The tracker evaluates states&#8217; compliance with title IX regulations as interpreted under Trump&#8217;s order, which emphasizes protecting all-female sports and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/harvard-launching-app-to-help-students-find-inclusive-bathrooms\/\" title=\"Harvard Launching App to Help Students Find Inclusive Bathrooms\">single-sex spaces<\/a> from what it calls &#8220;gender ideology extremism.&#8221; While 32 states have aligned with the order by enforcing policies that restrict male participation in female sports, 18 states-including California, Maine, and Minnesota-maintain policies allowing athletes to compete based on gender identity rather than biological sex.<\/p>\n<p>The Trump administration has initiated lawsuits against California and Maine for violating Title IX, and is investigating Minnesota, but most other noncompliant states have avoided federal enforcement so far. States like california and Maine have publicly rejected the federal directives, with officials arguing for inclusion of transgender athletes and disputing safety concerns for female athletes. Several states&#8217; education departments and athletic associations continue to support participation based on gender identity, resisting the executive order&#8217;s restrictions. Advocates for compliance argue that Title IX protections are legal requirements to prevent sex-based discrimination and ensure fairness and safety in women&#8217;s sports,while opponents frame the federal efforts as discriminatory or politically motivated.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Eighteen states are still dodging Trump&rsquo;s executive order that protects women by keeping biological boys out of girls&rsquo; sports, Defending Education&rsquo;s (DE) compliance <a href=\"https:\/\/defendinged.org\/investigations\/title-ix-state-tracker-compliant-or-not\/\" target=\"_blank\" rel=\"noreferrer noopener\">tracker<\/a> shows.<\/p>\n<p>The conservative organization&rsquo;s tracker assessed whether the 50 states are complying with &ldquo;Title IX regarding single-sex spaces and <a href=\"https:\/\/amzn.to\/3YuVZYV\" >single-sex interscholastic athletics&#038;rdquo<\/a>; in line with President Donald Trump&rsquo;s executive <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/defending-women-from-gender-ideology-extremism-and-restoring-biological-truth-to-the-federal-government\/\" target=\"_blank\" rel=\"noreferrer noopener\">order<\/a> &ldquo;defending women from gender ideology extremism.&rdquo; Eighteen states were found to be openly defiant of the order that &ldquo;protect[s] all-female athletic opportunities and all-female locker rooms&rdquo; based on &ldquo;public statements made by state officials or state policies,&rdquo; the <a href=\"https:\/\/defendinged.org\/investigations\/title-ix-state-tracker-compliant-or-not\/\" target=\"_blank\" rel=\"noreferrer noopener\">tracker<\/a> says.<\/p>\n<p>The Trump administration has sued two of the 18 states, <a href=\"https:\/\/thefederalist.com\/2025\/07\/09\/trump-doj-hits-california-with-title-ix-lawsuit-for-forcing-women-to-compete-against-men\/\" target=\"_blank\" rel=\"noreferrer noopener\">California <\/a>and <a href=\"https:\/\/apnews.com\/article\/maine-education-department-transgender-athletes-pam-bondi-5b5c8d0022233fae5ec60efc9fa5394f\" target=\"_blank\" rel=\"noreferrer noopener\">Maine<\/a>, for forcing girls to tussle and compete with boys in girls&rsquo; sports and is <a href=\"https:\/\/www.hhs.gov\/press-room\/ocr-title-ix-investigation-mn.html\" target=\"_blank\" rel=\"noreferrer noopener\">investigating<\/a> the state of Minnesota. Yet it appears that 15 other states have thus far avoided enforcement measures from the administration.<\/p>\n<p>&ldquo;The fact that 32 states are now compliant with Title IX shows that all we needed was an administration that used its authority to enforce federal law,&rdquo; Casey Ryan, investigative reporter for Defending Education, said in a statement.