The California Charter School Association (CCSA) filed a lawsuit in April 2024, arguing that this policy discriminated against about 11,000 charter school students and undermined the goals of Proposition 39, which requires equal treatment of district and charter schools regarding space allocation. The judge sided with CCSA, affirming the rights of charter school students to access shared facilities. While LAUSD disputed most claims, critics said the district&#8217;s policy clearly violated the law. Now he says it&#8217;s &#8216;woke&#8217;<\/a><\/li>\n<\/ul>\n<\/div>\n<div class=\"article-paywall\">\n<p>The LAUSD board in February 2024 approved&nbsp;<a href=\"https:\/\/www.documentcloud.org\/documents\/24529526-031924-lausd-co-location-policy-special-meeting?responsive=1&amp;title=1\" target=\"_blank\" rel=\"noopener\" title=\"\">a policy<\/a>&nbsp;that told district administrators to &ldquo;avoid&rdquo; sharing with charter schools on certain campuses.<\/p>\n<div class=\"tpd-featured-video featured-post-video in-content bridtv\">\n<div id=\"Brid_2182176\" class=\"brid\" style=\"width:1280;height:720;\"> <\/div>\n<div class=\"tpd-featured-video-placeholder\" style=\"position:relative;overflow:hidden;width:100%;padding-top:56.25%;background-color:#000;\">\n<div style=\"position:absolute;top:0;left:0;bottom:0;right:0;width:100%;height:100%\"><\/div>\n<\/div>\n<\/div>\n<p>The California Charter School Association filed a&nbsp;<a href=\"https:\/\/calcharters.app.box.com\/s\/rs3cbezc3zub6lnd833bqbez8j37pko4\" target=\"_blank\" rel=\"noopener\" title=\"\">lawsuit<\/a>&nbsp;against the school district in April 2024.&nbsp;<\/p>\n<p>Goorvitch&nbsp;wrote that LAUSD&rsquo;s policy prevented the goals of&nbsp;<a href=\"https:\/\/www.energy.ca.gov\/programs-and-topics\/programs\/california-clean-energy-jobs-act-proposition-39-k-12-program\" target=\"_blank\" rel=\"noopener\" title=\"\">Proposition 39<\/a>, &ldquo;to treat District and charter schools equally with respect to the allocation of space.&rdquo;<\/p>\n<p>The lawsuit claims that LAUSD policy discriminated against roughly 11,000 charter school students.&nbsp;<\/p>\n<p>&ldquo;This is a victory for all public school families and a critical affirmation of the rights of charter public school students across Los Angeles,&rdquo;&nbsp;<a href=\"https:\/\/www.ccsa.org\/posts\/lausd-charter-access-ruling\" target=\"_blank\" rel=\"noopener\" title=\"\">said<\/a>&nbsp;Myrna Castrej&oacute;n, president and CEO of CCSA. &ldquo;We&rsquo;re grateful the court recognized that LAUSD&rsquo;s blatant attempt to exclude charter public school students from <a href=\"https:\/\/amzn.to\/3YuVZYV\" >learning alongside traditional district school students<\/a> in the communities they share violates California law.&rdquo;<\/p>\n<p>A Los Angeles Unified spokesperson told The Center Square that by carefully reviewing the court&rsquo;s ruling, it denied all of the CCSA&rsquo;s contentions, apart from two lines in the policy.&nbsp;<\/p>\n<p>&ldquo;CCSA significantly mischaracterizes the plain language of both the policy and last month&rsquo;s ruling. We remain firmly committed to serving the best interests of all students in our school communities while continuing to meet our legal obligations,&rdquo; a Los Angeles Unified spokesperson told The Center Square.&nbsp;<\/p>\n<p>Yet Eric Premack, the executive director of the&nbsp;Charter Schools Development Center, an organization that advises charter schools, said the ruling was indisputable.&nbsp;<\/p>\n<p>&ldquo;The district&rsquo;s policy favoring district-run schools over charter schools clearly violated the letter and intent of the law,&rdquo; Premack&nbsp;<a href=\"https:\/\/edsource.org\/2025\/judge-rules-lausd-broke-state-law-denying-charter-co-location-access\/737027\" target=\"_blank\" rel=\"noopener\" title=\"\">said<\/a>&nbsp;in a statement to EdSource. &ldquo;This situation is one in a long string of the district&rsquo;s efforts to evade this law.&rdquo;<\/p>\n<p>Because LAUSD student enrollment has significantly&nbsp;<a href=\"https:\/\/www.thecentersquare.com\/california\/article_8d72912d-fe3e-4b0a-9a72-aa278287e3ad.html\" target=\"_blank\" rel=\"noopener\" title=\"\">decreased<\/a>&nbsp;over the past two decades&nbsp;&mdash;&nbsp;747,009 in 2003-04 to 387,152 students this year&nbsp;&mdash;&nbsp;CCSA emphasized there is more than enough space to serve all public school students.&nbsp;<\/p>\n<p><strong><a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3482074\/court-strikes-down-california-background-check-ammunition-law\/\" target=\"_blank\" rel=\"noopener\" title=\"\">COURT STRIKES DOWN CALIFORNIA AMMUNITION BACKGROUND CHECK LAW<\/a><\/strong><\/p>\n<p>&ldquo;Our legal challenge clearly demonstrated how the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/washington-state-allowing-covid-vaccine-providers-to-prioritize-people-of-color-deny-vaccines-to-white-people\/\" title=\"Washington State Allowing COVID Vaccine Providers To Prioritize People Of Color, Deny Vaccines To White People\">policy violated state law<\/a>,&rdquo;&nbsp;<a href=\"https:\/\/www.ccsa.org\/posts\/lausd-charter-access-ruling\" target=\"_blank\" rel=\"noopener\" title=\"\">said<\/a>&nbsp;Julie Umansky, CCSA general counsel and executive director of the Charter Schools Legal Defense Fund. &ldquo;The judge&rsquo;s decision confirms what we knew to be true: The district must treat District and charter schools equally when it comes to facilities &mdash;
