(AP Photo\/Jim Mone, File)<\/figcaption><\/figure>\n<\/div>\n<p>In a straw purchase, an individual buys a firearm for someone ineligible to purchase or possess guns. <a href=\"https:\/\/www.revisor.mn.gov\/bills\/bill.php?b=House&amp;f=HF2609&amp;ssn=0&amp;y=2023\" target=\"_blank\" rel=\"noreferrer noopener\">House File 2609<\/a> amended the state&rsquo;s straw purchasing law to increase the penalty from a gross misdemeanor to a felony and lowered the bar for prosecution based on whether the firearms provider should have &ldquo;reasonably known&rdquo; about the recipient&rsquo;s ineligibility. Beforehand, the prosecutorial standard required proof of prior knowledge.<\/p>\n<p>Additionally, the bill <a href=\"https:\/\/www.house.mn.gov\/members\/Profile\/News\/15550\/39412\" target=\"_blank\" rel=\"noreferrer noopener\">expanded the statutory definition<\/a> of illegal &ldquo;trigger activators&rdquo; to include <a href=\"https:\/\/www.lrl.mn.gov\/archive\/minutes\/senate\/2024\/fin\/20240418\/Fin_20240418_SF5153-1E-Summary.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">binary triggers<\/a>, which are devices that allow a gun to fire more than one round per pull and release of a trigger. <a href=\"https:\/\/www.revisor.mn.gov\/statutes\/cite\/609.67\" target=\"_blank\" rel=\"noreferrer noopener\">In Minnesota<\/a>, it is a felony to own, possess, or operate a trigger activator; violations are punishable by up to 20 years in prison.<\/p>\n<p>However, a Minnesota court <a href=\"https:\/\/gunowners.mn\/press-release-court-strikes-down-binary-trigger-ban-in-landmark-legal-victory-for-minnesota-gun-owners\/\" target=\"_blank\" rel=\"noreferrer noopener\">struck down the binary trigger ban<\/a>, arguing that the legislature violated the state constitution&rsquo;s single-subject clause by burying the ban inside a sprawling spending bill.<\/p>\n<p>Both measures became state law after legislators tucked them into a <a href=\"https:\/\/www.revisor.mn.gov\/bills\/bill.php?b=House&amp;f=HF5247&amp;ssn=0&amp;y=2024\" target=\"_blank\" rel=\"noreferrer noopener\">1,000-plus page tax bill<\/a> approved by Walz. (AP Photo\/Seth Perlman, File)<\/figcaption><\/figure>\n<\/div>\n<p>In May 2023, <a href=\"https:\/\/mn.gov\/governor\/newsroom\/press-releases\/?id=1055-578396\" target=\"_blank\" rel=\"noreferrer noopener\">Walz signed into law<\/a> a sweeping public safety package he had touted as &ldquo;historic&rdquo; gun reform.<\/p>\n<p>Introduced as <a href=\"https:\/\/www.revisor.mn.gov\/bills\/bill.php?b=Senate&amp;f=SF2909&amp;ssn=0&amp;y=2023\" target=\"_blank\" rel=\"noreferrer noopener\">Senate File 2909<\/a>, the omnibus bill in part prohibits private-party transfers of pistols and semiautomatic &ldquo;military-style assault weapons&rdquo; without a prior background check of the firearms recipient. Police are accordingly required to deny an application for a transferee permit or report of transfer if &ldquo;a substantial likelihood&rdquo; exists that the individual in question would pose a threat to themselves or the public when in possession of a firearm.&nbsp;&nbsp;<\/p>\n<p>Another provision of <a href=\"https:\/\/house.leg.state.mn.us\/NewLaws\/story\/2023\/5511\" target=\"_blank\" rel=\"noreferrer noopener\">S.F. 2909<\/a> establishes a &ldquo;red flag&rdquo; law temporarily confiscating firearms from dangerous individuals. Through this mechanism, family or household members, law enforcement officers, a city or county attorney, or legal guardian are able to <a href=\"https:\/\/mncourts.gov\/getforms\/firearms\" target=\"_blank\" rel=\"noreferrer noopener\">petition the court<\/a> for an <a