<\/p>\n<p>After Trump signed an <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/defending-women-from-gender-ideology-extremism-and-restoring-biological-truth-to-the-federal-government\/\" target=\"_blank\" rel=\"noreferrer noopener\">executive order<\/a> in January recognizing biological sex and barring men from playing in women&rsquo;s sports, Georgia, Indiana, Nebraska, Pennsylvania, Virginia, and Wisconsin soon after adopted policies or passed legislation requiring that men not be allowed to compete in women&rsquo;s sports.<\/p>\n<p>California, Colorado, Connecticut, Delaware, Hawaii, Illinois, Maine, Maryland, Massachusetts, Michigan, Minnesota, New Jersey, New Mexico, New York, Oregon, Rhode Island, Vermont, and Washington are the remaining 18 states that still enforce radical gender ideology instead of Trump&rsquo;s executive order, according to DE&rsquo;s tracker.<\/p>\n<p>The Department of Education found California in violation of Title IX on June 25, &ldquo;but the [state] entities have&nbsp;<a href=\"https:\/\/dailycaller.com\/2025\/07\/07\/california-ready-to-rumble-with-trump-to-keep-men-in-womens-sports\/\" target=\"_blank\" rel=\"noreferrer noopener\">refused to comply<\/a>&nbsp;with <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-justice-department-pick-helped-kill-pipeline-favored-by-key-senator\/\" title=\"Biden Justice ... Pick Helped Kill Pipeline Favored by Key Senator\">federal civil rights law<\/a> in order to ensure the state can harm as many women as possible,&rdquo; The Federalist&rsquo;s Breccan Thies <a href=\"https:\/\/thefederalist.com\/2025\/07\/09\/trump-doj-hits-california-with-title-ix-lawsuit-for-forcing-women-to-compete-against-men\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a> on Wednesday.<\/p>\n<p>California&rsquo;s Department of Education Superintendent Tony Thurmond published a <a href=\"https:\/\/edsource.org\/wp-content\/uploads\/2025\/06\/Update-Regarding-Compliance-with-Equal-Protection-Clause-of-U.S.-Constitution.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">statement<\/a> on June 3 telling school administrators to keep allowing students to play on sports teams that mirror their &ldquo;gender identity.&rdquo;<\/p>\n<p>After the Department of Justice filed a lawsuit against Maine for insisting that men should play women&rsquo;s sports, Maine&rsquo;s Attorney General Aaron Frey <a href=\"https:\/\/x.com\/alleighmarre\/status\/1912942904496013486\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a> there are &ldquo;no concerns of safety&rdquo; when it comes to females competing against males (and in some cases being seriously <a href=\"https:\/\/thefederalist.com\/2025\/04\/17\/maine-ag-wildly-claims-no-concerns-of-safety-with-men-in-womens-sports\/\" target=\"_blank\" rel=\"noreferrer noopener\">injured<\/a>), lying to boys by telling them they are girls, and making women strip naked in front of men.<\/p>\n<p>The &ldquo;<a href=\"https:\/\/www.house.mn.gov\/sessiondaily\/Story\/17865\" target=\"_blank\" rel=\"noreferrer noopener\">trans refuge<\/a>&rdquo; state, also known as Minnesota, also made it clear that it fully supports allowing gender dysphoria to rule sports. &ldquo;Female sports team participation in Minnesota is not restricted to the female sex,&rdquo; the Minnesota House of Representatives <a href=\"https:\/\/www.house.mn.gov\/sessiondaily\/Story\/18545\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a>. &ldquo;Nor will it be anytime soon.&rdquo;<\/p>\n<p>The Minnesota Department of Education and the Minnesota State High School League are currently under investigation to see whether they are discriminating against females by letting boys who claim to be girls steal opportunities from actual girls, the Department of Human Health and Services said in a June 26 <a href=\"https:\/\/www.hhs.gov\/press-room\/ocr-title-ix-investigation-mn.html\" target=\"_blank\" rel=\"noreferrer noopener\">press release<\/a>. The high school league continues to allow students to play according to their supposed &ldquo;gender identity,&rdquo; the tracker shows.