This decision overturned an earlier ruling that found the <a href=\"https:\/\/amzn.to\/3YuVZYV\" >vaccine requirement violated employees&#8217; constitutional rights<\/a> by forcing them to get vaccinated without exemptions, under threat of termination. the original challenge was brought in 2021 by California Educators for Medical Freedom and others, arguing that mandating the vaccine infringed on workers&#8217; rights to refuse medical treatment.<\/p>\n<p>A <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/aclu-targets-anti-woke-medical-group-do-no-harm\/\" title=\"ACLU focuses on Do No Harm, an anti-woke medical group\">federal judge initially dismissed<\/a> the case, citing the 1905 Supreme Court precedent Jacobson v. However, other judges on the circuit called for an en banc review by the full 11-judge panel.<\/p>\n<p>The full panel ultimately ruled that the vaccine mandate was &#8220;more than reasonable,&#8221; stating that reducing the severity of illness alone justified the requirement, even without preventing spread. they rejected the argument that Jacobson applied only to vaccines that prevent transmission and immunity. The court admonished them, however, accusing the district of trying to &ldquo;tactically manipulate&rdquo; the judiciary by constantly rescinding and then reupping the mandate to gain a dismissal, according to Legal News Wire.<\/p>\n<p>The three-judge panel of the Ninth Circuit voted two to one that the ineffectiveness of the <a href=\"https:\/\/www.westernjournal.com\/documents-usaid-sent-thousands-viral-samples-wuhan-lab-despite-shocking-lack-oversight\/\" target=\"_blank\" rel=\"noopener\">COVID<\/a>&nbsp;shot to prevent infection &mdash; and transmission &mdash; would separate it from &ldquo;traditional vaccines.&rdquo;<\/p>\n<p>They also said the <em>Jacobson<\/em> case shouldn&rsquo;t apply, because the district couldn&rsquo;t prove the vaccines it was mandating would &ldquo;effectively &lsquo;prevent the spread&rsquo; of COVID-19.&rdquo;<\/p>\n<p>Now, here is where we learn why the Ninth Circuit has a <a href=\"https:\/\/www.law.com\/nationallawjournal\/2024\/07\/19\/9th-circuits-unusually-low-reversal-rate-this-supreme-court-term-doesnt-tell-full-story\/?slreturn=20250802173253\" target=\"_blank\" rel=\"noopener\">historically high<\/a> rate of being <a href=\"https:\/\/www.politifact.com\/factchecks\/2017\/apr\/26\/donald-trump\/does-ninth-circuit-have-overturn-record-close-80\/\" target=\"_blank\" rel=\"noopener\">overturned<\/a>.<\/p>\n<p>Other judges on the circuit overruled the panel&rsquo;s decision, saying that the case should be decided by the entire 11-judge panel.<\/p>\n<p>The new &ldquo;en banc&rdquo; ruling stated that the Los Angeles Unified School District vaccine measures were &ldquo;<a href=\"https:\/\/caselaw.findlaw.com\/court\/us-9th-circuit\/117554189.html\" target=\"_blank\" rel=\"noopener\">more than reasonable<\/a>.&rdquo;<\/p>\n<p>The vaccine merely lessening symptoms &mdash; not preventing the spread &mdash; was enough for the district to hit everyone with the requirement.<\/p>\n<p>&ldquo;The LAUSD could have reasonably determined that the vaccines would protect the health of its employees,&rdquo; the majority wrote.<\/p>\n<p>They <a href=\"https:\/\/law.justia.com\/cases\/federal\/appellate-courts\/ca9\/22-55908\/22-55908-2025-07-31.html\" target=\"_blank\" rel=\"noopener\">added<\/a>, &ldquo;We reject Plaintiffs&rsquo; attempt to limit <em>Jacobson<\/em> to only those <a href=\"https:\/\/westernjournal.com\/covid-study-calls-question-every-bureaucrat-cops-arrest-people-parks-beaches\/?utm_source=twitter&amp;utm_medium=thenewvoice\" target=\"_blank\" rel=\"noopener\">vaccines<\/a> that prevent the spread of a disease and provide immunity.&rdquo;<\/p>\n<p>Judge John Owens and Judge Kenneth Lee, who dissented partially, wrote about concerns regarding constitutional precedent.<\/p>\n<p>They argued that by not examining the effectiveness of the vaccine when weighing the legality of a medical mandate, the freedom of patients is put at risk.<\/p>\n<p>They also wrote that the <em>Jacobson<\/em> decision was related to inoculations that did more than just &ldquo;lessen the severity of symptoms&rdquo; and therefore should be treated differently.<\/p>\n<p>&ldquo;If we accept the majority&rsquo;s holding that a state can impose a vaccine mandate just to &lsquo;lessen the severity of symptoms&rsquo; of sick persons &mdash; without considering whether it lessens transmission and contraction of this disease &mdash; then we are opening the door for compulsory medical treatment against people&rsquo;s wishes,&rdquo; the dissent read in part.<\/p>\n<p>&ldquo;Vaccines, by definition, build immunity and prevent transmission and contraction of an infectious disease, but we risk blurring the line between vaccines and medical treatment if vaccines are defined as anything that lessens symptoms,&rdquo;
