As part of the noncompulsory requests, police departments are asked to then hand the suspects over to federal immigration authorities or at least notify ICE in advance of their release should they be bailed out or let go without bond.<\/p>\n<p>Under the city ordinance, BPD officers are forbidden from detaining a person solely on the basis of a civil immigration detainer after the suspect becomes eligible to be released, except for a few exemptions, such as when a criminal warrant is issued or the subject was convicted of a violent crime.<\/p>\n<p>Since the signing of the Boston Trust Act in 2014, in accordance with the ordinance, the BPD has refused to honor at least 238 detainer requests.<\/p>\n<p><a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3794800\/doj-boston-sanctuary-city-lawsuit-michelle-wu\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>DOJ SUES BOSTON OVER IMMIGRATION ENFORCEMENT: &lsquo;WORST SANCTUARY OFFENDERS&rsquo;<\/strong><\/a><\/p>\n<p>In 2024, BPD Commissioner <a href=\"https:\/\/www.boston.gov\/departments\/466\/michael-cox\" target=\"_blank\" rel=\"noreferrer noopener\">Michael A. Cox<\/a> reported to the Boston city clerk&rsquo;s office that <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mad.288616\/gov.uscourts.mad.288616.1.10.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">15<\/a> civil immigration detainers were lodged with the police department during that calendar year.<\/p>\n<p>&ldquo;DHS has determined that probable cause exists that the subject is a removable alien,&rdquo; ICE personnel said in each <a href=\"https:\/\/www.ice.gov\/doclib\/secure-communities\/pdf\/immigration-detainer-form.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">detention petition<\/a> to the BPD. However, none of the requests were acted upon pursuant to the Boston Trust Act, and zero immigration suspects were further detained by the BPD or transferred over to ICE custody.<\/p>\n<p>Such has been the case for more than a decade in Boston. In 2023, the BPD ignored <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mad.288616\/gov.uscourts.mad.288616.1.9.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">19<\/a> detainers, <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mad.288616\/gov.uscourts.mad.288616.1.8.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">12<\/a> in 2022, <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mad.288616\/gov.uscourts.mad.288616.1.7.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">two<\/a> in 2021, <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mad.288616\/gov.uscourts.mad.288616.1.6.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">107<\/a> in 2018, <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mad.288616\/gov.uscourts.mad.288616.1.5.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">68<\/a> in 2017, and <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mad.288616\/gov.uscourts.mad.288616.1.4.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">15<\/a> in 2016, either transporting illegal immigrant defendants to court for arraignment, at which point the BPD has no authority to hold them, or outright releasing detainees from jail.<\/p>\n<p>Notably, <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mad.288616\/gov.uscourts.mad.288616.1.3.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">in 2015<\/a>, the BPD was a cooperative partner with ICE&rsquo;s enforcement efforts, fulfilling all nine detention requests from federal immigration officers. BPD reports for the years 2019 and 2020, though, could not be located within <a href=\"https:\/\/boston.legistar.com\" target=\"_blank\" rel=\"noreferrer noopener\">Legistar<\/a>, the city&rsquo;s legislative management system.<\/p>\n<p>The BPD&rsquo;s yearly numbers, however, may be undercounts, possibly by wide margins. ICE personnel <a href=\"https:\/\/www.boston.com\/news\/local-news\/2025\/01\/09\/how-many-ice-requests-did-boston-police-receive-2024-it-depends-who-you-ask\/\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a> they sent 198 detainers to the BPD in 2024, far higher than the commissioner&rsquo;s figures. Accordingly, the city council <a href=\"https:\/\/www.boston.gov\/sites\/default\/files\/file\/2025\/02\/Docket%20%230256.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">ordered<\/a> a hearing to discuss the discrepancy between the requests received, by the BPD&rsquo;s count, and ICE&rsquo;s number.<\/p>\n<p>A spokesperson for the Department of Homeland Security indicated to the <em>Washington Examiner<\/em> that the total number of ICE detainers issued may be more than Boston reported.<\/p>\n<p>According to Cox, the BPD does not maintain a separate database of ICE detainer requests received &ldquo;to ensure continued compliance with the Boston Trust Act.&rdquo;<\/p>\n<p>In 2019, the Boston Trust Act was <a href=\"https:\/\/perma.cc\/NNP8-BCKG\" target=\"_blank\" rel=\"noreferrer noopener\">amended<\/a> to specify that BPD personnel are strictly prohibited from assisting federal immigration enforcement in any form, such as asking about a suspect&rsquo;s immigration status, sharing information with ICE, conducting arrests based on administrative ICE warrants, and turning over detainees to ICE.<\/p>\n<p>According to the <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mad.288616\/gov.uscourts.mad.288616.1.2.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">updated ordinance<\/a>, which was unanimously approved by the Boston City Council in response to mass deportations under the first Trump administration, the revisions added a requirement for the BPD to train all officers on these provisions.<\/p>\n<p>On Thursday, the Justice Department <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3794800\/doj-boston-sanctuary-city-lawsuit-michelle-wu\/\" target=\"_blank\" rel=\"noreferrer noopener\">launched a lawsuit<\/a> challenging the Boston Trust Act, saying it instructs BPD &ldquo;to categorically flout federal immigration detainer requests so that removable aliens can evade ICE apprehension.&rdquo;<\/p>\n<p>When local law enforcement abides by immigration detainers, federal officers are able to arrest deportable aliens in a secure, controlled environment, such as detention centers, instead of searching for at-large suspects in the community, <a href=\"https:\/\/www.ice.gov\/immigration-detainers\" target=\"_blank\" rel=\"noreferrer noopener\">according to ICE<\/a><strong>.<\/strong> The latter situation expends scarce government resources and puts public safety and the lives of arresting officers at risk.<\/p>\n<p>According to the <a href=\"https:\/\/www.justice.gov\/opa\/media\/1413161\/dl\" target=\"_blank\" rel=\"noreferrer noopener\">federal complaint<\/a> filed against city leadership, criminal charges often cited in detainers by ICE&rsquo;s <a href=\"https:\/\/www.ice.gov\/field-office\/boston-field-office\" target=\"_blank\" rel=\"noreferrer noopener\">Boston field office<\/a> include homicide, larceny, and sexual offenses. The BPD apprehended him in July 2024, and ICE attempted to facilitate a custodial transfer via detainer request, &ldquo;but was forced by the noncooperative jurisdiction&rdquo; to nab Aybar-Alcantara on the streets, not until half a year later.<\/p>\n<p>The sanctuary city showdown brewing in Boston follows <a href=\"https:\/\/www.washingtonexaminer.com\/news\/white-house\/3760640\/boston-mayor-rejects-trumps-sanctuary-city-deadline\/\" target=\"_blank\" rel=\"noreferrer noopener\">months of jabs<\/a> exchanged between the Trump administration and Mayor Michelle Wu, a Democrat who was named as a plaintiff in the DOJ lawsuit.<\/p>\n<p><a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3337092\/bondi-doj-intensify-efforts-boston-michelle-wu\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>BONDI SAYS DOJ WILL INTENSIFY EFFORTS IN BOSTON AFTER WU SPAT<\/strong><\/a><\/p>\n<p>Late last year, Boston city councilors adopted <a href=\"https:\/\/www.boston.gov\/news\/council-reaffirms-trust-act\" target=\"_blank\" rel=\"noreferrer noopener\">a resolution<\/a> reaffirming the Boston Trust Act ahead of President Donald Trump&rsquo;s inauguration.
