court-denies-trump-bid-to-remove-federal-reserve-board-member-lisa-cook-00565084\" target=\"_blank\" rel=\"noreferrer noopener\">declined<\/a> (2-1) to do so on Monday.<\/p>\n<p>Writing on behalf of the administration, U.S. Solicitor General John Sauer asked the Supreme Court to place &ldquo;an immediate administrative stay of [Cobbs&rsquo;] preliminary injunction&rdquo; while the merits of the case continue to proceed in the lower courts. He specifically argued that the government&rsquo;s newest application &ldquo;involves yet another case of improper judicial interference with the President&rsquo;s removal authority &mdash; here, interference with the President&rsquo;s authority to remove members of the Federal Reserve Board of Governors for cause.&rdquo;<\/p>\n<p>&ldquo;The Federal Reserve Act, ch. 6, 38 Stat. 251, broadly authorizes the President to dismiss members of the Board of Governors &lsquo;for cause,&rsquo; without further restricting permissible types of cause,&rdquo; Sauer wrote. <\/p>\n<p>The solicitor general went on to argue that the administration is likely to succeed on the merits of the case &ldquo;because Cook lacks a Fifth Amendment property interest in her continued service as a Governor of the Federal Reserve System&rdquo; and that &ldquo;the district court lacked authority to order reinstatement as an equitable remedy for the removal of an officer of the United States.&rdquo; He further claimed that the administration &ldquo;faces irreparable harm&rdquo; if Cook is allowed to remain in her current position.<\/p>\n<p>&ldquo;That the Federal Reserve Board plays a uniquely important role in the American economy only heightens the government&rsquo;s and the public&rsquo;s interest in ensuring that an ethically compromised member does not continue wielding its vast powers,&rdquo; Sauer wrote. &ldquo;Put simply, the President may reasonably determine that interest rates paid by the American people should not be set by a Governor who appears to have lied about facts material to the interest rates she secured for herself &mdash; and refuses to explain the apparent misrepresentations.&rdquo;<\/p>\n<p>&ldquo;This Court should stay the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/federal-appeals-court-hands-texas-a-major-border-win-over-the-biden-administration\/\" title=\"Federal Appeals ... Hands Texas a Major Border Win Over the Biden Administration\">district court&#038;rsquo<\/a>;s deeply flawed preliminary injunction and should grant an immediate administrative stay,&rdquo; he added. <\/p>\n<p><em>Trump v.
