Police Say She Lied To Get U.S. Citizenship \u2013 And She\u2019s Not The First.\">seek permanent status<\/a> in the U.S.<\/p>\n<p>Judge Sooknanan granted the class status and issued a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/federal-judge-suspends-s-c-new-abortion-ban\/\" title=\"Federal judge suspends S.C. new abortion ban\">14-day restraining order<\/a>,halting DHS deportations temporarily. Notably, 76 children had already been boarded on a plane but were returned to custody after the ruling. Critics argue that these activists prefer to keep children in U.S. detention, separated from their families and culture, despite assurances that parents are waiting safely in Guatemala. The <a href=\"https:\/\/amzn.to\/3YuVZYV\" >article highlights past political theatrics<\/a> over migrant children detention conditions, accusing the left of flip-flopping-from condemning &#8220;kids in cages&#8221; to now urging courts to keep children detained to allow immigration claims.<\/p>\n<p>The judge&#8217;s prior rulings are portrayed as favoring liberal causes, and the piece suggests that it is harmful for a partisan judge to decide on such sensitive cases. The summary implies that the children likely prefer reunification and cultural familiarity but are caught in political and legal battles that disrupt their lives.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Activist attorneys trying to prevent the U.S. government from sending around 600 Guatemalan children back home to Guatemala to be with their Guatemalan parents got greenhorn Judge Sparkle Sooknanan to side with them over the Labor Day holiday weekend. Sooknanan, a Joe &ldquo;Autopen&rdquo; Biden appointee, has only been on the bench for eight months. An immigrant herself, Sooknanan was <a href=\"https:\/\/www.judiciary.senate.gov\/imo\/media\/doc\/2024-03-20_-_qfr_responses_-_sooknanan.pdf\">born in<\/a>&nbsp;Trinidad and Tobago and has been a U.S. citizen since 2009.&nbsp;&nbsp;&nbsp;<\/p>\n<p>The Young Center for Immigrant Children&rsquo;s Rights and the National Immigration Law Center<strong> <\/strong>rushed to U.S. District Court in the District of Columbia Sunday with an emergency <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.284360\/gov.uscourts.dcd.284360.1.0_1.pdf\">complaint<\/a> seeking class status for the children and requesting a temporary restraining order, asking the court to block the Department of Homeland (DHS) from sending detained children to their home country &mdash; a move they expected to happen over the weekend.<\/p>\n<p>Sooknanan <a href=\"https:\/\/www.courtlistener.com\/docket\/71240524\/lgml\/\">allowed<\/a> the class action status (the case, which started with 10 specific children, will now cover the 600) and <a href=\"https:\/\/www.cbsnews.com\/news\/guatemala-children-deportation-judge-ruling\/\" target=\"_blank\" rel=\"noreferrer noopener\">issued<\/a> a temporary restraining order preventing DHS from removing children in the class of this case from the U.S. for 14 days while the parties argue the matter in court. &nbsp;&nbsp;<\/p>\n<p>The DHS Office of Refugee Resettlement (ORR) had apparently <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.284360\/gov.uscourts.dcd.284360.9.0.pdf\">already loaded<\/a> 76 children on an airplane Sunday when it learned of the order. The children were deplaned and returned to ORR custody.<\/p>\n<p>The activist attorneys would rather keep children in U.S. detention, separated from their families and home country, than reunite them with all that is familiar. They oppose removing the children because they &ldquo;will lose the opportunity to seek permanent status in the United States in immigration court,&rdquo; the <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.284360\/gov.uscourts.dcd.284360.1.0_1.pdf\">complaint<\/a> reads, adding the children &ldquo;fear persecution in Guatemala,&rdquo; and if they are removed before they have a chance to make a case in court, &ldquo;they are at risk of persecution, torture, or death.&rdquo; <\/p>\n<p>Yet White House Deputy Chief of Staff Stephen Miller has noted that children are returning to their parents, and it is totally implausible that the parents and family members of some 600 children are waiting to kill their kids when they come home.<\/p>\n<figure>\n<p><span><\/p>\n<blockquote data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">It&rsquo;s actually much worse than even that. These smuggled migrant children were orphaned in America by the Biden Administration. The minors have all self-reported that their parents are back home in Guatemala. While working at the Department of Justice, she played a part in searching for a legal &ldquo;federal hook&rdquo; to prevent parents from speaking out at school board meetings, <a href=\"https:\/\/thefederalist.com\/2025\/07\/18\/biden-justice-department-sought-federal-hook-to-go-after-parents-as-domestic-terrorists-documents\/\">The Federalist<\/a> previously reported.<\/p>\n<p>In March, Sooknanan <a href=\"https:\/\/www.politico.com\/news\/2025\/03\/12\/susan-grundmann-labor-firing-00227769\">ruled against<\/a> Trump, ordering him to reinstate Democrat Susan Grundmann to a post on the Federal Labor Relations Authority that Trump had fired her from.<\/p>\n<p>In August, Sooknanan <a href=\"https:\/\/www.lawdork.com\/p\/judge-blocks-states-use-of-trumps\">ruled against<\/a> Trump&rsquo;s <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/06\/restricting-the-entry-of-foreign-nationals-to-protect-the-united-states-from-foreign-terrorists-and-other-national-security-and-public-safety-threats\/\">directive<\/a> to restrict foreign nationals entering the U.S. who may commit crimes or threaten national security.<\/p>\n<p>It is a disservice to these children for a partisan, activist judge to hear this case.<\/p>\n<p>We can only speculate about how the children sitting on an airplane felt on Sunday. It is likely some, if not all, were excited to see their families and to be surrounded by the culture and language they were immersed in from birth. <\/p>\n<p>Many likely accepted the new plan for their lives until Sooknanan yanked them back into detention at the request of activist attorneys who are playing politics with the lives of children instead of helping them get settled and living within the legal realities of international borders they should have never crossed.<\/p>\n<hr>\n<p>      Beth Brelje is an elections correspondent for The Federalist.
