Court of Appeals to stay a preliminary injunction <a href=\"https:\/\/www.fox7austin.com\/news\/judge-blocks-trump-firing-fed-gov-lisa-cook\" target=\"_blank\" rel=\"noreferrer noopener\">issued<\/a> last week by D.C. District Judge Jia Cobb, a Biden appointee. That order barred President Trump from removing the <a href=\"https:\/\/thefederalist.com\/2024\/07\/23\/democrats-obsession-with-identity-politics-threatens-to-destroy-the-economy\/\" target=\"_blank\" rel=\"noreferrer noopener\">Biden-appointed<\/a> Cook and &ldquo;ruled that Cook would likely succeed in an August lawsuit she filed against Trump over his effort to oust her from the Federal Reserve,&rdquo; according to a <a href=\"https:\/\/www.fox7austin.com\/news\/judge-blocks-trump-firing-fed-gov-lisa-cook\" target=\"_blank\" rel=\"noreferrer noopener\">local Fox affiliate<\/a>.<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2 d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-1913059968\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p>Trump announced he was firing Cook &ldquo;on Aug. 25 over allegations broached by one of his appointees that she <a href=\"https:\/\/amzn.to\/3YuVZYV\" >committed mortgage fraud related<\/a> to two properties she purchased in Ann Arbor, Michigan, and Atlanta in 2021, before she joined the Federal Reserve,&rdquo; the outlet reported.<\/p>\n<p><strong>[READ:[READ:<a href=\"https:\/\/thefederalist.com\/2025\/08\/29\/trump-was-right-to-fire-fed-governor-lisa-cook-and-heres-why\/\" target=\"_blank\" rel=\"noreferrer noopener\">Trump Was Right To Fire Fed Governor Lisa Cook, And Here&rsquo;s Why<\/a>]<\/strong><\/p>\n<p>Sunday&rsquo;s filing echoed arguments the administration made in its <a href=\"https:\/\/www.courtlistener.com\/docket\/71317181\/01208774677\/lisa-cook-v-donald-trump\/\" target=\"_blank\" rel=\"noreferrer noopener\">original appeal<\/a> filed with the D.C. Circuit last Thursday. In that motion, the DOJ characterized Cobb&rsquo;s preliminary injunction as an &ldquo;extraordinary order countermanding the President&rsquo;s exercise of his Article II authority,&rdquo; and contended that the order &ldquo;rests on a series of legal errors.&rdquo;<\/p>\n<p>Citing Supreme Court precedent, the administration argued that &ldquo;when a statute gives a power of removal &lsquo;for cause,&rsquo; without any specification of the causes, the removal decision &lsquo;is a matter of discretion and not reviewable.&rsquo;&rdquo;<\/p>\n<p>It further claimed that Trump &ldquo;had clear cause to remove Cook from office&rdquo;; that &ldquo;there is no basis under the Due Process Clause for enjoining the President&rsquo;s removal of a principal officer&rdquo;; and that &ldquo;the Supreme Court has established that the balance of equities favors the government when a district court reinstates a removed principal officer.&rdquo;<\/p>\n<p>&ldquo;The Court should grant an immediate administrative stay and issue a stay pending appeal,&rdquo; the Thursday filing reads. <\/p>\n<p>In their opposition to the DOJ&rsquo;s motion for appeal filed Saturday, Cook&rsquo;s lawyers <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cadc.42372\/gov.uscourts.cadc.42372.01208775253.0_1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">argued<\/a> that their client&rsquo;s removal from the Federal Reserve would &ldquo;mark an immediate end&rdquo; to what they described as &ldquo;the independence of the Federal Reserve.&rdquo; They further argued that Cook&rsquo;s removal &ldquo;would send a destabilizing signal to the financial markets that could not be easily undone.&rdquo;<\/p>\n<p>The Trump administration has asked the D.C.
