The next step in the regulatory process is to draft a Notice of Intended Regulatory Action (NOIRA) for the Board of Health&rsquo;s future consideration.&rdquo;<\/p>\n<p>A NOIRA typically does not <a href=\"https:\/\/amzn.to\/3YuVZYV\" >include actual regulatory text<\/a>, Reppas said, but instead notifies the public that the state is considering a regulatory change and outlines what the change entails. The Virginia Department of Health will then hold another at least 30-day public comment period and then follow the next two steps in the <a href=\"https:\/\/register.dls.virginia.gov\/process.shtml\" target=\"_blank\" rel=\"noreferrer noopener\">standard regulatory process<\/a>: drafting a proposed regulation and final regulation. The entire three-step process can take between 18 months and two years, according to Reppas.<\/p>\n<p>&ldquo;The Virginia Department of Health remains committed to making Virginia the healthiest state in the nation, and we will work with the Board of Health to move forward with the regulatory process,&rdquo; Reppas said.<\/p>\n<p>Monday&rsquo;s board vote follows an announcement from the Education Department that it plans to pull federal funding out from under five northern Virginia school districts after the department found the districts&rsquo; transgender policies violated Title IX. The Trump administration gave the districts a deadline of last Friday to adopt their proposed <a href=\"https:\/\/www.ed.gov\/about\/news\/press-release\/us-department-of-education-finds-five-northern-virginia-school-districts-violation-of-title-ix\" target=\"_blank\" rel=\"noreferrer noopener\">resolution agreement<\/a> while dangling the threat of pulled funding, but the districts <a href=\"https:\/\/www.washingtonexaminer.com\/policy\/education\/3501882\/virginia-school-districts-ignore-trump-demand-change-transgender-policy\/\" target=\"_blank\" rel=\"noreferrer noopener\">did not comply<\/a>.<\/p>\n<p>The Virginia High School League <a href=\"https:\/\/www.washingtonexaminer.com\/news\/3402403\/virginia-policy-protecting-girls-sports-transgender-athletes\/\" target=\"_blank\" rel=\"noreferrer noopener\">ratified a policy<\/a> to prevent transgender women from playing in <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/california-forces-girls-into-basketball-playoff-with-boy\/\" title=\"California Forces Girls Into Basketball Playoff With Boy\">high school girls&#038;rsquo<\/a>; sports in May. In February, the <a href=\"https:\/\/www.washingtonexaminer.com\/news\/3313842\/ncaa-changes-rules-ban-biological-men-womens-sports\/\" target=\"_blank\" rel=\"noreferrer noopener\">NCAA<\/a> announced its policy to limit women&rsquo;s sports to people who were assigned the female sex at birth. This all followed President Donald Trump&rsquo;s February executive action titled &ldquo;<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/02\/keeping-men-out-of-womens-sports\/\" target=\"_blank\" rel=\"noreferrer noopener\">Keeping Men Out of Women&rsquo;s Sports<\/a>,&rdquo; which promoted keeping biological men out of women&rsquo;s athletics.<\/p>\n<p><a href=\"https:\/\/www.washingtonexaminer.com\/news\/investigations\/3758553\/loudoun-county-schools-boys-title-ix-transgender-locker-room-case\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>LOUDON COUNTY SCHOOLS SUSPENDS BOYS IN TITLE IX TRANSGENDER LOCKER ROOM CASE: REPORT<\/strong><\/a><\/p>\n<p>One of the petitioners, R&eacute;ka Gy&ouml;rgy, <a href=\"https:\/\/townhall.virginia.gov\/L\/GetFile.cfm?File=Meeting%5C58%5C42141%5CAgenda_VDH_42141_v2.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">said in her bio<\/a> that she missed the finals of the 2022 Women&rsquo;s Swimming and Diving NCAA Championship for the 500-yard freestyle by one spot after placing 17th in a competition that <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/lia-thomas\/\" target=\"_blank\" rel=\"noreferrer noopener\">Lia Thomas<\/a>, who is transgender, won. Gy&ouml;rgy also <a href=\"https:\/\/townhall.virginia.gov\/L\/GetFile.cfm?File=Meeting%5C58%5C42141%5CAgenda_VDH_42141_v2.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">detailed<\/a> an uncomfortable interaction with Thomas in the locker room in which she felt &ldquo;her privacy was taken away.&rdquo;<\/p>\n<p>Gy&ouml;rgy competed as a swimmer for Hungary in the 2016 Olympics and graduated from Virginia Tech as a swimmer in 2022. Gy&ouml;rgy did not respond to the <em>Washington Examiner&rsquo;s<\/em> request for comment.
