Adoption is not a constitutional law dead zone. And a state&rsquo;s general conception of the child&rsquo;s best interest does not create a force field against the valid operation of other constitutional rights,&rdquo; the ruling said.<\/p>\n<p>The appeals court found Bates was likely to succeed in her case and granted a preliminary injunction preventing the Oregon Department of Human Services from deeming her ineligible to be an adoptive parent based on the statute it had previously cited.<\/p>\n<p>In his dissent, Clifton argued that the state was within its rights to deny Bates under the statute and disagreed with the majority&rsquo;s holding that the state violated her First Amendment rights.<\/p>\n<p>The lawsuit was <a href=\"https:\/\/www.washingtonexaminer.com\/news\/2757160\/oregon-denies-christian-mothers-adoption-request-over-stance-on-gender\/\" target=\"_blank\" rel=\"noopener\" title=\"originally filed in April 2023\">initially filed in April 2023<\/a>, after the state rejected Bates&rsquo;s application to adopt based on the gender affirmation requirement.
