It&rsquo;s a terrible thing.&rdquo;<\/p>\n<p>Then, Trump showed off the understated manner of speaking he often uses in the company of friends. They said that this was a fake case&hellip; But that&rsquo;s a nice victory.&rdquo; <a href=\"https:\/\/t.co\/ohUP60Ep7p\">pic.twitter.com\/ohUP60Ep7p<\/a><\/p>\n<p>&mdash; Fox News (@FoxNews) <a href=\"https:\/\/twitter.com\/FoxNews\/status\/1958654825530630157?\">August 21, 2025<\/a><\/p>\n<\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>According to <a href=\"https:\/\/www.foxnews.com\/politics\/ny-appeals-court-throws-out-500m-penalty-against-trump-letitia-james-civil-case\" target=\"_blank\" rel=\"noopener\">Fox News<\/a>, the New York Appellate Division ruled that the massive fine violated the Eighth Amendment.<\/p>\n<p>&ldquo;Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted,&rdquo; the <a href=\"https:\/\/constitution.congress.gov\/constitution\/amendment-8\/\" target=\"_blank\" rel=\"noopener\">Eighth Amendment<\/a> reads.<\/p>\n<p>Democrats, of course, despise the Bill of Rights, particularly the <a href=\"https:\/\/www.westernjournal.com\/justice-ketanji-brown-jackson-true-thoughts-first-amendment-slip-obstacle-hamstringing-government\/\" target=\"_blank\" rel=\"noopener\">First<\/a> and <a href=\"https:\/\/www.westernjournal.com\/federal-judge-smacks-california-gun-law-calls-repugnant-second-amendment\/\" target=\"_blank\" rel=\"noopener\">Second<\/a> Amendments. So it stood to reason that they would also ignore the Eighth.<\/p>\n<p>Unfortunately for Trump, the appeals court did not actually deem this a &ldquo;fake case.&rdquo;<\/p>\n<p>In fact, the court did not remove Trump&rsquo;s liability. Nor did it rule that James had acted beyond her authority. It merely struck down the massive fine as excessive and, therefore, unconstitutional.<\/p>\n<p>Justice David Friedman summarized the problems in his partial dissent.<\/p>\n<p>James&rsquo; &ldquo;ultimate goal was not market hygiene,&rdquo; Friedman wrote, but &ldquo;political hygiene, ending with the derailment of President Trump&rsquo;s political career and the destruction of his real estate business.&rdquo;<\/p>\n<p>The dissenting judge also characterized the issue in question as one that involved &ldquo;successful, private, commercial transactions, negotiated at arm&rsquo;s length between <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/ny-case-against-trump-was-pretext-to-take-down-his-campaign\/\" title=\"NY ... Against ... Was Pretext To Take Down His Campaign\">highly sophisticated parties fully capable<\/a> of monitoring and defending their own interests.&rdquo;<\/p>\n<p>Thus, the appeals process will continue.<\/p>\n<p>Indeed, the legal process always seems to continue.<\/p>\n<p>For instance, earlier this year federal judges <a href=\"https:\/\/www.westernjournal.com\/trump-warns-handful-communist-radical-judges-trying-assume-powers-belonging-solely-potus\/\" target=\"_blank\" rel=\"noopener\">usurped power<\/a> in order to derail an elected president&rsquo;s agenda. The Supreme Court finally had to <a href=\"https:\/\/www.westernjournal.com\/scotus-shuts-activist-court-clears-way-trump-begin-deportations-third-party-countries\/\" target=\"_blank\" rel=\"noopener\">chastise<\/a> the activist lower courts.<\/p>\n<p>Moreover, the New York Appellate Division did right by ruling in Trump&rsquo;s favor on Eighth Amendment grounds. But leaving Trump&rsquo;s liability in place legitimized an absurd and tyrannical proceeding.<\/p>\n<p>On the other hand, if courts want to uphold liability in politically-charged fraud cases, then perhaps we should thank them. After all, both <a href=\"https:\/\/www.westernjournal.com\/letitia-james-bad-day-gets-worse-confronted-town-hall-feel-know-will-prison\/\" target=\"_blank\" rel=\"noopener\">James<\/a> and Democratic Sen. <a href=\"https:\/\/www.westernjournal.com\/divine-justice-schiff-criminal-referral-accuses-thing-dems-prosecuted-trump\/\" target=\"_blank\" rel=\"noopener\">Adam Schiff<\/a> of California now face their own legal troubles pertaining to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/letitia-james-faces-criminal-referral-for-alleged-mortgage-fraud\/\" title=\"Letitia James faces criminal referral for alleged mortgage fraud\">alleged mortgage fraud<\/a>.<\/p>\n<p>Nonetheless, as the lawyers continue to make their arguments, Trump continues to show why so many people love him.<\/p>\n<p>The president made his understated &ldquo;nice victory&rdquo; and &ldquo;not bad&rdquo; comments while holding a microphone and speaking to police and <a href=\"https:\/\/www.westernjournal.com\/dc-police-union-announces-immediate-impact-trumps-national-guard-deployment\/\" target=\"_blank\" rel=\"noopener\">National Guard<\/a> members, people who put their lives on the line to protect the public.<\/p>\n<p>Trump spoke to them as peers. He didn&rsquo;t use political jargon.
