New York Attorney General Letitia James announced her intervention in a lawsuit initiated by Texas Attorney General Ken Paxton. The lawsuit targets an Ulster County clerk in New York who refused to enforce a Texas court judgment against Dr. Margaret Carpenter, an abortion provider in New York. Carpenter had been ordered to pay $100,000 and barred from sending abortion pills<\/a> to patients in Texas, where abortion is largely banned.<\/p>\n

This case challenges New york’s abortion shield law, designed to protect abortion providers in the state from out-of-state legal actions. James defended the law’s constitutionality, describing Texas’s attempt as an overreach and emphasizing New York’s commitment to reproductive rights and healthcare freedom.<\/p>\n

Texas had sued the county clerk for not enforcing the judgment against Carpenter, who allegedly prescribed and mailed abortion pills to Texas patients without a Texas medical license. Governor Kathy Hochul also supports New York’s stance, having rejected a Louisiana warrant for Carpenter’s arrest related to similar charges.<\/p>\n

The lawsuit comes amid broader Republican efforts to oppose abortion shield laws, including recent Texas legislation allowing private citizens to sue out-of -state abortion providers<\/a>. New York is among several states enacting shield laws following the Supreme court overturning Roe v. Wade in 2022. The legal battle is set to further define the tension between states over abortion rights and jurisdiction.
