According to <a href=\"https:\/\/www.lc.org\/newsroom\/details\/072425-kim-davis-asks-scotus-to-overturn-obergefell-marriage-opinion\" target=\"_blank\" rel=\"noreferrer noopener\">Liberty Counsel<\/a> &mdash; a Christian organization representing Davis  &mdash; the former clerk was previously &ldquo;jailed, sued, and held personally liable post-[[<em>Obergefell<\/em> <em>v. Hodges<\/em>]&nbsp;for her <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/house-republicans-push-bill-aimed-at-balancing-lgbt-rights-and-religious-freedom\/\" title=\"House Republicans Push Bill Aimed at Balancing LGBT Rights and ...\">sincerely held religious beliefs<\/a> on marriage.&rdquo;<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2 d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-1614331375\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p>In <em>Obergefell<\/em>, the Supreme Court ruled (5-4) that the <a href=\"https:\/\/www.archives.gov\/milestone-documents\/14th-amendment#:~:text=No%20State%20shall%20make%20or,equal%20protection%20of%20the%20laws.\" target=\"_blank\" rel=\"noreferrer noopener\">Due Process Clause<\/a> &ldquo;of the Fourteenth Amendment guarantees the right to marry as one of the fundamental liberties it protects, and that analysis applies to same-sex couples in the same manner as it does to opposite-sex couples,&rdquo; as summarized by <a href=\"https:\/\/www.oyez.org\/cases\/2014\/14-556\" target=\"_blank\" rel=\"noreferrer noopener\">Oyez<\/a>. Put another way, the majority effectively opened the floodgates for &ldquo;gay marriage&rdquo; across the country.<\/p>\n<p>According to <a href=\"https:\/\/www.lc.org\/newsroom\/details\/072425-kim-davis-asks-scotus-to-overturn-obergefell-marriage-opinion\" target=\"_blank\" rel=\"noreferrer noopener\">Liberty Counsel<\/a>, Davis&rsquo; legal troubles began following the <em>Obergefell<\/em> decision in 2015 when she &ldquo;ceased issuing any marriage licenses while she sought an accommodation for her religious beliefs.&rdquo; &ldquo;The courts,&rdquo; the organization said, &ldquo;then used&nbsp;<em>Obergefell<\/em> &hellip; to deny her a religious accommodation that unconstitutionally forced her to choose between her religious beliefs and her livelihood.&rdquo;<\/p>\n<p>In the petition, Davis&rsquo; legal team has asked the justices, in part, to consider whether <em>Obergefell<\/em> &ldquo;and the legal fiction of substantive due process, should be overturned.&rdquo; <\/p>\n<p>As Associate Justice Clarence Thomas <a href=\"https:\/\/thefederalist.com\/2025\/06\/26\/10-years-after-obergefell-its-even-more-obvious-it-should-be-overturned\/\" target=\"_blank\" rel=\"noreferrer noopener\">predicted<\/a> in his dissenting opinion in <em>Obergefell<\/em>, the court&rsquo;s &ldquo;inversion of the original meaning of liberty&rdquo; has produced &ldquo;collateral damage to other aspects of our constitutional order that protect liberty.&rdquo; That point has been proven true on the issue of transgenderism, which <a href=\"https:\/\/thefederalist.com\/2025\/06\/20\/the-10-years-since-obergefell-have-proven-its-critics-right\/\" target=\"_blank\" rel=\"noreferrer noopener\">arguably<\/a> would not have become as mainstream without the majority&rsquo;s <em>Obergefell<\/em> decision. <\/p>\n<p><strong>[READ:[READ:<a href=\"https:\/\/thefederalist.com\/2025\/06\/20\/the-10-years-since-obergefell-have-proven-its-critics-right\/\" target=\"_blank\" rel=\"noreferrer noopener\">The 10 Years Since&nbsp;<em>Obergefell<\/em>&nbsp;Have Proven Its Critics Right<\/a>]<\/strong><\/p>\n<p>Davis&rsquo; petition was filed in July, raising questions as to why <a href=\"https:\/\/abcnews.go.com\/Politics\/supreme-court-formally-asked-overturn-landmark-same-sex\/story?id=124465302\" target=\"_blank\" rel=\"noreferrer noopener\">many<\/a> <a href=\"https:\/\/www.newsweek.com\/supreme-court-faces-decision-same-sex-marriages-2111822\" target=\"_blank\" rel=\"noreferrer noopener\">major<\/a> <a href=\"https:\/\/www.yahoo.com\/news\/article\/could-the-supreme-court-overturn-same-sex-marriage-this-case-hopes-to-roll-back-the-ruling-that-made-it-legal-222155998.html\" target=\"_blank\" rel=\"noreferrer noopener\">media<\/a> <a href=\"https:\/\/www.thepinknews.com\/2025\/08\/12\/scotus-same-sex-marriage-kim-davis\/\" target=\"_blank\" rel=\"noreferrer noopener\">outlets<\/a> have suddenly (all at once) decided to widely report on it.<\/p>\n<p>The prospect of SCOTUS potentially taking up Davis&rsquo; case is significant when considering that the current makeup of the Supreme Court is notably different from when the high court handed down its ill-fated <em>Obergefell<\/em> ruling. <\/p>\n<p>Republican appointees currently hold a 6-3 majority on the high court, with three of those justices (Chief Justice John Roberts and Associate Justices Clarence Thomas and Samuel Alito) having dissented in <em>Obergefell<\/em>. Meanwhile, of those in the majority decision, only Associate Justices Sonia Sotomayor and Elena Kagan are still on the court.<\/p>\n<p><strong>[READ:[READ:<a href=\"https:\/\/thefederalist.com\/2025\/06\/26\/10-years-after-obergefell-its-even-more-obvious-it-should-be-overturned\/\" target=\"_blank\" rel=\"noreferrer noopener\">10 Years After&nbsp;<em>Obergefell<\/em>, It&rsquo;s Even More Obvious It Should Be Overturned<\/a>]<\/strong><\/p>\n<p>Whether enough justices agree to hear Davis&rsquo; case and consider overturning the precedent established in <em>Obergefell<\/em> remains to be seen. At least four justices must <a href=\"https:\/\/www.uscourts.gov\/about-federal-courts\/educational-resources\/about-educational-outreach\/activity-resources\/supreme-court-procedures\" target=\"_blank\" rel=\"noreferrer noopener\">agree<\/a> to hear a case before it can be considered by the full court.<\/p>\n<p>Those who will likely be pivotal in determining if the matter is ultimately taken up later this year will be Trump appointees Neil Gorsuch, Brett Kavanaugh, and Amy Coney Barrett, as well as the <a href=\"https:\/\/thefederalist.com\/2025\/03\/19\/if-anyones-destroying-the-judiciarys-legitimacy-its-chief-justice-john-roberts\/\" target=\"_blank\" rel=\"noreferrer noopener\">notoriously political<\/a> Roberts.<\/p>\n<p><strong><br \/><\/strong><\/p>\n<\/p>\n<hr class=\"wp-block-separator\">\n<div class=\"article-author-description fst-italic\">      Shawn Fleetwood is a staff writer for The Federalist and a graduate of the University of Mary Washington.
