cell named after alleged ringleader Jack &ldquo;Ziz&rdquo; LaSota. The so-called death cult is linked to six killings across the country, including the fatal shooting of Maland.<\/p>\n<p>On Jan.&#8239;20, Youngblut <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.vtd.38914\/gov.uscourts.vtd.38914.5.1_2.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">allegedly<\/a> opened fire on Maland and other officers &ldquo;without warning&rdquo; during an immigration inspection near the Canadian border in Coventry, Vermont.<\/p>\n<p>Felix &ldquo;Ophelia&rdquo; Bauckholt, a fellow &ldquo;Zizian&rdquo; and German national traveling alongside Youngblut, was killed by returning gunfire in an ensuing shootout with responding Border Patrol personnel. (WRAL-TV via AP)<\/figcaption><\/figure>\n<p>Youngblut entered a not guilty plea in the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/maryland-senate-introduces-bill-to-block-minors-from-being-charged-as-adults\/\" title=\"Maryland Senate Introduces Bill to Block Minors From Being ... as Adults\">high-profile murder case<\/a> at a court appearance Friday, the first since federal prosecutors filed upgraded charges and said they would seek the death penalty against her.<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-doj-paves-a-path-to-pursuing-the-death-penalty-against-youngblut\">DOJ paves a path to pursuing the death penalty against Youngblut<\/h2>\n<p>Half a year before the capital indictment, <a href=\"https:\/\/amzn.to\/3YuVZYV\" >federal prosecutors initially lodged lesser firearms-related assault charges<\/a> against Youngblut.<\/p>\n<p>Per the <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.vtd.38914\/gov.uscourts.vtd.38914.5.0.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Jan. 22 criminal complaint<\/a>, Youngblut was only charged with intentional use of a deadly weapon &ldquo;while forcibly assaulting, resisting, opposing, impeding, intimidating, or interfering with federal law enforcement&rdquo; and discharge of a firearm during an assault with a deadly weapon.<\/p>\n<p>Together, the two counts carried a minimum 30-year prison sentence and were not punishable by death.<\/p>\n<p>Murder, a capital crime, was added months later to the charges, after the DOJ revived its death penalty policy and singled out Youngblut&rsquo;s case as a prime example of how the Trump administration will aggressively apply capital punishment when appropriate, especially in law enforcement officer killer cases.<\/p>\n<p><a href=\"https:\/\/www.washingtonexaminer.com\/news\/white-house\/3782829\/trump-proposes-death-penalty-dc-murder-convictions\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>TRUMP PROPOSES DEATH PENALTY FOR DC MURDER CONVICTIONS<\/strong><\/a><\/p>\n<p>In <a href=\"https:\/\/www.justice.gov\/ag\/media\/1388561\/dl?inline\" target=\"_blank\" rel=\"noreferrer noopener\">a Feb. 5 memorandum<\/a> issued shortly after being sworn in, Attorney General Pam Bondi lifted a Biden-era moratorium on federal executions in accordance with Trump&rsquo;s <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/restoring-the-death-penalty-and-protecting-public-safety\/\" target=\"_blank\" rel=\"noreferrer noopener\">executive order<\/a> directing the DOJ to restore use of the death penalty.<\/p>\n<p>Trump&rsquo;s sweeping directive, signed on the day Maland died, declared that DOJ officials should seek the death penalty &ldquo;regardless of other factors&rdquo; against alleged police killers.<\/p>\n<p>Bondi accordingly asserted that federal prosecutors are &ldquo;expected&rdquo; to pursue capital punishment in cases involving the murder of a law enforcement officer and cited Maland&rsquo;s shooting death as one such case in which capital charges would be warranted.<\/p>\n<p>&ldquo;This policy applies to the recent murder of U.S. Customs and Border Patrol agent David Maland during a traffic stop in Vermont,&rdquo; Bondi&rsquo;s department-wide memorandum reads.<\/p>\n<p>In June, the defense claimed in <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.vtd.38914\/gov.uscourts.vtd.38914.80.0.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">a court filing<\/a> that federal prosecutors were fast-tracking the process for pressing death penalty charges against Youngblut.<\/p>\n<p>The defense&rsquo;s motion, which <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.vtd.38914\/gov.uscourts.vtd.38914.90.0.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">unsuccessfully<\/a> sought to extend the deadline for persuading the attorney general&rsquo;s <a href=\"https:\/\/www.justice.gov\/criminal\/capital-case-section\" target=\"_blank\" rel=\"noreferrer noopener\">capital case review committee<\/a> against recommending the death penalty, accused the Trump administration of rushing an &ldquo;unprecedentedly tight timeline&rdquo; that is &ldquo;vastly out of step&rdquo; with DOJ procedures.