The Georgia Supreme Court has declined to hear an appeal from Fulton County District Attorney Fani Willis, effectively upholding a lower court’s ruling that disqualified her from prosecuting former President Donald Trump in the 2020 election interference and racketeering case.The decision, made by a 4-3 vote, ends Willis’s involvement in the high-profile RICO case and transfers prosecutorial responsibility to a new attorney.<\/p>\n

Willis was removed after it was revealed she had concealed a romantic relationship with special prosecutor Nathan Wade, whom she hired to help lead the investigation.Defense attorneys argued this relationship created a conflict of interest and undermined the prosecution’s integrity. Although Wade resigned in March 2024 following a court order, the georgia Court of Appeals ruled that Willis could not continue in the case due to the appearance of impropriety.<\/p>\n

Willis petitioned the state Supreme Court, arguing that no court had previously disqualified a prosecutor based only on appearance without proof of actual misconduct. Though, the Supreme Court rejected her appeal. consequently, the case must now be reassigned, with the Prosecuting Attorneys’ Council of Georgia overseeing the appointment of a new prosecutor. It remains uncertain whether the new prosecutor will pursue the full range of charges or modify the case.<\/p>\n

The case originates from an August 2023 indictment accusing Trump and 18 others of participating in a racketeering conspiracy to overturn Georgia’s 2020 election results, including Trump’s phone call urging officials<\/a> to “find” votes to change the outcome.Fourteen defendants still face charges, with some having accepted plea deals.
