Mark Fusetti (Retired) (@MarkFusetti) <a href=\"https:\/\/twitter.com\/MarkFusetti\/status\/1965542296700727776?\">September 9, 2025<\/a><\/p>\n<\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>Video shows Kelly fighting with Jardine, repeatedly punching her, and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/socialist-party-rips-ocasio-cortez-for-going-to-elitist-met-gala-while-blm-protesters-were-being-arrested-on-pavement-just-outside\/\" title=\"Socialist Party Rips Ocasio-Cortez For Going To Elitist Met Gala While BLM Protesters Were Being Arrested On Pavement Just Outside\">firing multiple shots<\/a> after he wrestled <a href=\"https:\/\/www.westernjournal.com\/good-guy-gun-turns-tables-7-eleven-robbers-florida\/\" target=\"_blank\" rel=\"noopener\">a gun<\/a> away from her.<\/p>\n<p>The clip also includes a final shot fired at the victim as she sat on the ground.<\/p>\n<p>At one point in the video, the man police identified as Kelly lines up a handgun carefully at the victim.<\/p>\n<p>After several seconds, he pulls the trigger.<\/p>\n<p>Kelly was originally charged with murder and a handful of secondary crimes, but on Tuesday, District Attorney <a href=\"https:\/\/www.westernjournal.com\/radical-soros-funded-da-danger-losing-position-opponents-force-runoff-cut-deep-primary-night\/\" target=\"_blank\" rel=\"noopener\">Larry Krasner&rsquo;s<\/a> office downgraded the most serious charge to voluntary manslaughter.<\/p>\n<p>Jeff Hojnowski with the DA&rsquo;s office said the decision to downgrade the charge was based on &ldquo;new evidence.&rdquo;<\/p>\n<p>&ldquo;You hear another gunshot, which I believe to be the fatal gunshot wound,&rdquo; Hojnowski told WCAU.<\/p>\n<p>&ldquo;She was fighting with the homeless guy outside the store,&rdquo; a witness told the news outlet. &ldquo;He shot the woman at least six times.&rdquo;<\/p>\n<p>Witnesses claimed Kelly was attacking or threatening to attack another woman with a screwdriver when Jardine intervened and was ultimately killed by a stolen gun she brought to the interaction.<\/p>\n<p>Jardine was rushed to <a href=\"https:\/\/www.westernjournal.com\/12-year-old-girl-injured-annunciation-school-shooting-released-hospital\/\" target=\"_blank\" rel=\"noopener\">a hospital<\/a> and was pronounced dead there.<\/p>\n<p>To be fair, police said the victim did bring the firearm, which by any objective measure would be considered an escalation.<\/p>\n<p>But anyone who has ever been to a <a href=\"https:\/\/amzn.to\/3YuVZYV\" >rudimentary gun training class<\/a> has almost certainly been told never to behave in such a manner when armed.<\/p>\n<p>We can assume Jardine did not attend one of those classes, as cops said the gun she produced and was killed with was lifted during a burglary.<\/p>\n<p>But none of that changes what is seen on the video.<\/p>\n<p>The video shows a wounded Jardine on the ground and no longer a threat, which made Kelly the aggressor.<\/p>\n<p>Retired Philadelphia cop Mark Fusetti, who d the clip above, argued that on X.<\/p>\n<p style=\"text-align: center;\"><em><strong>WARNING: The following video contains language that might offend some viewers.<\/strong><\/em><\/p>\n<blockquote class=\"twitter-tweet\" data-conversation=\"none\">\n<p dir=\"ltr\" lang=\"en\">Here&rsquo;s why this is not a justified shooting <a href=\"https:\/\/t.co\/zHhpCVKX6C\">pic.twitter.com\/zHhpCVKX6C<\/a><\/p>\n<p>&mdash; Sgt.