<\/p>\n<p>DOJ protocol concerning death penalty recommendations typically takes more than a year, Youngblut&rsquo;s attorneys said.<\/p>\n<p>On Aug. 14, a grand jury returned <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.vtd.38914\/gov.uscourts.vtd.38914.96.0.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">a superseding four-count indictment<\/a> charging Youngblut with Maland&rsquo;s murder, among other offenses, thereby elevating the case to death-eligible.<\/p>\n<figure class=\"wp-block-image size-large is-resized\"><figcaption class=\"wp-element-caption\">In this undated and unknown location photo released by the Department of Homeland Security, Border Patrol Agent David Maland poses with a service dog. (Department of Homeland Security via AP)<\/figcaption><\/figure>\n<p>That day, <a href=\"https:\/\/www.justice.gov\/opa\/pr\/seattle-woman-indicted-murder-us-border-patrol-agent-vermont\" target=\"_blank\" rel=\"noreferrer noopener\">at Bondi&rsquo;s direction<\/a>, acting U.S. Attorney for the District of Vermont Michael Drescher submitted <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.vtd.38914\/gov.uscourts.vtd.38914.97.0.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">a notice<\/a> to the court announcing that prosecutors intend to seek the death penalty against Youngblut, specifically for count four: discharge of a firearm during a violent crime resulting in death.<\/p>\n<p>To justify a death sentence, the prosecution must prove <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/18\/3591\" target=\"_blank\" rel=\"noreferrer noopener\">elements of intent<\/a>, such as intent to kill. Federal prosecutors will also attempt to prove several <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/18\/3592\" target=\"_blank\" rel=\"noreferrer noopener\">aggravating factors<\/a> for the court to consider in determining whether a death sentence is justified, including that Youngblut targeted Maland because of his status as a public servant.<\/p>\n<p>The <em>Washington Examiner <\/em>contacted Youngblut&rsquo;s defense counsel for comment.<\/p>\n<p>Youngblut recently acquired new legal representation. <a href=\"https:\/\/www.thejusticecenter.org\/staff\" target=\"_blank\" rel=\"noreferrer noopener\">Christine Lehmann<\/a>, a senior capital attorney at the Louisiana Crisis Assistance Center specializing in defending clients with mental illness and intellectual disabilities, is taking on Youngblut&rsquo;s case.<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-capital-punishment-in-vermont\">Capital punishment in Vermont<\/h2>\n<p>The case&rsquo;s setting is significant, given that capital punishment has a complex history in <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/vermont\/\" target=\"_blank\" rel=\"noreferrer noopener\">Vermont<\/a>.<\/p>\n<p>In 1972, Vermont abolished the death penalty due to the Supreme Court decision in <a href=\"https:\/\/www.oyez.org\/cases\/1971\/69-5030\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Furman v. Georgia<\/em><\/a>  that struck down all existing state-level execution laws. Though other U.S. states amended their respective capital punishment statutes to conform with the Supreme Court ruling, Vermont did not reinstate the death penalty post-<em>Furman<\/em>.<\/p>\n<p>Vermont technically permitted capital punishment for treason until 2024, when <a href=\"https:\/\/legislature.vermont.gov\/bill\/status\/2024\/H.878\" target=\"_blank\" rel=\"noreferrer noopener\">House Bill 878<\/a> replaced <a href=\"https:\/\/legislature.vermont.gov\/statutes\/section\/13\/075\/03401\" target=\"_blank\" rel=\"noreferrer noopener\">the penalty<\/a> with 25 years behind bars or up to lifetime imprisonment plus a possible $50,000 fine.<\/p>\n<p><a href=\"https:\/\/www.washingtonexaminer.com\/news\/796459\/trump-cop-killers-should-immediately-get-the-death-penalty\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>TRUMP: COP KILLERS SHOULD &lsquo;IMMEDIATELY&rsquo; GET THE DEATH PENALTY<\/strong><\/a><\/p>\n<p><a href=\"https:\/\/web.archive.org\/web\/20150514233911\/https:\/\/legislature.vermont.gov\/statutes\/section\/13\/075\/03401\" target=\"_blank\" rel=\"noreferrer noopener\">Previously under the state statute<\/a>, anyone owing allegiance to Vermont &ldquo;who levies war or conspires to levy war &hellip; or adheres to the enemies thereof, giving them aid and comfort, within the State or elsewhere, shall be guilty of treason against this State and shall suffer the punishment of death.&rdquo;<\/p>\n<p>In 2005, <a href=\"https:\/\/deathpenaltyinfo.org\/judge-approves-plea-deal-in-case-that-challenged-the-constitutionality-of-the-federal-death-penalty\" target=\"_blank\" rel=\"noreferrer noopener\">Donald Fell<\/a> was the last defendant sentenced to death in Vermont on federal charges for the murder of a supermarket worker, but a judge tossed out the conviction because of juror misconduct.