<\/p>\n<p>The Illinois High School Association (IHSA), which says it does not receive federal or state funds, also made a <a href=\"https:\/\/www.ihsa.org\/News-Media\/Announcements\/ihsa-responds-to-illinois-lawmakers-regarding-transgender-laws\" target=\"_blank\" rel=\"noreferrer noopener\">statement<\/a> in April upholding its policy of letting boys pretend to be girls in sporting events.<\/p>\n<p>Maryland also issued a <a href=\"https:\/\/goci.maryland.gov\/wp-content\/uploads\/sites\/2\/2025\/03\/Statement-on-the-Federal-Attacks-on-Transgender-Marylanders-Adopted-on-3.10.2025.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">statement<\/a> in March making clear that &ldquo;opportunities&rdquo; will &ldquo;remain accessible&rdquo; for boys, so girls will be put in more physical harm while playing sports, saying Maryland has &ldquo;always been a state that values fairness, dignity, and inclusion.&rdquo;<\/p>\n<p>The statement also said Trump has &ldquo;launched an all-out assault&rdquo; on boys who pretend to be girls, calling for &ldquo;[l]eaders in the public and private sectors at all levels &hellip; to make full-throated declarations that transgender, nonbinary, and intersex youth, adults, and families will be protected and supported in Maryland.&rdquo;<\/p>\n<p>According to DE&rsquo;s tracker, New Jersey has not made a change to the state&rsquo;s rule that students can play sports according to the individual&rsquo;s so-called &ldquo;gender identity.&rdquo; The New Jersey State Interscholastic Athletic Association (NJSIAA), the governing body for <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/watch-psaki-pressed-about-girls-having-to-compete-against-trans-girls-dismisses-concerns\/\" title=\"WATCH: Psaki Pressed About Girls Having To ... Against Trans Girls, Dismisses Concerns\">high school sports<\/a> in New Jersey, <a href=\"https:\/\/www.northjersey.com\/story\/sports\/high-school\/2025\/02\/19\/transgender-policy-nj-high-school-sports-njsiaa-discusses\/79066418007\/\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a> it hasn&rsquo;t had any complaints about boys playing on girls&rsquo; teams, so the state is not going to abide by Trump&rsquo;s order.<\/p>\n<p>Washington&rsquo;s Superintendent Chris Reykdal also published a <a href=\"https:\/\/ospi.k12.wa.us\/about-ospi\/news-center\/news-releases\/state-superintendent-chris-reykdals-statement-president-trumps-order-discriminate-against-trans\" target=\"_blank\" rel=\"noreferrer noopener\">statement<\/a> in February saying Trump&rsquo;s order to protect women is &ldquo;disregarding the rule of law.&rdquo;<\/p>\n<p>Oregon and Vermont allow students to <a href=\"https:\/\/defendinged.org\/investigations\/title-ix-state-tracker-compliant-or-not\/\" target=\"_blank\" rel=\"noreferrer noopener\">choose<\/a> their &ldquo;preferred gender identity&rdquo; when it comes to playing on a sports team. <a href=\"https:\/\/www.nysed.gov\/sites\/default\/files\/nysed-oag-joint-statement-regarding-transgender-students.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">New York<\/a> and <a href=\"https:\/\/ride.ri.gov\/press-releases\/attorney-general-neronha-and-commissioner-infante-green-issue-guidance-schools-lgbtq-students-rights-and-diversity-programs?utm_\" target=\"_blank\" rel=\"noreferrer noopener\">Rhode Island<\/a>&rsquo;s attorneys general and education commissioners published statements in February telling schools to ignore the president&rsquo;s order to protect girls.<\/p>\n<p>&ldquo;While the majority of states are compliant with Title IX, there are still 18 states, including the District of Columbia, that have chosen noncompliance as their hill to die on,&rdquo; Kendall Tietz, investigative reporter for Defending Education, said in a statement.<\/p>\n<p>&ldquo;While young female athletes and students are forced to share single-sex spaces with biological males, leaders in states like California and Maine continue to play politics at the expense of women&rsquo;s rights,&rdquo; Tietz said. &ldquo;These are not optional guidelines; they are legal obligations designed to protect students from sex-based discrimination, including sexual harassment and assault.&rdquo;<\/p>\n<hr>\n<p>      Abigail Nichols is a correspondent for The Federalist.