href=\"https:\/\/mncourts.gov\/_media\/migration\/scao_library\/legalcounseldivision\/fast-facts-extreme-risk-protection-order-external.pdf?utm_source=govdelivery&amp;utm_medium=email&amp;utm_content=&amp;utm_term=\" target=\"_blank\" rel=\"noreferrer noopener\">&ldquo;<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/reports-red-flag-laws-result-in-66-firearm-confiscations\/\" title=\"Reports: ... ...s result in 66 firearm confiscations\">extreme risk protection order<\/a>,&rdquo;<\/a> including on an emergency basis, prohibiting a person perceived as at high risk of harming themselves or others with a gun from purchasing and possessing firearms for up to one year.<\/p>\n<p><a href=\"https:\/\/www.washingtonexaminer.com\/news\/2587150\/minnesota-democrats-red-flag-bill-joins-flurry-of-blue-state-gun-control-measures\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>MINNESOTA DEMOCRATS&rsquo; &lsquo;RED FLAG&rsquo; BILL JOINS FLURRY OF BLUE STATE GUN CONTROL MEASURES<\/strong><\/a><\/p>\n<p>Gun owners have raised concerns about the law skirting due process protections by circumventing the issuance of the warrants typically required in such seizures.<\/p>\n<p>According to Minnesota Judicial Branch <a href=\"https:\/\/mncourts.gov\/help-topics\/court-statistics\" target=\"_blank\" rel=\"noreferrer noopener\">data<\/a>, of the 284 ERPO petitions filed through Aug. 1, few (5%) were rejected by a judge.<\/p>\n<p>Minnesota Gun Owners Caucus chairman Bryan Strawser told the <em>Washington Examiner <\/em>that tens of thousands of AR-style rifles and accessories are already lawfully owned in Minnesota, and state-level bans on these items would likely not survive legal challenges.<\/p>\n<p>&ldquo;The recent Minneapolis attack involved handguns and a shotgun&mdash;underscoring that focusing on the design of a firearm misses the larger point,&rdquo; Strawser said.<\/p>\n<p>Strawser urged officials to invest in mental health resources and work to secure schools, rather than focusing on firearm design.<\/p>\n<p>&ldquo;Instead of treating this as a political football in an election year, we should pursue steps that research shows are effective: strengthening mental health resources, broadening community support systems, providing schools with discreet layered security, and denying perpetrators the notoriety they seek,&rdquo; Strawser said. &ldquo;These solutions would have real impact and can earn broad bipartisan, even unanimous, support.&rdquo;<\/p>\n<p><strong><a href=\"https:\/\/www.washingtonexaminer.com\/news\/crime\/3790292\/trump-military-teachers-carry-weapons-school-shootings\/\" target=\"_blank\" rel=\"noreferrer noopener\">TRUMP SUGGESTS &lsquo;DISTINGUISHED&rsquo; EX-MILITARY TEACHERS COULD CARRY WEAPONS AT SCHOOLS<\/a><\/strong><\/p>\n<p>The state&rsquo;s Republican Party is expressing similar sentiments.<\/p>\n<p>&ldquo;Governor Tim Walz has once again shown Minnesotans that he is not serious about solutions&mdash;only about radical rhetoric,&rdquo; Alex Plechash, chair of the Minnesota GOP, told the <em>Washington Examiner<\/em>.<\/p>\n<p>Speaking on Walz&rsquo;s record, Plechash said he failed Minnesota&rsquo;s nonpublic schools when the state&rsquo;s Catholic dioceses <a href=\"https:\/\/www.mncatholic.org\/letter_to_governor_walz_school_safety_in_nonpublic_schools\" target=\"_blank\" rel=\"noreferrer noopener\">asked<\/a> him for school security funding following credible threats in 2023.<\/p>\n<p>&ldquo;Now he wants to rush into a special session, not to solve problems, but to advance an extreme agenda that will not keep children safe,&rdquo; Plechash said of Walz.<\/p>\n<figure class=\"wp-block-image size-large is-resized\"><figcaption class=\"wp-element-caption\">Minnesota Gov. A <a href=\"https:\/\/content.govdelivery.com\/attachments\/MNGOV\/2025\/07\/11\/file_attachments\/3321574\/Special%20Election%20Writ%20House%20District%2034B.