Whoops.<\/p>\n<p>You&rsquo;d think that maybe they would have learned, but no: In 2021, the Democrats went through with a fruitless impeachment trial against Donald Trump even though he&rsquo;d already left office because he&rsquo;d been accused as being the instigator in the events of Jan. 6, 2021, which were then being described as worse than <a href=\"https:\/\/www.westernjournal.com\/kamala-harris-fire-likening-jan-6-pearl-harbor-9-11\/\" target=\"_blank\" rel=\"noopener\">Pearl Harbor<\/a> or 9\/11.<\/p>\n<p>He wasn&rsquo;t convicted, of course, but the precedent was set: We could impeach former President Millard Fillmore if we wanted to. (And we probably should, because anyone named &ldquo;Millard&rdquo; is just asking for it on general principles.)<\/p>\n<p>That&rsquo;s a bit of a problem now that new documents being declassified by the <a href=\"https:\/\/www.westernjournal.com\/op-ed-gabbards-latest-russiagate-findings-exposed-obamas-treachery\/\" target=\"_blank\" rel=\"noopener\">Office of the Director of National Intelligence<\/a> indicate that, in the last days of the Obama administration, efforts to hobble the incoming administration through a <a href=\"https:\/\/www.westernjournal.com\/russia-hoax-fallout-democrats-destroyed-trust-divided-nation\/\" target=\"_blank\" rel=\"noopener\">Russiagate hoax<\/a> they knew to be anti-factual were undertaken by top administration officials, with some evidence that, in this case, Barack Obama was &ldquo;The Big Guy&rdquo; in this grift.<\/p>\n<p>Well, as one of Trump&rsquo;s former impeachment lawyers, David Schoen, pointed out during a Sunday appearance on Newsmax, that means an impeachment of Obama is on the table &mdash; and, if convicted, his immunity from prosecution could be stripped.<\/p>\n<p>&ldquo;President Trump is right when he said the immunity decision would help President Obama,&rdquo; Schoen said. &ldquo;But you know what it doesn&rsquo;t help him with? But you know what it doesn&rsquo;t help him&hellip; <a href=\"https:\/\/t.co\/HRlM3kOzq0\">pic.twitter.com\/HRlM3kOzq0<\/a><\/p>\n<p>&mdash; Jason Cohen &#127482;&#127480; (@JasonJournoDC) <a href=\"https:\/\/twitter.com\/JasonJournoDC\/status\/1949524565970833544?\">July 27, 2025<\/a><\/p>\n<\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>&ldquo;According to the Democratic Party and the House managers in the second impeachment trial, a former president &mdash; once out of office &mdash; is still subject to impeachment,&rdquo; he said.<\/p>\n<p>&ldquo;As I predicted at the time, this would come back &mdash; they would rue the day &mdash; because President Obama could be impeached if this evidence really says what it says.<\/p>\n<p>&ldquo;And that could also step over the immunity &mdash; because under Article I, Section 3, Clause 7 of the Constitution, the Democrats argued [impeachment] bars one from holding further office, and the language itself says you&rsquo;re still subject to criminal prosecution &mdash; or indictment,&rdquo; he added.<\/p>\n<p>Now, this is only if you&rsquo;re convicted, <a href=\"https:\/\/constitution.congress.gov\/browse\/article-1\/section-3\/clause-7\/\" target=\"_blank\" rel=\"noopener\">naturally<\/a>:<\/p>\n<p><em>Judgment in Cases of Impeachment shall not extend further than to removal from Office, and disqualification to hold and enjoy any Office of honor, Trust or Profit under the United States: but the Party convicted shall nevertheless be liable and subject to Indictment, Trial, Judgment and Punishment, according to Law.<\/em><\/p>\n<p>You need 67 votes in the Senate for that, and you have a better chance of getting all the little children in the world to clap their hands simultaneously than getting that unless something particularly heinous emerges. (And I&rsquo;m not just talking Nixon smoking-gun tape stuff in 2025 Washington, I&rsquo;m talking video of Obama saying, &ldquo;Yeah, and I had <a href=\"https:\/\/digitalcommons.law.uga.edu\/fac_pm\/263\/\" target=\"_blank\" rel=\"noopener\">Ted Cruz&rsquo;s dad framed for killing JFK<\/a>. So don&rsquo;t worry, I&rsquo;ve got this Russia stuff down pat, baby. The Democrats have been <a href=\"https:\/\/www.westernjournal.com\/deep-dive-gop-votes-epstein-docs-release-arent-seem-dems-hoodwinked-everyone\/\" target=\"_blank\" rel=\"noopener\">trying to choke up the House of Representatives with meaningless nonsense<\/a>; all the GOP needs is a majority vote to impeach. Goose, gander, etc. And with an impeachment comes a trial, and with a trial comes the ability to present evidence and to have to answer for it under oath, if one wants to emerge clean.<\/p>\n<p>Harry Reid&rsquo;s&nbsp;<em>volte-face<\/em> on the judicial filibuster &mdash; including the views once allegedly held by Barack Obama, then abandoned when they burdened Obama &mdash; brought us Neil Gorsuch, Brett Kavanaugh, and Amy Coney Barrett.<\/p>\n<p>Post-administrative impeachment may bring us &hellip; well, let&rsquo;s put it this way: We may be on the precipice of the playing out of a popularly acronymed two-part process, the second half of which &nbsp;is usually described as &ldquo;finding out.&rdquo; Have fun, Dems!
