The policy requires supervisors to justify hiring decisions favoring candidates who are not from underrepresented groups-defined broadly as white males-in certain job roles. Established in 2002 and set to become a standalone rule in August, the policy aims to promote affirmative action by ensuring diversity, mandating that hiring managers interview multiple candidates from underrepresented groups and document reasons if a non-diverse candidate is chosen over more qualified diverse applicants. However, this practice has raised concerns about potential discrimination against white men and possible conflicts with recent Supreme Court rulings that require affirmative action measures to meet strict constitutional scrutiny by serving a compelling government interest and being narrowly tailored.Acting Deputy Assistant Attorney General Eric Sell will lead the DOJ investigation. Minnesota officials defend the policy as a lawful effort to fulfill affirmative action responsibilities and reflect the diversity of the state’s population.

Gov. The Minneapolis Star-Tribune reports that the DOJ’s Civil Rights Division has launched an investigation into a Minnesota policy requiring supervisors to justify hiring candidates who are not from underrepresented groups. These “underrepresented roles” generally exclude white men.

A letter from Harmeet K. Dhillon, assistant attorney general for the Civil Rights Division, to Minnesota Attorney General Keith Ellison explains that “underrepresented candidates” include women and racial minorities such as Black, Hispanic, Asian or Pacific Islander, American Indian, or Alaskan Native individuals. Employees who do not follow this policy risk disciplinary action up to termination.

This hiring justification rule is part of a broader affirmative action effort by Minnesota aimed at race- and sex-based employment goals. Established in 2002 by the Department of Human Services (DHS), it will become a standalone rule on August 12 that requires supervisors to get approval before offering jobs to white men in these “underrepresented positions.” These positions are broadly defined as those where certain protected groups have less representation than their availability in the local labor market.

The policy also mandates that if there are three or more underrepresented candidates available for a role, managers must interview at least three of them. If they choose a more qualified candidate outside these groups over an underrepresented applicant, they must document objective reasons such as qualifications and interview scores.

However, this approach may face legal challenges following recent Supreme Court decisions limiting affirmative action programs unless they meet strict scrutiny-meaning they serve compelling government interests and are narrowly tailored. Requiring prior approval for hiring white men in vaguely defined roles may not satisfy this standard.

The investigation will be led by acting deputy assistant attorney general Eric Sell. Meanwhile, Minnesota officials maintain that these rules help fulfill affirmative action obligations and promote workforce diversity reflective of their client base. The DHS stated it complies with all state and federal laws and noted similar justification requirements have existed since 1987 for some non-affirmative action hires.

In summary: Governor Walz’s administration could soon be held accountable by federal authorities over its race- and gender-conscious hiring policies designed to increase diversity within state employment

[33651
7076,5698,36113,3634,59058
post-2461387","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-the-western-journal","tag-doj","tag-minnesota","tag-tim-walz","tag-trump","tag-unlawful-action
["GET