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">special election in September<\/a> is expected to restore a 67-67 tie in the Minnesota House, and state Senate Democrats only hold a one-seat majority.<\/p>\n<p>&ldquo;I&rsquo;m going to need some Republicans to break with the orthodoxy and say that we need to do something on guns,&rdquo; Walz said.<\/p>\n<p>GOP legislative leaders <a href=\"https:\/\/apnews.com\/article\/school-shooting-minneapolis-gun-control-41e146a644ebdb99b7de5c607836a45b\" target=\"_blank\" rel=\"noreferrer noopener\">reportedly<\/a> complained that Walz did not consult them before floating the idea of a special session.<\/p>\n<p><span style=\"box-sizing: border-box; margin: 0px; padding: 0px;\">In&nbsp;<a href=\"https:\/\/www.facebook.com\/mnhousegop\/posts\/speaker-representative-lisa-demuthafter-a-long-overdue-conversation-with-the-gov\/1221343166707626\/\" target=\"_blank\">a statement<\/a>, Republican state House Speaker Lisa Demuth urged that bipartisanship should be the focus if Minnesota lawmakers convene f<\/span>or a special session.<\/p>\n<p>&ldquo;If Governor Walz and Democrats are focused on partisan accusations and demands, this special session will not be productive for the people of Minnesota,&rdquo; the top-ranking House Republican said.<\/p>\n<p>The <em>Washington Examiner <\/em>reached out to Walz&rsquo;s office for comment.<\/p>\n<p>Meanwhile, the mayors of <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/minneapolis\/\" target=\"_blank\" rel=\"noreferrer noopener\">Minneapolis<\/a> and St. Paul are calling on the Minnesota legislature to change <a href=\"https:\/\/www.revisor.mn.gov\/laws\/1985\/0\/144\/#laws.0.1.0\" target=\"_blank\" rel=\"noreferrer noopener\">a 1985 state statute<\/a> preventing cities from enacting gun restrictions at the municipal level.<\/p>\n<p>Joined by several suburban mayors, Twin Cities mayors Jacob Frey and Melvin Carter, both Democrats, held <a href=\"https:\/\/www.facebook.com\/MayorFrey\/posts\/pfbid02n34DGqTa3VhnZswmeSsscFHgeTitRqdkLMcEmJW18oi4L5RRh8mzky2G1a6iVfHal\" target=\"_blank\" rel=\"noreferrer noopener\">a press conference<\/a> Tuesday to rally for statewide and federal bans on so-called &ldquo;assault weapons&rdquo; and high-capacity magazines.<\/p>\n<p><a href=\"https:\/\/www.washingtonexaminer.com\/news\/crime\/3784359\/annunciation-church-minneapolis-shooting-days-of-violence\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>ANNUNCIATION CHURCH SHOOTING COMES AFTER DAYS OF VIOLENCE IN MINNEAPOLIS<\/strong><\/a><\/p>\n<p>Frey said if state and federal authorities decline to do so, Minnesota should give municipalities the power to enact gun reform measures locally. Under <a href=\"https:\/\/www.revisor.mn.gov\/statutes\/cite\/471.633\" target=\"_blank\" rel=\"noreferrer noopener\">state law<\/a>, the legislature currently preempts all authority of a home rule charter or city government to regulate firearms and ammunition.<\/p>\n<p>&ldquo;If state and federal officials are either unwilling or unable to make the necessary change, give us, as mayors of these cities, the ability to do it ourselves,&rdquo; Frey said.<\/p>\n<p>Second Amendment advocates say city-by-city ordinances would be cumbersome for permit holders commuting daily between jurisdictions.<\/p>\n<p><a href=\"https:\/\/www.washingtonexaminer.com\/tag\/everytown-for-gun-safety\/\" target=\"_blank\" rel=\"noreferrer noopener\">Everytown for Gun Safety<\/a>, an organization lobbying for greater gun control across the country, <a href=\"https:\/\/everytownresearch.org\/rankings\/state\/minnesota\/\" target=\"_blank\" rel=\"noreferrer noopener\">ranks Minnesota<\/a> 14th in the nation on gun law strength.
