Trump et al.<\/em>, stems from Democratic&nbsp;Gov.<a href=\"https:\/\/www.washingtonexaminer.com\/tag\/gavin-newsom\" target=\"_blank\" rel=\"noreferrer noopener\"> Gavin Newsom&rsquo;s<\/a>&nbsp;lawsuit against President Donald Trump, filed on June 9. The lawsuit alleges that the president&rsquo;s federalization of 4,000 California National Guard troops and deployment of Marines in support of immigration enforcement&nbsp;operations and efforts to quell riots was illegal.<\/p>\n<p>The lawsuit has become a constitutional clash between a sitting president and a state governor. <\/p>\n<p>While Judge Breyer temporarily blocked Trump&rsquo;s actions last month, the&nbsp;<a href=\"https:\/\/www.washingtonexaminer.com\/tag\/ninth-circuit-court-of-appeals\" target=\"_blank\" rel=\"noreferrer noopener\">9th U.S. Circuit Court of Appeals<\/a>&nbsp;quickly reversed that ruling, granting the <a href=\"https:\/\/amzn.to\/3YuVZYV\" >federal government continued authority<\/a> over the National Guard&rsquo;s presence in Los Angeles. <\/p>\n<p>However, the appellate panel, composed of Judges Mark J. Bennett, Eric D. Miller, and Jennifer Sung, <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3484100\/appeals-panel-skeptical-doj-bid-lift-court-immigration-raid-restrictions\/\" target=\"_blank\" rel=\"noopener\" title=\"\">did not weigh<\/a> in on whether the president&rsquo;s order violated the Posse Comitatus Act.<\/p>\n<p>Following that reversal, Breyer ordered an expedited discovery process on the Posse Comitatus question and denied further delays. &ldquo;The Court will not entertain requests or stipulations for extensions of time,&rdquo; he wrote.<\/p>\n<p>The trial will also investigate the involvement of U.S. Marines alongside immigration agents in crowd control and public security. Last month, federal officers in tactical gear were witnessed patrolling MacArthur Park, some on horseback, despite objections from Newsom and&nbsp;Democratic Los Angeles Mayor Karen Bass.<\/p>\n<p>Breyer has allowed state lawyers to depose Ernesto Santacruz Jr., the&nbsp;<a href=\"https:\/\/www.washingtonexaminer.com\/tag\/department-of-homeland-security\" target=\"_blank\" rel=\"noreferrer noopener\">Department of Homeland Security<\/a>&nbsp;field office director in Los Angeles, ruling against&nbsp;<a href=\"https:\/\/www.washingtonexaminer.com\/tag\/department-of-justice\" target=\"_blank\" rel=\"noreferrer noopener\">Justice Department<\/a>&nbsp;objections. <\/p>\n<p>&ldquo;Defendants themselves offered up Mr. Santacruz on the subject of what the federalized National Guard and U.S. Marines are doing in Los Angeles,&rdquo; Breyer <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cand.450934\/gov.uscourts.cand.450934.108.0.pdf\" target=\"_blank\" rel=\"noopener\" title=\"\">wrote in a July 9 order<\/a>.<\/p>\n<p>The Posse Comitatus Act has rarely been litigated in civil court, and courts have generally ruled in favor of the government when it arises in criminal cases. In&nbsp;<em><a href=\"https:\/\/law.justia.com\/cases\/federal\/district-courts\/FSupp\/392\/916\/1580576\/\" target=\"_blank\" rel=\"noopener\" title=\"\">U.S. v. Red Feather<\/a><\/em>&nbsp;(1975), a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/federal-judge-finds-j6-defendant-not-guilty-nuking-doj-charges-that-walking-through-an-open-door-is-a-crime\/\" title=\"Federal Judge Finds J6 Defendant Not Guilty, Nuking DOJ Charges That Walking Through An Open Door Is A Crime\">federal judge found<\/a> that evidence of troops engaging in &ldquo;direct law enforcement&rdquo; during the Wounded Knee occupation could be admitted, but passive military support was excluded.<\/p>\n<p>More recently, the&nbsp;9th Circuit&nbsp;ruled in&nbsp;<em><em><em><em><a href=\"https:\/\/cdn.ca9.uscourts.gov\/datastore\/opinions\/2015\/11\/04\/13-30077.pdf\" target=\"_blank\" rel=\"noopener\" title=\"\">U.S. v. Dreyer<\/a><\/em><\/em><\/em><\/em>&nbsp;(2015) that evidence collected by a Navy intelligence officer investigating civilian crimes was not automatically inadmissible, even if the Posse Comitatus Act may have been violated.<\/p>\n<p>Since the Trump administration deployed more than 4,000 National Guard soldiers and 700 Marines to Los Angeles in May, there has been a withdrawal of more than 2,000 troops from the area in light of diminished unrest and riots.
