the prosecution of Milwaukee County circuit Judge Hannah Dugan for allegedly assisting an illegal immigrant to evade law enforcement<\/a> will proceed,according to a federal judge’s ruling. U.S. District Judge Lynn Adelman denied Dugan’s motion to dismiss the obstruction charges and rejected her claim of judicial immunity.Dugan had argued that her actions were part of her official duties and cited a recent supreme Court decision granting limited immunity to presidents for official acts.However, the judge noted that immunity does not apply if the actions violate criminal law. The case involves allegations<\/a> that Dugan helped an illegal immigrant, Eduardo Flores-Ruiz, escape thru a courthouse back door to avoid arrest by federal agents. Dugan was arrested about a week later and has pleaded not guilty. The trial date,originally set for July 21,has been postponed,with a hearing scheduled for September 3. If convicted, Dugan faces up to six years in prison and a $350,000 fine. the Wisconsin Supreme Court suspended her after the federal charges were filed.
