Judge Waverly Crenshaw questioned the government&#8217;s claim that no release conditions could mitigate any danger Garcia might pose, suggesting he might grant bond. (AP Photo\/Mark Schiefelbein)<\/figcaption><\/figure>\n<p>&ldquo;Obviously, the court is going to look at the issues &hellip; I&rsquo;m having a hard time understanding your argument that there is by clear and convincing evidence no conditions that could control the danger posed by the defendant &hellip; that&rsquo;s a pretty high standard,&rdquo; said Crenshaw, an appointee of former President Barack Obama.<\/p>\n<p>Abrego Garcia, 29, is charged with two counts of&nbsp;<a href=\"https:\/\/www.washingtonexaminer.com\/tag\/immigration\" target=\"_blank\" rel=\"noreferrer noopener\">human smuggling<\/a>&nbsp;and has pleaded not guilty. Defense attorneys say he was unlawfully deported to&nbsp;<a href=\"https:\/\/www.washingtonexaminer.com\/tag\/el-salvador\" target=\"_blank\" rel=\"noreferrer noopener\">El Salvador<\/a>&nbsp;in March in violation of a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/traffickers-everywhere-cheer-judge-who-ruled-abrego-garcia-can-get-out-of-jail-despite-staggering-allegations\/\" title=\"Traffickers Everywhere Cheer ... Who Ruled ... Can Get Out of Jail, Despite Staggering Allegations\">2019 immigration court order<\/a> that found he would face gang-related persecution there. After the&nbsp;<a href=\"https:\/\/www.washingtonexaminer.com\/tag\/supreme-court\" target=\"_blank\" rel=\"noreferrer noopener\">Supreme Court<\/a>&nbsp;stepped in, the&nbsp;<a href=\"https:\/\/www.washingtonexaminer.com\/tag\/donald-trump\" target=\"_blank\" rel=\"noreferrer noopener\">Trump administration<\/a>&nbsp;eventually returned him to the United States in June, where he was promptly indicted and detained.<\/p>\n<p><span style=\"box-sizing: border-box; margin: 0px; padding: 0px;\">Prosecutors have said Abrego Garcia is&nbsp;<a href=\"https:\/\/www.washingtonexaminer.com\/news\/white-house\/3385269\/trump-highlights-photo-abrego-garcia-tattoo-ms13-knuckles\/\" target=\"_blank\">affiliated<\/a>&nbsp;with&nbsp;<a href=\"https:\/\/www.washingtonexaminer.com\/tag\/ms-13\" target=\"_blank\">MS-13<\/a>&nbsp;and poses a danger to the public.<\/span> But his defense team says if he is released, the&nbsp;<a href=\"https:\/\/www.washingtonexaminer.com\/tag\/department-of-homeland-security\" target=\"_blank\" rel=\"noreferrer noopener\">Department of Homeland Security<\/a>&nbsp;will move to deport him again, likely to a &ldquo;third country&rdquo; such as&nbsp;<a href=\"https:\/\/www.washingtonexaminer.com\/tag\/mexico\" target=\"_blank\" rel=\"noreferrer noopener\">Mexico<\/a>&nbsp;or&nbsp;<a href=\"https:\/\/www.washingtonexaminer.com\/tag\/africa\" target=\"_blank\" rel=\"noreferrer noopener\">South Sudan<\/a>, before he can exercise his right to trial.<\/p>\n<p>At the same time, a separate federal court in&nbsp;<a href=\"https:\/\/www.washingtonexaminer.com\/tag\/maryland\" target=\"_blank\" rel=\"noreferrer noopener\">Maryland<\/a>&nbsp;has not yet ruled in a civil lawsuit on whether to require DHS to give more advance notice before attempting any removal. U.S. District Judge Paula Xinis is considering a request to mandate 72 hours&rsquo; notice, a move that could temporarily stall deportation proceedings if Abrego Garcia is released.<\/p>\n<p>Xinis, also an Obama appointee, has previously signaled concern about the government&rsquo;s intentions, warning during a prior hearing that he could be &ldquo;whisked out of the country&rdquo; before legal challenges can be resolved. Her ruling could come soon, though some legal experts were perplexed as to why she did not rule before Wednesday&rsquo;s hearing in <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/tennessee\/\" target=\"_blank\" rel=\"noopener\" title=\"Tennessee\">Tennessee<\/a>, given that last week, she had signaled her intention to do so.<\/p>\n<p>During Wednesday&rsquo;s hearing in&nbsp;Nashville, prosecutors again relied on testimony from Homeland Security Investigations Agent Peter Joseph and introduced evidence related to a 2022 traffic stop in Tennessee, when Abrego Garcia was <a href=\"https:\/\/www.washingtonexaminer.com\/daily-memo\/3434546\/kilmar-abrego-garcia-returns-to-the-us-human-smuggling\/\" target=\"_blank\" rel=\"noopener\" title=\"\">allegedly transporting nine <a href=\"https:\/\/amzn.to\/3YuVZYV\" >illegal immigrant passengers<\/a><\/a>. A key exhibit for the government, an image of a handwritten &ldquo;roster&rdquo; that a state trooper asked the passengers to write with their names and birth years, has been criticized by the defense and by a magistrate judge for lacking reliability.<\/p>\n<p>Crenshaw likewise signaled skepticism when shown the image of the alleged passenger list, <a href=\"https:\/\/x.com\/KlasfeldReports\/status\/1945549381538656746\" target=\"_blank\" rel=\"noopener\" title=\"\">according<\/a> to a reporter who was inside the courtroom.<\/p>\n<p>Acting U.S. Attorney Robert McGuire argued the case before Crenshaw, continuing his hands-on involvement in the proceedings.
